2948 Passengers for hireA 560 ORDINANCE NO. 2948 T)MI-,r Union 1,11arch 7th. 1924 An Ordinance relating to and regulating the conveyance of pas- sengers for hire in the City of Salina; fixing -fares and rates therefor; providing for the licensing of taxicabs - and the drivers thereof and the use of taximeters; pro- hibiting the use of taxicabs for certain purposes; pro- viding penalties for the violation of .this ordinance and repealing Section to of Ordinance Nw ber 1552 and all other ordinances or parts of ordinances in conflict with this ordinance. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas Section 1. '�ffienever used in this ordinance the following terms shall respectively be defined to mean: TAXICAB Any motor driven passenger vehicle for yrhich a charge os made for the carrying of passengers, except busses or other Vehicles operating between fixed points for which a fixed charge is made for each passenger between such points. In addition to the requirements and provisions now existing, or hereinafter provided for, no license shall be issued for the operation of any taxicab within the City of Salina, when the same is equipped with a taximeter until such taximeter shall have been inspected, tested and approved by the License Inspector, as shown by a certify uch Inspector, presented to the City Clerk at the,,.,.me sucn dense is applied for, and until the owner or-o'peratc c such taxicab has complied with .0 the provisions of �� .ons Three (3) and Four (4) hereof., which u_ said i-,qeter shallie in operation on such taxicab when any such test is made, A fee of Fifty cents (50�) shall be paid to the License Inspector for each inspection, before any certificate shall be issued by him, and the certificate shall show the pay- ment of such fee. Section 3. No license for the operation of any taxicab shall be issued until the applicant therefor shall file with the ,City Clerk a written application containing a description of such vehicle, the -. ke and type thereof, its motor or serial number, and the make and serial number of the taximeter, if there be one thereon, and the license inwd on any such application shall contain such description I+f` 11az taxicab and taxirmeter, w IN and shall apply to and ce particular taxicab and taximeter so describes. -1t. shall be unlawful for any person to use, drive or opera, either as owner, agent, employee or manager of the owner any taxicab within the City of Salina which shall not have been so licensed, and both the owner and driver of any such taxicab, if they be different persons, shall be deem -ed guilty of a any violation of the provisions of this section. ZZ 1 C. rr Ll CJ Any applicant for any such license shall first pay to the City %lerk the fee of such license, as now provided for b r ordinance, or which may be hereafter provided for by ordinance. Section 4. It shall be unlawful to operate a taxicab for hive or permit the same to be operated, nor shall any license be issued hereunder until and unless the applicant for license depos- its with the City Clerk a policy or certificate of liability in- surance for each taxicab for which a license is sought, said policy or certificate of liability insurance to be acceptable to and ap- proved by the Board of Commissioners and issued by a company auth- orized to do business in the State of Kansas, and having an author- ized representative in the City of Salina, indemnifying the appli- cant against liability for damages in,t" sub, of at least .Five Thousand Dollars (5,000.00) for ry�ne (1) person or Ten Thousand Dollars ( 10,000.010j�,f` Mfjtry to more than one person, ard. One Thousand Dollars ����.00 } property damage in any one accident, through the o r tion of a taxicab of the applicant; or deposits, in lieu thereof, the bond of a surety company authorized to do business in the State of Kansas and having an authorized representative in the City of Salina, indemnifying persons who may be injured or whose property may be damaged by the operation of any such taxicab in the same amount and conditioned that action may be brought thereon by any person so injured or damaged against said surety company for the amount of such damage up to the amount named therein, any such bond or certificate of insurance to be approved by the Board of Commissioners. The policy or insurance or bond so deposited shall contain a clause obligating the company issuing the same to give ten (10) days irrritten notice before cancellation thereof to the City Clerk, and the license for the operation of suds taxicab shall expire upon the lapse or termination of said policy or bond unless a new certificate or bond shall be filed and ap- proved before the expiration of such period. Section 5. The maximum rates of fare to be charged by or for the use 'of taxicabs for conveying persons with the usual hand baggage shall be as. follows: For the first mile or portion thereof for one person Thirty -rive cents (35�); for each succeeding one- half mile or any fraction thereon',, ,tem ce (a, '} for each