An Ordinance specifying and selecting the paving material to -be
used and letting a contract for the curbing, guttering
excavating, grading and paving Morrison Avenue in the dity
of 0alina, Kansas from the gest I= _oT Tenthstreet to the
east line of Eleventh Street in said City.
BE IT ORDAINED by the Board of Commissioners of the City of
Salina.. K nsas;
Section 1. That it is hereby determined that Morrison Avenue
in the City'of Salina, Kansas from the west line of Tenth Street
to the east line of Eleventh Street in said City shall be pawed
with one course vitrified vertical fiber plain wire cut brick, not
less than three (3) inches deep, with asphalt filler laid on a
foundation of five (5) inches deep, in depth of Portland Cement
Concrete base with one (1) inch sand cushion, such pa -.e merit within
the limits above defined to be twenty-six (26) feet in width ex -
eluding curb and gutter.
Section
2. That
it is hereby determined that
Morrison Avenue
in the City of
Salina,
Kansas from the west line of
Tenth Street
to the east line of Eleventh Street in said City shall be curbed
and gutteredwith one piece combination cement curb and gutter,
said combined curb and gutter shall be comprised of a curb six
(6) inches thick at the top and six and one-half (62) inches
thick at the throat, with gutter twenty-four (24) inches wide,
six (6) inches thick at the throat and seven (7) inches thick
next to the pavement.
Section 3. All excavating, filling and rolling necessary for
the proper construction of such improvements shall be done and all
of such improvements shall be made and f one in strict conformity to
and in compliance with the plans and specifications heretofore
made by the City Engineer of Salina, Kansas and now on file with
the City Clerk of said City, which plans and specifications are
hereby incorporated in and made a part hereof in all respects
as fully and completely as though written out at length herein;
which said plans and specifications are hereby adopted as and:
for the plans and specifications of such work and improvements.
Section 4. That a contract is hereby awarded to C. P. Bar-
rington for the paving, curbing, guttering, excavating and filling
the above mentioned street in the limits aforesaid with the mater-
ials hereinbefore specified, for the paving actually laid and put
inplace, for the labor actually,performed and the materials actu-
ally furnished at the following prices; For excavating and grad-
ing One and No/100 ($1,.00) Dollars per cubic yard; for Portland
Cement Concrete combined curb and gutter Ninety cents (94�) per
lineal foot, and for paving actually laid and put in place '-three
and 23/100 Dollars ($3.23) per square yard. All of said work shall
be paid for according to the measurement made by the City engineer
of the City of Salina. It is hereby determined and found that the
prices to be paid for the Improvements as aforesaid is less than tle
estimated prices of each and all of said improvements as now on
file with the City Clerk of the City of Salina, Kansas.
Section 5.- Such contract is awarded upon the express condi-
tion that such work and improvements shall be done in strict accord-
ance with and in compliance with the plans and specifications of the
City Engineer therefor, which plans and specifications are hereby
made a part of this ordinance and of the contract awarded, and upon
further conditions among others that the person to whom said con-
tract is awarded shall furnish to the City of Salina a surety com-
pany bond in the approximatel sum of the cost of such improvements
guaranteeing the prompt., proper and workmanlike construction of all
the same together with a surety company bond guaranteeing such
pavement against all efects in material and workmanship for a
period of five ',(5%)years from the date of its completion and ac-
ceptance by said City; and said contract is awarded upon a further
condition that said C. P. Barrington shall furnish the City of
Salina a good and sufficient surety company bond guaranteeing said
curb and gutter against all defects in niate-rial and workmanship for
a period of two (2) years from the date of its completion and ac-
ceptance of such wort by the City; together with a good and suffiedh
surety corapany company bond running to the State of Liansas in an
amount approximately equal to the contract price of said Improve-
;mients and conditioned that said C. F. Barrington shall pay all
indebtedness for labor and material furnished in making the --luri-
Drovements provided for herein.
Section 6. The Board of Corimissioners Of the City Of Salina
are hereby authorized to make and enter into on behalf
of said
City all written agreements necessary in order to secure the con-
struction of the im-prove.ments herein provided for.
Section 7. This ordinance shall take effect and
be in
full force from and after its publication once in the
official
City paper.
