An ordinance specifying and selecting the paving material to be
used and letting a contract for the curbing, guttering, ex-
cavating, grading and paving of Eleventh Street in the
City of Salina, Kansas from the north line of Washington
Avenue to the north line of Prescott Avenue in said City.
BE IT ORDAINED by the Board of Cortmmissioners of the City of Salina,
Kansas:
Section 1. That it is hereby determined that Eleventh Street
in the City of Salina, Kansas from the north line of ilashington
Avenue to the north line of Prescott Avenue in said City shall be
paved with one course vitrified vertical fiver plain wire cut brick,
not less than three (3) inches deep, with asphalt filler laid on
a foundation of five (5) inches in depth of Portland Cement Concrete
base with one (1) inch sand cushion, such pavement within the limits
above defined to be twenty-six (26) feet in width excluding curb
and gutter.
Section 2. That it is hereby determined that Eleventh Street
in the City of Salina, Kansas from the north line of Washington
.Avenue to the north line of Prescott Avenue in said City shall be
curbed and guttered with one piece combination cement curb and gutter,
said combined curb and gutter shall be comprised of a curb six (6)
inches thick at the top and six and one-half (61) inches thick at
the throat, with gutter twenty-four (24) inches wide, six (6) inches
thick at the threat and seven (7) inches thick nect to the pavement.
Section 3. All excavating, filling and rolling necessary for
the proper construction of such improvements shall be done and all
of such improvements shall be made and done in strict conformity to
and in compliance with the plans and specifications heretofore made
by the City Engineer of Salina, Kansas and now on file with the City
Clerk of said City, which plans and specifications are hereby incor-
porated in and made a part hereof in all respects as fUll.y and com-
pletely as though written out at length herein.; which said plans and
specifications are hereby adopted as and for the plans and specifi-
cations of such work and improvements.
Section 4. That a contract is hereby awarded to C. P. Barring-
ton for the paving, curbing, guttering, excavating and filling the
above mentioned street in the limits aforesaid with the'materiaals
hereinbefore specified, for the paving actually laid and put in
place, for the labor actually performed and the materials actually
furnished at the following prices: For excavating and grading One
and No/100 01.00) Dollars per cubic yard; for rortland Cement Con-
crete combined curb and gutter Ninety cents (90/) per lineal foot,
and for paving actually laid and put in place Three and 23/100
Dollars (`:3.23) per square yard/ All of said work shall be paid
for according to the measurement made by the City Engineer of
the City of Salina. It is hereby determined and cound that the
prices to be paid for the improvements as aforesaid is less than
the estimated prices of each and all of said improvements as now
on file with the City Clerk of the City of Salina, Kansas.

tion that such work and improvements shall be done in strict accord-
ance with and in compliance with the plans and specifications of
the City Engineer therefor, which plans and specifications are
hereby made a part of this ordinance and of the contract awarded,'
and upon further conditions among others that the person to Whom
said contract is awarded shall furnish to the City of Salina a
surety company bond in the approximate sum of the cost of such
improvements guaranteeing the prompt proper and workmanlike con-
struction of all the same together with a surety company bond
guaranteeing such pavement against all defects in material and
workmanship for a period of five (5) years from the date of its
completoin and acceptance by said City; and said contract is award-
ed upon a further condition that said C. P. Barrington shall fur-
nish to the City of Salina a good and sufficient surety company
bond guaranteeing said curb and gutter against all defects in
material and workmanship for a period of two (2) years from the
date of its completion and acceptance of such work by the City;
together with a good and sufficient surety company bond running
to the State of Kansas in an amount approximately equal to the
contract price of said improvements and conditioned that said
C. P. Barrington shall pay all indebtedness for labor and material
furnished in making the improvements provided for herein.
Section 6. — The Board of Cor.missioners of the City of
Salina are hereby authorized to make and enter into on behalf
of said City all written agreements necessary in order to secure
the construction of the improvements herein provided for.
Section 7.- This ordinance shall take effect and be in full
force from and after its publication once in the official City
paper,*