four minutes or fractional part j,h6 e 1. of -offer ' ' e minutes waiting time for each addi' Tonal passenger over one for the ten cents (l0¢�); p entire trip, Twenty cents„ (20�) , PROVIDED, KOWEVEB., that no charge shall be made for the conveyance of children under the age of six 562 (6) years, when accompanied by a person caring for same. Section 6. The owner., driver or other person in charge or control of a taxicab may, upon request of a passenger, accept employment whereby the fare to be asked nay be computed at an agreed amount for the trip or by an hourly rental. When a taxi- cab is employed at an hourly rental the.. Section 7. Section 8. VI -never any taxicab shall not be equipped with a taximeter the maximum rates of fare to be charged for the use thereof shall be the same as the rates provided for in Section 5 of this ordinance. It shall be the duty of the License Inspector to examine, inspect and seal, at least every six months, all taxi - Meters or other registering meters used on any taxicab in the City of Salina, PROVIDED H0101EVER., that in the event complaint is made to said License inspector that any taximeter registers improperly or inaccurately at any time that he deems it necessary, it shall be the duty of said inspector to immediately examine said taximeter or other registering meter, and in case it does not property and ac- curately measure the distance traveled, e a pd 'x�egister the ar?ount of fares, in the case of a taximeter, termined and charged therefor, then in that event, unlawful for the owner or person in charge of such takica , b�,t o permit its use until such taxicab is equipped with a" 'xim er or other registering meter, approved by said License Inspector. When any such License is suspended or revoked the City 1da.nager shall notify the City Clerk thereof and the City Clerk's -hall make a note thereof on his records and shall not thereaf ter issue a license for any such vehicle, except as provided for herein. Section 25. The driver of any tax" ab sed for any of the purposes mentioned in Section 23 -,her person using or 0 c c upying the sane f or any s shall be deemed Z guilty of a misdemeanor and a friction thereof shall be pun- ished by a fine of not less Wenty-five Dollars ($25.00) nor more than Two Hundred Fif Dollars ($250.00) or by imprisonment in the City Jail for not less than ten (10) days nor more than sixty (60) days, or by both such fine and imprisonment. Section 26.. If any driver of any taxicab or other vehicle for hire shall be charged with the violation of any of the provis- ions of any of the foregoing sections in this ordinance,, the City Manager of the City of Salina shall have the authority to suspend his license during the pendancy of such charges, by a written order filed with the City Clerk and served on such driver, and if any such driver shall be convicted of any such violation, the license of such driver shall immediately stand revoked,� rescinded and suspended and it shall be the ty, k.the City 1danagen to notify the City Clerk of such rev W— No such person shall ther=after be permitted or i zeh-4,q of drive a taxicab witihin r ,z S the City of Salina until 9n;L-'' such right or privilege shall be specifically granted 461alff by the Board of Commissioners of the City of Salina andratil the revocation of such license shall be set aside by such Board of Corimissioners., PROVIDED HOWEVER, that in case of conviction of the violation of any of the provis- ions of Sect on 23 hereof, such revocation shall be permanent and the Board of Commissioners shall not thereafter set aside such revocation or grant a license to any such driver. Section 27. In addition to the requirements and provisions now existing, or hereinafter provided for, no -license shall be issued for the operation of any taxi -cab within the City of Salina, when the same is equipped with a taximeter until such taximeter shall have been in- spected, testedandapproved by the License Inspector, as shown by a certificate of such Inspector, presented to the City Clerk at the time such license is applied for, and until the owner or operator of such taxi -cab has complied with the provisions of Sections Three (3) and Four (4) hereof, which said meter shall be in operation on such taxi- cab when any such test is made. A fee of Fifty Cents (50¢) shall be paid. to the License.Inspector for each inspection, before any certificate shall be.issued by him, and the certificate shall show the payment of such fee. Section 3. Any applicant for any such license shall first pay to thePity Clerk the fee for such license, as now provided' for by ordinance, or which may be hereafter provided for by ordinance. Section 4. It shall.be unlawful to operate a taxi -cab for hire or p �} permit the same to be operated, nor shall until and unless the applicant for .license �1 a policy or certificate of liability insur license be issued hereunder its with the City Clerk for each taxi -cab for which a license is sought, said policy or/certificate of liability insurance to be