ORDIrvANCE NO. 3416
AN ORDINANCE relating to'and apportioning and levgfing special
assessments on certain lots and pieces of ground in the
City of Salina, Kansas, to, pay the cost,of curbing and
guttering; excavating, gradingand paving Crawford Avenue
from the east line of Tenth Street to the east ne o
the Missouri,Pacific Railroad Right -of -xray in the City
Of Salina, Kansas, and 'relating to and,providing for the
collection and payment of such assessments.
WHEREAS, pursuant to Resolution Number 405 duly adopted by the
Board of Commissioners'of,the City of Salina on February 7, 1927
and which resolution was duly adopted and ratified by the Board
of County Commissioners of Saline county, Kansas as required by
law and in accordance with Ordinance ivumber 3344 of said city
duly passed on, March -1140 1927 and Ordinance Number 3366 of said
city, duly passed'6h May 2, 1927, a contract has been let for the
curbing, guttering,` grading and paving of Crawford Avenue in said
city(connecting the existing pavement on urawford Avenue at Tenth
Street'; in said city with a certain county road in Saline County
extending west from the city limits of said city at the Missouri
Pacifie'Railr-oad right-of-way,) which said improvement is to be
paid for in accordance with provisions of Section 13-1032 ,to 13-
1035,,..inclusive, of the Revised Statutes of nansas 1923 as follows:
30 -per cent by the City of, Salina; Kansas; 3,0 -percent ,by,Saline
County,.Kansas; and 40 percent by the propertyliable to special
assessment as provided by law; and'.
'WHEREAS, the cost of said improvemen•t',as determined by the final
estimate of .the City Engineer of the`City of Salina, filed inthe
office of the City Clerk as provided by law on''the 5th day 'of ,
Jaly.:1927 has been determined and found to be'the sum of $26.,,618:75,
which amount 30 percent_ thereof -or 07 985.63 is ,to be paid by the
City 'of'Salina, and 30`percent thereof or $7,985.62 is to be paid
by Saline County, Kansas, and the remaining 40 percent thereof or
$10,647.50 is'to be.paid by the,property liable to. special assess-
ment therefor as provided by law; ;'NOW, THEREFORE,
BE::IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. That for.the purpose of payiI4g.for.that part of
the cost•of.curbing.,,'and guttering, excavating,, grading and paving
of Crawford Avenue from the eaa.t.'line„of Tenth Street to the east
line of the Missour.i,Pacific Railroad Right-of-way in the City of
Salina, Kansas, which is t'o'be paid for by the. property owners with-
in the benefit district provided by law, there are hereby levied
and assessed on the property liable therefor, being all the lots
and pieces of ground lying on either side of said street above
mentioned for the distance improved, as aforesaid, to the center
of the block„according to the appraised value of such lots and

pieces of groundwithout regard to the buildings or improvements
thereon, special assessments covering that portion of the cost of
such work and improvements assessable against such property)daid
special assessments being based on the special valuation and
appraisement of said lotsand pieces of ground heretofore made
by three disinterested appraisers,,appointed by the Board of
Commissioners of the City of Salina., Kansas.and,duly approved,
by the Board of County Commissioners of Saline County$ Kansas,
which said appraisement is,'hereby-referred;to,and made a part
of this ordinance,, and the several amounts levied.apportioned
and, assessed against such lots and pieces of ground for,the
purpose aforesaid are hereby foundand determined to be as follows:

ied for the year 192 and one of said installmenta faring due
each and every year thereafter until all. are paid, and all to

PROVIDSDo.that the owner of any piece of property liable;for
any such assessment may•redeem his property from such liability
by paying into the City Treasury the entire amount ohargeable_
against the same as in this ordinance designated;;at`any time
within thirty days after the publication of this. ordinance and,
before the issuance of the bonds. of said'City in -payment of``the
balance of said improvements, and his property so paid on shall
not thereafter be liable for any further assessment for the host
of said impvovements, nor for any part.o:,' said ::ands

against each lot and piece of ground described -in this ordinance
Al er cent, interest per annum on all of said installments
therein mentioned from the date of the bandsp which: may be
issued at the end of thirty days,; as specified in the preceding
section hereofo as by law provided, to the time of collection of
the last installment as provided by law; which said interest
shall be collected annually at the same time and in the same
manner as said installments are colleoted;_and after the taking.
effeot.of this ordinance it shall be the duty of the City Clerk
of said City to annually at the same time other taxes are oerti-
fiedo and until all of said assessments so,apportioned and levied
herein have been certified, to certify to the County Clerk of
Saline Countya Kansas, a full list of all property liable to.
assessment and taxation for such work and improvement except such
property on which the special assessments aforesaid have been
paid in full as hereinbefore provided, together with the respective
amounts due on each of siLt lots and pieces of ground, which
amounts shall inelude.the annual installments of such speR+p.'_
assessments togethar with the interest for one year at the rate
of 4Q per cent per annum on all unpaid balances of such
assessments at the beginning of each such year as aforesaid
and such amounta eo certified as herein provided shall be.plaoed
upon the tax roll by the County Clerk of Saline Countyo knsas,
and collected as all other taxes are collectsdo
Section 4. This ordinance shall..take effect and be in
full force from.and after its publication once in the official
