N-REEAs, by resolutions duly adopted on the 24th day of September 1023 and on the 13th day of October 1023, the Board of Commissioners of the City of Salina, Kansas have declared that they deem it necessary to excavate, grade and pave all of the unpaved portion of Santa Fe Avenue in the City of Salina, ansas in the center of said Santa Fe Avenue, as now occupied by the tracks of the Salina Street Railway Company, from a point 230 feet south of South Street to the north line of Beloit Avenue therein, and ': � 1'iS, sa. id 1,e.solutions were published for six days in The Salina -Evening Journal, a daily newsppaer publi to the specifications of theGIty Engineer of said City as herein- after provided, and that said Santa Fe Avenue between the limits aforesaid be paved for a width of twelve (12) feet. Section 3. For the work and improvements herein provided for the City Engineer shall make and file with the City Clerk on or before the 25th day of February 1924, complete plans and speci- fications for the paving of said street with the following materi- als: 1. 3 -inch Vertical fiber plain wire'eut brick, 5 -inch concrete base. Asphalt filler, and that on or before the last named date said City Engineer shall submit to the Board of Commissioners under oath, detailed estimate of the cost of such paving of said street with the different kinds of material herein mentioned and of the excavation and grading of said street. Section 4. That after such plans and specifications shall have been made and prepared by the City Engineer and filed with the City Clerk as aforesaid., the Board of Commissioners may adv6rtise by advertisement publihhed in the official City paper of the City of Salina,, for 6 consecutive days for the receipt of sealed propos- als for Ihe paving of said street with the different kinds of paving material named and specified in the preceding section here- of and for the excavating and grading of said street to the estab- lished grade thereof as herein provided for; and after the re- ceipt of such proposals the Board of Commissioners shall select from the different kinds of street paving material the kind with which said street ought in their judgment be paved and said Board of Commissioners may and are hereby authorized to let contracts for the grading excavating of said street to the loviest responsible bidder therefor, and for the paving of such street with the mater ials so selected to the lowest responsible bidder therefor, as determined by said Board of Commissioners foi, the kind and charadt- er of paving which shall be determined upon by said Board of Com- missioners and for such eXcavating and gradin& SaidBoard of Commissioners reserve the right to reject any and all bids. Section 5. That for such paving special assessments shall be made for the full cost thereof on each block separately, on all lots or pieces of land to the center of the block on either side of the street, according to the appraised value thereof, without I regard to the bWklidings or improvements thereon, dor the distance I- to be improved. The entire distance to be graded shall constitute one grading district. time for holding a special session of such Board for the purpose of hearing any complaints that may be made as to the value of any lots or pieces of land appraised as aforesaid, of which special I session due notice shall be given in the official City paper, at which special session the Board of CormAssioners may alter any valuation of any lot or piece of land if in their opinion the same has been appraised too high or too low. Section 7 For the purpose of paying for the work and :Im- Drovement in this ordinance provided for., the Board of Commission- ers are hereby authorized and directed to issue internal improve- ment bonds of the City of Salina, in an amount not to exceed the contract price of such improvements, and to run for a period of ten years3, and be payable in ten equal installments, together with the interest not to excedd five (5) per centmn per annmi, v-,ihich bonds shall be made payable at the fiscal agency of the State of kansas; and for the purpose of paying principal and interest on I said bonds as they severally become due and payable, the Board of Commissioners shall apportion and assess against the lots and -oieces of land �4iithin the taxing district of such improvements and special assessments covering the cost of such improvement -vi and the apportionment therein contained shall hold good for all the installments that are to be collected from the specific property chargeable with said Jr-,lprovements. Such assessment and apport- ionemtn ordinance shall contain the total amount of tax apport- ioned to each tract piece and parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected* and thereqfter the City Clerk shall annually., at the same time other taxes are certified, certified to the County Clerk of Saline County, Kansas a full list 500 IT: 'Section 6. After the passage and -publication of this ordinance the Board of Commissioners shall appoint three disinter. ested appraisers,, householders, who after having taken an oath to make a true and impartial