BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That it is hereby determined that Mulberry Street in the City of Salina, Kansas from the east line of Fifth Street to the west line of Second Street in said City, (except the intersections of Third Street and Fourth Street which are e already paved) shall be paved with one -course vitrified vertical t fiber plain wire cut brick, not less than three (3) inches deep, with asphalt filler filler laid on a foundation of five (5) inches in depth of Portland Cement Concrete base with one (1) inch sand scushion, such pavement within the limits above defined to be forty-one (41) feet excluding curb and gutter. Section 2. All excavating, filling and rolling necessary for the proper construction of such improvements shall be done 3 3 and all of such improvements shall be made and done in strict conformity to and in compliance with the plans and specifications heretofore made by the City Clerk of said City, which plans and specifications are nowon file with the City Clerk of said City, which plans and specifications are hereby incorporated in and made a part hereof in all respects as fully and completely as though written out at length herein; which said plans and specifications are hereby adopted as and for the plans and specifications of such work and improvements. Section 3. That a contract is hereby mfaarded to C. P. BarriiT ton for the excavating, grading and paving the above mentioned street in the limits aforesaid with the materials hereinbefore specified, for the paving actually laid and put in place, far the labor actually performed and the materials actually furnished at the following prices: For excavating and grading One and Tho/100 ($1.00) per cubic yard; for paving actually laid and put inplace Three and 23/100 ('3.23) per square yard. All of said / p q work shall be paid for according to the measurement made by the City Engineer the City Salina, It of of is hereby determined and found that the prices to be paid for the improvements as aforesaid is less than the estimates prices of each and all of said improvements as now on file with the City Clerk of the City of Salina, Kansas. Section 4. Such contract is awarded upon the express condition that such work and improvements shall be done in strict accordance with and in compliance with the plans and specifications of the City Engineer therefor, which plans and specifications are hereby made a part of this ordinance and of the contract awarded, and upon further conditions tamong others that the person to whom said contract is awarded shall furnish to the City of Salina a surety company bond in the approxin,.ate sum of the cost of such improvements guaranteeing the prompt, proper and w orkmanlike con- struction of all the saute together with a surety company bond guaranteeing such pavement against all defects in material and workmanship for a period of five (5) years from the date of its completion and acceptance by said City; together with a good and sufficeitn surety company bend running to the State of Kansas in an amount approximately equal to the contract price of said improvements and conditioned that said C. P. Barrington shall pay all indebtedness for labor and material furnished in making the improvements provided for herein. Section 5. That the Board of Commissioners of the City of Salina are'hereby autborized to make and enter into on behalf of said City ally ritten agreements necessary in order to secure the construction of the improvements herein provided for, Section. 6. This ordinance shall take effect and be in full force and effect from and after its publication once in the of'f'icial City paper. All of said work shall be paid for according to the measurement made by the City Engineer of the City of Salina.