acceptable to and approve by the Board of Commissioners and issued by a company authorized to / business in the State of Kansas., and having an authorized representaj'ive in the City of Salina, indem- nifying the applicant against liability for damages in the sum of at least Five Thousand Dollars ($5000.00) for injury to one (1) person or Ten Thousand Dollars (610,000.00) folr injury to.more than one person, and Ane`-Tti:ousand Gallars +($1000:/0O)property damage in any one accident, through the operation of a taxi-cabPof the applicant;: or deposits, in lieu there- of,.the bond of a surety ompany authorized to do business in the State of Kansas and having .authorized representative in the City of Salina, indemnifying persons/who may be injured or whose property may be damaged by the operation of/any such taxi -cab in the same amount and conditioned that action may be" brought thereon by any person so injured or damaged against said surety company for the amount of such damage up to the amount named.therein,✓any such bond or certificate of insurance to be approved by the Boa d'of Cormnissioners. The policy of insurance or bond so dep- osited shall contain a clause obligating the company issuing the same to Taxi Ordinance -- Page 3'. give ten (10) days written notice before cancellation thereof to th6a City Clerk, and the license for the operation of such taxi -cab -shall expire upon the lapse or termination of said policy or bond unless a new certificate or bond shall be filed and approved before the expiration of such period. Section 5. The maximum rates of fare to be charged by or for the Iilgiy,' use of taxi-cabs4for eonvying persons with the usual hand baggage shall be as follows.- For the/first mile or portion thereof for one person, r f Thirty-five cents (35¢) for each succeeding one-half mile or any fraction or fractional part thereof over five minutes i thereof, Ten cents( OCL); for each -four minutes�mraiting time, ten cents 6 ��\ (100; for each ditional passenger over one for the entire trip, "Q Twenty cents (20�), Provided however, that no charge shall be made for the conveyance ,if children under the age of six (6) years, when accompan- ied by a person caring for same. No charge shall be made for stops occasioned by� the driver himself or by reason of any defect or improper working condition of the taxi -cab, nor shall any charge be made because of premat•4e arrival upon a call. All charges herein are to be based upon the,dmost direct route. It shall be unlawful for any person owning, operatin"g or driving any taxi -cab, to charge, collect, receive or attempt to collect any rates in excess of the foregoing, except when arrangements have been previously made, as hereinafter provided for. Section 6. The owner, driver or other person in charge or control of a taxi -cab mag, upon request of a passenger, accept employment whereby the fare to be asked may be computed at an agreed amount for the trip or by an hourly rental. When a taxi -cab is employed at an hourly rental the maximum fare to be charged shall not exceed Q�_ per hour. This rate shall not be effective unless employment by the hour is arranged.for in advance of the trip, and if rented on a trip basis, the charge for such trip shall be agreed upon in advance, and it shall be unlawful to charge, collect or attempt to collect any other additional charge. Section 7. Whenever any taxi -cab shall have affixed thereto a taxi- meter, such taximeter shall be of a size and design approved by the Lic- ence Inspector of the City of Salina; shall be set not to exceed the rates 6 Taxi Ordinance -- Page 4. provided for in this ordinance; shall be in proper mechanical condition and in operation at all times, and shall at the conclusion of each trip discharge a printed slip showing the distance traveled and the fare, which slip shall be given to the passenger paying such fare. Section 8. Whenever any taxi" -cab shall not be equipped with a taxi- meter the maximum rates of fare to be charged for the use thereof shall be the same as the rates provided for in Section 5 of this ordinance. Any taxi -cab not so equipped with a taximeter shall be equipped with a speedometer or other registering meter, which shall accurately register and show the distance traveled, and such speedometer or meter shall be of a type which has what is known as a trip meter, which =+fe turned. to zero at the beginning of each and every .trip. The driver of any such taxi -cab shall, at the time of taking on any passenger, set said trip the meter at zero and/charge for any such trip shall,be based upon the actual by the moist direct route &istance traveled in making any iripdat the rates prescribed in Section 5. Any such registering meter shall be in all respects subject to the same_ regulations and inspections as in this ordinance provided for in the case of taximeters, in so far as any such regulations and provisions for inspection may be made to apply. The driver of any such taxi -cab shall give to the passenger paying such fare a