An Ordinance specifying and selecting the paving material to be
used and letting a contract for the Sorbing, guttering, ex-
cavating, grading and paving Spruce treet in the City of
Salina , Kansas from the gest _11ne o : Ker Street to the
east line of Phillips Street ins aid City.
BE IT ORDAINED by the Board of Coman.i ssioners of the City of
Salina, Kansas.
Section 1. That it is hereby determined that Spr1ce_Street
in the City of Salina, Kansas from, the east line of fillips Street
to the west line of Baker Street in said City shall be paved with
one course vitrified vertical fiber plain wire out brick, not less
than three (3) inches deep, with asphalt filler laid on a. foundation
of five (5) inches in depth of Portland Cement Concrete base with
one (1)
inch
sand cushion, such pavement within the limits
above
defined
to be
twenty-six (26) feet in width excluding curb
and
gutter.
Section 2. That it is hereby determined that Spruce Street
in the City of Salina, Kansas from the cast line of Phillips
Street
to the west line of
Baker-Otreet
in said City
shall be
curbed
and guttered with one
piece
combination cement
curb and
gutter, said combined curb and gutter shall be comprised of a curb
six (6) inches thick at the top and six and one-half (62) inches
thick at the throat with gutter 24 inches wide, six (6) inches
thick at the throat and seven (7) inches thick next to the pave-
ment.
Section 3. Alle xcavating, filling and rolling necessary for
the proper construction of such improvements shall be done and all
of such improvements shall be made and done in strict conformity to
and in compliance with the plans and specifications heretofore made
by the City Eingeer of Salina, Kansas, and now on file with the
City Clerk of said City,. which plans and specifications are hereby
incorporated in and made a part hereof in all respects as fully and
completely as though written out at length herein; which said plans
and specifications are hereby adopted as and for the plans and speci-
fications of such work and improvements.
Section 4. That a contract is hereby awarded to C. F. Barring-
ton for the pavinf, curbing, guttering, excavating and filling the
above mentioned street in the limits aforesaid with the materials
hereinbefore specified, for the paving actually laid and put in
place, for the labor ac tually performed and the materials actually
furnished at the following prices: For excavating and grading
One and Nol166 01.00) Dollars per Cubic yard; for iortland cement
Concrete combined curb and gutter Ninety cents (94�) per lineal

foot; and for paving actuzlly laid and put in place Three and 23/100
($3.23) Dollars per square yard. All of said work shall be paid
for according to the e measurement made by the City Engineer of the
City of Salina. It is hereby determined. and found that the prices
to be paid for the improvements as aforesaid is less than the esti-
mated prices of each and all of said improvements as now on file
with the City Clerk of the City of 'Salina Kansas.
Section 5. Such contract is awarded upon the express conditim
that such work and improvements shall be done in strict accordance
with and in compliance with the plans and specifications of the
City Engineer therefor, which plans and specifications are hereby
made a part of this ordinance and of the contract awarded, and upon
further conditions among others that the person to whom said contract
is awarded shall furnish to the City of Salina a surety company
bond in the approximate sum of the cost of such improvements guar-
anteeing the prompt., proper and T�,rorkmanlike construction of all
the same together with a surety company bond guaranteeing such
pavement against all defects in material and workmanship for a
period_offive (5) years from the date of its completion and accept.

condition that said C. P. Barrington shall furnish the City of Sali-
na a good and sufficient surety company bond guaranteeing said
curb and gutter against all defects in material and workmanship for
a period of two (2) years from the date of its completion and ac-
ceptance of such work by the City; together with a good and suffi-
cient surety company bond running to the State of Kansas in an
amount approximately equal to the contract price of said improve-
ments and conditioned that said C. P. Barrington shall pay all in-
debtedness for labor and material furnished in iaaking the improve-
City paper.

are hereby authorized to make and enter into on behalf of said
City all written agreements necessary in order to secure the con-
struction of the improvements herein provided for.
Section 7. This ordinance shall take effect and be in

City paper.
