2873 Vac AlleyORDINANCE N0. 2873. _ (Published_in.ghe--o.alina_�veni -i.ournal— .�11t.1 °-1923 An Ordinance vacating a certain part of a certain alley in the City of Salina, Kansas, established by.Ordinanee No. 1643, and authorizing the re -conveyance of the land occupied by that part of the alley so vacated to The Kansas Ice and Storage Company. WHEREAS, under the provisions of Ordinance No. 1643 of the City of Salina, Kansas, adopted January 15th, 1912, the following describe& property to -wit: Commencing at the southeast corner of Lot 56 on Fourth Street, running thence west 70 feet, thence. -north 10 feet, thene east 70 feet, thence south 10 feet to place of begining, was establish- ed as a part of an alley, in leiu of another alley vacated by said ordinance No. 1643, and WHEREAS, in accordance with the provisions of said ordinance, the land above described with other land was conveyed to the City of Salina by The Kansas Ice and Storage Company by warranty deed., dated January 15th, 1912, which is recorded in Book.56.of Deeds at Page 540 in the office of the Register of Deeds of Saline County, Kansas, and WHEREAS, that part of the alley,above described which was so established by Ordinance No. 1643, and which was conveyed by said warranty deed, is no longer necessary for use as an alley, and is not used as such, and is inaccessible from Fourth Street, and should be vacated and returned to the former owner thereof, NOW THEREFORE, BE IT ORDAINED by the Board of Commissioners of the City of oalina, Kansas: Section 1. That that part of the present ten -foot alley lying north of the south line of Lot 56 on Fourth Street in the City of Salina, Kansas, described as follows, to -wit: Commencing at the south- east corner of Lot 56 on Fourth Street, running thence west 70 feet, thence north 10 feet, thence east 70 feet, thence south 10 feet to the place of beginning, all in the City of Salina, Kansas, be and the same is hereby vacated, set aside and discontinued as a public alley and driveway and that such ground so vacated shall revert to and become a part of Lot No.,56 on Fourth Street as the same was originally laid out and platted. Section 2. That the Mayor of the City of Salina, Kansas be and he is hereby authorized 'and directed to execute and deliver to The Kansas Ice and Storage Company, the owner of said Lot No. 56 on Fourth Street, from whom said land was conveyed to the City of Salina for use as an alley, a quit claim deed of said City, conveying that portion of said Lot No. 56 hereinbefore described and that said deed be attest- ed by the City Clerk and duly acknowledged according to law. bection 3.