receipt, which shall have printed thereon the name and the nugsber of such taxi -cab and shall show the date of the trip, the distance traveled, the point of beginning and destination, the number of persons carried and the charge for any such trip, and the drivers number, and shall be signed by the driver collecting such fare, such receipt to be in substantially the following form. If the driver of a taxi -cab shall have taken on or con- Taxi Ordinance -- Page 5* treated with one passenger, he shall not thereafter take on or accept employment by another passenger until the first passenger shall have been taken to his destination. -except -with the consent of the first passengers, and in any such case the fare or the rate of fare to be charged each such passenger shall be 'arranged for in advance. In no case shall the total amount collected from all of such passengers on any such trip be more than two-thirds (2/3) of the total amount which would have been due from such passengers traveling individually, by the most direct route from the starting point to destination. The term passenger used in this section shall apply to any group of two or more passengers having the same starting point and destination. Section 104 No person shall use or permit to be used upon any taxes' cab a taximeter or other registering meter which shall be in such con= dition as to be over five per cent (5%) incorrect to the prejudice of any passenger or which shall be operated from any wheel to which the power is applied, or which has not been duly inspected and approved. Section 11. After sundown the face of every taximeter or other reg- istering meter shall be ill4minated by suitable light so arranged as to throw continuous steady light thereon. Section 12. No person shall use or permit to be used or driven for hire a taxi -cab equipped with a taximeter, the case of which is unsealed and not having its covers and gears intact, or a taxi -cab without a taximeter whose registering meter has not been examined and approved, and which is not at all times in good working condition, or any taxi- cab, the use of which has not been duly licensed, Section 13. No driver. of a taxi -cab equipped, with a taximeter while carrying passengers or under employment shall display the signal affixed to such taximeter in such position to denote that he is unemployed. While carrying"passengers the signal must be in such position that the taxi- meter record the distance traveled and the fare, When such -driver is not employed said signal must be displayed in such position to denote that he is unemployedo no charge shall oemade for the time consmed in response to a call v in returning to the place from which such taxi -cab has been t Taxi Ordinance -- Page 6, 4f called, whether the taxi -cab be equipped with a meter or not. Section 14. It shall be the duty of the License Inspector to;exam- ine, inspect and seal, at least every six months, all taximeters or other registering meters used on any taxi -cab in the Oity of Salina, providedi. however, that in the event complaint is made to sadd License Inspector that any taximeter registers improperly or inaccurately at any time that he deems it necessary, it shall be the duty of said Inspector to immedi. iately examine said taximeter or other registering meter, and in it does not properly and accurately measure the distance traveled, and register the amount of fares, in the case of a taximeter, to be determined and charged therefor, then in that it event, it shall be unlawful for the owner or person in.charge of such taxi -cab to permit its use until such taxi -cab is equipped with a taximeter or other registering meter, approved by said License Inspector. For every inspection made by the License Inspector, as provided for in this ordinance, there shall be paid to said Inspector, a fee of Fifty Cents (50¢) by the owner or operator of such taxi -cab, provided however, that in case the,inspection or other registers is made upon complaint as herein provided and such taximeterXis found meter to be correct, said inspection fee shall be paid by the person making, said complaint and not by the owner or operator of such taxi -cab. Section 15, Every taxi -cab that is authorized and licensed to operate in the City of Salina shall be assigned a number by the City Clerk of said City, upon a certificate duly issued by said License Inspector that ;such taxi -cab is entitled to a license and has paid the fee therefor, and it shall be unlawful to operate a taxi -cab within the City of Salina unless said number be painted on each rear side door and on the rear of the said taxi -cab, the numberals to be usedto be plain and legible block numberals at least two (2) inches in height, and one (1) inch between. Each taxi -cab shall have painted thereon on each side the name of the person or company owning and operating the same; the letters constituting said name shall be block letters and at least one and one- half inches in height. Se e unlawful for any person to drive a taxi- Taxi Ordinance -- Page 7. b within the City of Salina until and unless such persons shall have secured from the City Clerk a license so to do. Every applicant for anuch license shall first file with the City Clerk an application in writin signed by the applicant, stating his age, name, present residence an.