An Ordinance specifying and selecting the paving material to be
used and letting a contract for the excavating, grading and
paving of University Place in the City of Salina, Kansas,
from the West line or—M=ker Street to the east line of Mis-
souri Pacific Railroad Plight -of -clay in said City, (except
the intersections of Phillips Street and College Avenue
rhich are already paved.)
BE IT ORDAINM by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. That it is hereby determined that University
Place in the City of Salina, Kansas from the west line of Baker
Street to the east line of Missouri Pacific Railroad Right -of -"'ay
in said City, (:except the intersections of Phillips Street and
College venue Which are already paved) shall be paved With one
course vitrified vertical fiber plain wire out brick., not less
than three, (3) inches deep. with asphalt filler laid on a founda-
tion of five (5) inches in depth of Portland Cement Concrete
base with one (1) inch sand cushion, such pavement within the
limits above defined to be thirty-one (31) feet excluding curb
and gutter.
Section 2. All excavating, filling and rolling necessary
for the proper construction of such improvements shall be done
and all of such improvements shall be made and done in strict
conformity to and in compliance With the plans and specifications
heretofore made by the City Engineer of Salina, Kansas and now on
file With the City Clerk of said City, which plans and specification
are hereby incorporated in and made a part hereof in all respects
as fully and completely as though written out at length herein;
which said plans and specifications are hereby adopted as and for
the plans and specifications of such work and improvements.
Section 3. That a contract is hereby awarded to C.P.Barringr
filling the above mentioned

street in the limits aforesaid with the materials hereinbefore
specified, for the paving actually laid and put inplace, for the
labor actually performed and the materials actually furnished at
the following prices: For excavating and grading U ne and No/1040
($1,00) Dollars per cubic yard; for paving actually laid and put
in place Three and 23/100 Dollars ($3.23) per square yard. All of
said work shall be paid for according to the measurement made by
the City -Engineer of the City of Salina. It is hereby determined
and found that the prices to be paid for the improvements as
aforesaid is less than the estimated prices of each and all of
said improvements now on file With the City Clerk of alina,
Kansas.

Section 4. Such contract is awarded upon the express condition
that such work and improvements shall be done in strict accordance
with and in compliance with the plans and specifications of the
City Engineer therefor, which plans and specifications are hereby
made a part off this ordinance and of the contract awarded, and upon
further conditions among others that the person to whom said contract
is awarded shall .furnish to the City of Salina a surety company bond
in the approximate sum of the cost of such improvements guaranteeing
the prompt, proper and workmanlike construction of all the same
together with a surety company bond guaranteeing such pavement
against all defects in material and workmanship for a period of
five (5) years from the date of its completion and acceptance by
said City; together with a good and sufficient surety company bond
running to the State of Kansas in an amount approximately equal to
the contract price of said improvements and conditioned that said
C. P. Barrington shall pay all indebetedness for labor and material
furnished in making the improvements provided for herein.
Section 5. The Board of Commissioners of the City of Salina,
are hereby authorized to make and enter into on behalf of said
City all written agreements necessary in order to secure the con-
struction of the improvements herein provided for,
Section 6. This ordinance shall take effect and be in
full force from and after its publication once in the official
City paper.