appraisement of all lots and pieces of land liable to assessment and taxation for the cost of the improve» ments herein provided for, shall, within five days after having been notified of their appointment, proceed to appraise said lots and pieces of land liable to assessment and taxation as aforesaid, as may be designated by the Board of Cormiissioners of said City, with- out regard to the buildings or imporvements thereon, and after making said appraisement shall return the same to the Board of U CormAssioners and said Board of Commissioners shall designate a time for holding a special session of such Board for the purpose of hearing any complaints that may be made as to the value of any lots or pieces of land appraised as aforesaid, of which special I session due notice shall be given in the official City paper, at which special session the Board of CormAssioners may alter any valuation of any lot or piece of land if in their opinion the same has been appraised too high or too low. Section S. This ordinance shall take effect and be in full force from and after its publication onece in the official City paper. WHEREAS, by resolutions duly adopted on the 24th day of September 1923 and on the 15th day of October 1923, the Board of Commissioners of the City of Salina, Kansas have declared. that they deem it necessar to excavate, grade and pave all of the unpaved portion of �anta Fe Avenue in the City of Salina, Kansas, in the center of said Santa Fe Avenue, as now occupied by the tracks of the Salina Street Railway Company, from a point 230 feet south of South Street to the north line of Beloit Avenue therein, and WHEREAS, said resolutions were published for six days in The Salina Evening Journal, a daily newspaper published in the City of Salina, the official City paper of said City, and WHEREAS, the majority of the resident property owners, owning a majority in square feet of the lots or real estate liable to taxation for the cost of said improvements did not within twenty days from the date of the last publication of such resolution file with the City Clerk of said City their protest in writing against such improvement or the making thereof, THEREFORE, BE IT ORDAINED by the Board of Commissioners of'the City of Salina, Kansas: Section 1. That it is necessary and it is hereby ordered that all of the unpaved portion of Santa Fe Avenue, in the City of Salina, Kansas in the center of said Santa Fe Avenue as now occupied by the tracks of the Salina Street Railway Company from a point 230 feet south of South Street to the north line of Beloit Avenue in said City (with the exception however of the intersections of said Santa Fe Avenue with Prescott Avenue, Craw- ford Avenue, Bond Street, Wilson Street and Republic Avenue in said City, which said intersections have already been excavated, graded and paved) be excavated and graded to the established grade thereof, as established by ordinances of the City of Salina, Kansas. Section 2. That it is necessary and it is hereby ordered that all of the unpaved portion of Santa Fe Avenue, in the City of Salina, Kansas in the center of said Santa Fe Avenue as now occupied by the tracks of the Salina Street Railway Company from a point 230 feet south of South Street to the north line of Beloit Avenue in said City (with the exception however of the intersections of said Santa Fe Avenue with Prescott Avenue, Crawford Avenue, Bond Street, Wilson Street and Republic Avenue in said City, which said intersections have already been excavated., graded and paved) be paved with such material as the Board of Commissioners may here- after designate and select as hereinafter provided for according to the specifications of the City Engineer of said City as herein- after probided, and that said Santa Fe Avenue between the limits aforesaid be paved for a width of twelve (12) feet. That after such plans and specifications shall have been made and prepared by the City Engineer and filed with the City Clerk as aforesaid, the Board of Commissioners may advertise by advertisement published in the official City paper of the City of Salina for consecutive days for the receipt of sealed pro- posals for the paving of said street with the different kinds of paving material named and specified in the Tr e ceding section 0 r' hereof, and for the excavating and grading of said street to the established grade thereof as herein provided for; and after the receipt of such proposals the Board of Commissioners shall select from the different kinds of street paving material the kind with which said street lught, in their judgment be paved and said Board of Commissioners may and are hereby authorized.to let contracts for the grading and excavating of said street to the lowest responsible bidder therefor, and for the paving of such street with the materials so selected to the lowest responsible bidder therefor, as determined by said Board of Commissioners for the kind and character of paving which shall be determined upon by said Board of Commissioners'and for such excavating and grading. Said Board of Commissioners reserve the right to reject any and all bids. Section 5.