�( cupation, and his residence and occupation for the pre- ceeding two year and shall have endorsed on such application the cer- tificate of two repb�1�l.e citizens of the`City of Salina, to be approved by the City Clerk, andh such applicant is a person of good moral char- atter. For each such ind ual license the applicant therefor shall pay to the City Clerk a fee o e Dollar ($1.00) for any license so issued, which shall entitle the 'et>son receiving the same to drive a taxi- cab for hire within the City of Sal aauuntil the 1st day of January next, after the issuing of such license, or t the same shall be revoked, rescinded or suspended, as hereinafter pr i i If any such license shall be issued after the 1st day of July in any ye r the fee for a license k until the 1st day of January next thereafter sha 1 Abe one-half of the ert amount above prescribed. Every person who shall be granted a drivers license as provided for in the preceding section hereof, shall be issued a metal badge by the City Clerk, on which shall be engraved or stamped.the word, "taxi -cab" together with the number of such license, and it shall be the duty of the person receiving such badgeto wear the same conspicu- i ously, at all times while in the performance of his duties as such driver, and it shall be the further duty of every person operating or driving any taxi -cab to display inside of such taxi -cab a printed card or sign bearing, the name of such driver and his license number in such a position as to be in plain view of the occupants thereof, the letters and figures of'such name,and number to be not less than three-fourths inches in height, If the license is revoked, such badge shall be returned to the City Clerk,' Taxi Ordinance .-- Yage 8. Section 18. Every taxi -cab licensed for operation within the City of Salina shall be, at the times;sueh license is issued, and shall, at all times thereafter, be maintained in a good, sound, safe and.fit condition, both mechanically and otherwise for the use in'the business of carrying passengers 'for hire, and it shall be the duty of the License Inspector, before he shall approve a license of any taxi-cabi to ex- amine every such vehicle as to its physical and mechanical condition at the same time of his inspection of the taximeter or other registering; meter, and to include in his certificate a statement as to his approval or rejection of the condition of such taxi -cab, and no license shall be issued by the City Clerk until such condition has been approved by the License inspector. The decision of such License Inspector with reference to such condition shall be final and conclusive, except that the Board of Commissioners may, if they deem it proper and necessaFys by resolu- tion, direct the issuing of a license to any such taxi, -,which may have been rejected by such Inspector, and such Board of Commissioners may also, at any time, inquire, with reference to the condition of any such taxi -cab and may at any time revoke the license of any such taxi -cab if in the opinion of such Board its physical or mechanical condition renders it unfit for its use as a taxi -cab. 9. Ido person shall drive, use or permit to be used. any taxi -cab which unclean or unsanitary condition, and no person while intoxicated or under nf} uence of Intoxicating ligzor or whose person or clothing are in an unclean tang condition shall --- "e<e „ drive any taxi -cab or vehicle for hire within the City of Section 20. It shall be unlawful for any person to refuse to pay the legal fare for a taxi -cab, as prescribed in this ordinance, after having hired the same, and any person who shall hire any taxi -cab with the intention of defrauding the person from whom the same is hired shall be guilty of a misdemeanor. Section 21. The provisions of this ordinance shall�inot include any passenger vehicle for hire while being used for services at funerals or weddings. Taxi Ordinance -- Page 9. . Any person violating or refusing to comply with any of the foregoing pro vis thi ord ante shall be deemed guilty of a misdemeanor and upon conviction the 1 be unished by afine �of not more than One Hundred Dollars ($100.00) and c Ing such violation, failure or refusal shall continue shall constitute a sepa and distinct offense. Section 23. It shall be unlawful to drive, operate or use any taxi- cab for the purpose of prostitution or transporting any person or persons from any place within the City of Salina to any other place within or without said City or from any place outside of said City to any place therein for the purpose of prostitution, or to drive, operate or use any taxi -cab for transporting liquor from any place within the City of Salina to any other place within or without said