An ordinance specifying and selecting the paving material to'be
used and letting a contract for the curbing, guttering, ex-
eavgting, grading and paving of Eleventh Street in the City
of alinas Kansas from the south lT`n_0o_f7F1_0_r_rTson Avenue to
the -north line of Oashington Avenue in said City.
BE IT ORDAINED by the Board of Commissioners of the City of Salina..
Kansas:
Section 1. That it is hereby determined that Eleventh Street
in the City of Salina., Kansas from the south line of 1,.Aorrison "venue
to the north line of Washington Avenue in said City shall be paved
with one course vitrified vertical fiber plain wire cat brick, not
less than three (3) inches deep, with asphalt filler laid on a found-
ation of five (5) inches in depth of Fortland vement Concrete base
with one (1) inch sand cushions such pavement within the limits
above defined to be twenty-six (26) feet in width excluding curb
and.gutter.
Section 2. mThat it is hereby determined that Eleventh Street
in the city of Salina, Kansas from the south line of Morrison Avenue
to the north line of Washington Avenue in said City shall be curbed
and guttered with one piece combination cement curb and gutter, said
combined curb and gutter shall be comprised of a curb six (6) inches
thick at the top and six and one-half (61) inches thick at the

throat and seven (7) inches thick next to the pavement.
Section 3. All excavzting, filling and rolling necessary for
the proper construction of such improvements shall be done and all
of such Improvements shall be made and done in strict conformity to
and in compliance with the plans and specifications heretofore made
by the City Engineer of Salina,, Kansas and now on file with the City
Clerk of said City, which plans and speficications are hereby incor-
porated in and made a part hereof in all respects as fully and com-

pletely as though written 6ut at length herein; which said plans and
specifications are hereby adopted as and for the plans and speci-
fications of such work and improvements.
Section 4. That a contract is hereby awarded to C. P. Barring-
ton for the paving., curbing., guttering, excavating and filling the
above mentioned street in the limits aforesaid with the materials
hereinbefore specified, for the paving actually laid and put in
place, for the labor actually performed and the materials actually
furnished at the following prices: i'or excavating and grading
one and No/loo Dollars ($1.00) per cubic yard; for Cortland ement
Concrete combined curb and gutter Ninety cents (90¢) per lineal
foot; for paving actually laid and put in place Three and 1 23/100
Dollars ($3.23) per square yard. All of said work shall be paid
for according to the -,T.easurement made by the City Engineer of the
City of Salina. It is hereby determined and found that the prices
to be paid for the improvements as aforesaid is less than the -
prices to be paid for the improvements as aforesaid is Less than
the estimated prices of each and all of said improvements as now
on file with the City Clerk of the City of Salina, Kansas.
Section 5. Such contract is awarded upon the express condition
that such work and improvements shall be done in strict accordance
with and in compliance with the plans and specifications of the
City Engineer therefor, which plans and spefifications are hereby
made a part of this ordinance and of the contract awarded., and
upon further conditions among others that the person to whom said
contract is atn�arded shall furnish to the City of Salina a surety
company bond in the approximate sum of the cost of such improve-
ments guaranteeing the prompt, proper and worImmnlike construction
of all the same together with a surety company bond guaranteeing
such pavement against all defects in material and wormanship for a
period of five (5) years from the date of its completion and
acceptance by said City; and said contract is awarded upon a fur-
ther condition that said C. P. Barrington shall furnish. tht Oity
of Salina a good and sufficient surety company bond guaranteeing
said curb and gutter against all defeats in material andworkman-
ship for a period of two (2) years from, the date of its completion
and acceptance of such worg by the City; together with a good and
sufficient surety company bund running to the State of Kansan'in
an amount approximately equal to the contract price of said im-
provements and conditioned that said C. P. Barrington shall pay
all indebtedness for Labor and material furnish in making the imp-
provem.ents <provided for herein.
Section 6. The Board of Commissioners of the City of
Salina, are hereby authorized to rake and enter into on behalf
of said City all written agreements necessary in order to secure
the construction of the improvements hterin provided for.
Section 7. This ordinance shall take effect and be in
full farce from and after its publication once in the official
City paper,
