ORDINANCE NTR�FIBER 2942.
An Ordinance specifying and selecting the material to be used
and letting a contract for the curbing and guttering of
Third Street in the City of Salina, Kansas from the south
line of Mul erry Street south to the Smoky Hila_ River.
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. That it is hereby determined that `Third Street
in the City of Salina, Kansas from the south line of Mulberry
E Street sough to the Smoky Hill River in. said City shall be curbed
and guttered with one piece combination cement curb and gutter,
said combined curb and gutter shall be comprised of a curb six
(6) inches thick at the top and six and one-half (61) inches
thick at the throat, with gutter twenty-four (24) inches wide.,
six (6) inches thick at the throat and seven (7) inches thick
next to the pavement.
Section 2. All excavating, filling and rolling necessary
for the proper construction of such improvements shall be done and
all of such improvements shall be made and done in strict con-
formity to and in compliance with the plans and specifications
heretofore made by the City Engineer of Salina, Kansas and now
on file with the City Clerk of said City, which plans and speci-
fications are hereby incorporated in and made a part hereof in
all respects as fully and completely as though written out at
length herein; which said plans and specifications are hereby
adopted as and for the plans and specifications of such work and
improvements.
Section 3. That a contract is hereby awarded to C. P.
Barrington for the curbing, guttering, excavating and filling
the above mentioned street in the limits aforesaid with the ma -
aerials hereinbefore specified, for the curbing and guttering
actually laid and put in place, for the labor a ctually performed
and the materials actually furnished at the following prices:
For excavating and grading One and Nof104 ($1.00) Dollars per
cubic yard; for Portland Cement Concrete combined curb and
gutter Ninety Cents (900 per lineal foot. All of said work
shall be paid for according to the measurement made by the City
Engineer of the City of Salina. It is hereby determined and
found that the prices to be paid for the improvements as aforesaid
is less than the estimated prices of each and all of said improve-
ments as now on file with the City Clerk of the City of Salina,
Kansas.
Section 4. Scuh cont=ract is awarded upon the express con-
ditions that such work and improvements shall be done in strict
accordance and in compliance with the plans and specifications
of the City Engineer therefor, which plans and specifications are
hereby made a part of this ordinance and of the contract awarded,
and upon further conditions among others that the person to whom
said contract is awarded shall furnish to the City of Salina a
surety company bund in the approximate sum, of the cost of such
improvements guaranteeing the prompt, proper and workmanlike
construction of all the same together with a surety company
bond guaranteeing such cirb and gutter against all defects in
material and workmanship for a period of two (2) years from the
date of its completion and acceptance of such work by the City;
together with a good and sufficient surery company bond running
to the State of Kansas in an amount approximately equal to the
contract price of said improvements and conditioned that said
C. P. Barrington shall pay all indebtedness for labor and material
furnished in making the improvements provided for herin.
Section 5. The Board of Conznissioners of the City of
Salina are hereby authorized to make and enter into on behalf
of said City all written agreements necessary in, order to secure
the construction of the improvements herein provided for.
Section 0. This ordinance shall take effect and be in
full force from and after its publication, once in the official
City paper.

Ah Ordinance specifying and selecting the material to be used

Third Street in the City of Salina, Kansas from the south
line of TUFerry Street south to the Smoky mill River
in said City.
BE IT ORDAINED by the Board of Commissioners of the City of
Salina, Kansas:

in the City of Salina, Kansas from the south line of Mulberry

curbed and guttered with one piece combination cement curb and gutter,