City or from any place without said City to any place therein, or for any other unlawful purpose within the City of Salina. f has been driven, operated or Section 24.it shall be charged that any taxi-cab/used for any of the purposes mentioned in the preceeding section, the license.for the operation of such taxi -cab may be immediately suspended or revoked by the Board of Commissioners on the recommendation of the City Manager or on the motion of such Board and after any such suspension or revocation, any such , vehicle shall not thereafter be used, operated or licensed for use within the City of Salina as a taxi -cab or other vehicle for hire without the to®-&aAee express permission granted therefor by the Board of Commissioners and if the license has been revoked, without the issuance of a new license issued under the direction of the Board of Commissioners* When any such license is suspended or revoked the City Manager shall notify the City Clerk thereof and the City Clerk shall make a note thereof on his records and shall not thereafter issue a license for any such vehicle, except. as provided for herein. 0 Section 25. The driver of any taxi -cab used for any of the purposes mentioned in Section 23, or any other person using or occupying the same fv for any such purpose shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not less than Twenty- • Taxi Ordinance -- Fage 10. five Dollars ($25.00) nor more than Pwo Hundred Fifty Dollars ($250.00) or by imprisonment in the city jail for not less than ten (10) days nor more than sixty (60) days, or by both such fine and imprisonment. Section 26. If any driver of any taxi-cab.or other vehicle for hire shall be charged with the violation of any of the provisions of any of the foregoing sections of this ordinance, the City Manager of the City of Salina shall have the authority to suspend his license during the pendency of such charges, by a written order filed with the City Clerk and served on such driver, and if any such driver shall be convicted of any such violation, the license of such driver shall immediately stand revoked, rescinded and suspended, and it shall be the duty of the City Manager to notify the City Clerk of such revocation. No such person shall there. be after permitted or licensed to drive a taxi -cab within the City of Salina until or unless such right or privilege shall be specifically granted to him by the Board of Commissioners of the City of Salina and until the revocation of such license shall be set aside by such Board of Commission" ers, provided however, that in case ofconviction of the violation of any of the provisions of Section 23 hereof, such revocation shall be permanent and the Board of Commissioners shall not thereafter set aside such revo- cation or grant a license to any such driver. Section 27. Any person who shall drive any taxi -cab within the City of Salina after his individual drivers license shall have been re- scinded, suspended or revoked, or who shall operate or direct or employ any other person to dtive or operate any taxi -cab, the license for which has been suspended, rescinded or revoked, while such recission, suspension or revocation is in effect, shall be deemed guilty of a misdemeanor and.upon conviction thereof shall be punished in the same manner as provided for in Section 22 of this ordinance. Section 28. Wherever in this ordinance the owner or operator of any taxi -cab is referred to, such term or terms shall apply to the agent, officer, manager or members of any corporation, firm or partnership, owning or operating any such taxi -cab and any such agent, officer, manager or member of any such corporation, firm or partnership shall be subject 6 Taxi Ordinance -- Page 11; to any and all of the penalties provided for in this ordinance for the violation of any of the terms thereof by any such owner or operator. Section 29. The Building Inspector of the City of Salina shall, for the purpose of this ordinance, be deemed and shall be ex -officio Licence Inspector and shall perform all of the duties as provided in this ordin- ante, to be performed by the License Inspector, and shall have all of the rights and privileges granted by this ordinance to such License Inspector. Any and all fees collected by him, as such License Inspector, shall be accounted for in the same manner as other fees collected by him,in his official capacity, are accounted for, provided however, that such Building Inspector shall act as such License Inspector and shall be deemed to be the License Inspector for the purpose of tnis ordinance only and until further provisions for the performance of the duties of such office shall be prescribed by ordinance. Section 30. Section 10 of Ordinance No. 1552, approved April 18th, 1910 is hereby repealed and all other ordinances or parts of ordinances in conflict with this ordinance are hereby repealed. Section 31. This ordinance shall take effect and be in force from and after March 20th,,,1924 and after its publication once in the official City paper.
