2916 Prohibiting Narcotic DrugsAn ordinance prohibiting the possession., bartering, sale, exchang- ing, or giving away of opium or coca Leaves, or any compound salt, derivative or pre M.-fi6n thereof, or of other narcotic drugs mentioned in said ordinance, and Th king the the viola- tion thereof a`m.isdexmeanor and providing for a penalty for such violation*, EF IT ORDAINED by the Board of Commissioners of the City of Salina, k Kansas. Section 1, That it shall be unlawful for any person, to keep or have in his possesion or under his control for personal use or otherwise anyopium, coca leaves, or any compound, salt, derivative or preparation thereof or any other narcotic including morphine, heroin, cocaine or codein and such possesion shall be presumptive evidence or the violation of this ordinance; br to permit another to have or keep or use any of said drugs upon any premises owned by or controlled by him, or to sell, give away or furnish any of said drugs to another, except physicians, dentists, veterinary surgeons, registered and registered pharmacists as hereinafter provided. Section 2. Nothing in the preceding section hereof shall apply to the sale or giving away of any of the drugs mentioned therein in pursuance of a written order of the person to whom such articles are sold or given, on a blank to be issued for that purpose by the Commissioner of Internal Revenue of the United States. Nor shall anything in said preceding section apply to the dispensing or distribution of any of the aforesaid drugs to a patient by a physician, dentist or veterinary surgeon registered under the laws of the State of Kansas in the course of his pro- fessional practice only, provided that such physician, dentist I l' or vetinary surgeon shall keep a record of all such drugs dispensed or distributed in accordance with the provisions of Section 65-616 of the Revised Statutes of Kansas 1923; Nor shall anything in said preceding section apply to the sale, dispensing or distribu- tion of any of the aforesaid drugs by a registered pharmacist to a consumer under and in pursuance .bf a written prescription by a physician,�dentist or veterinary surgeon registered under the laws of the State of Kansas; PROVIDED, H01M"VER, that such prescription shall be dated as of the day on which it is signed u and shall be signed by the physician, dentist or veterinary sur- geon, who shall have issued the same, and Provided Further, that such registered pharmacist shall preserve such prescription on the blank provided for by Section 65-61.6 of the Revised. Statutes of Kansas, 1923, 481 Section 3. The provisi E (Published in The Salina Evening Journal, � o � 192) ORDINANCE N0. 2916 An Ordinance prohibiting the.possession, bartering, sale, exchanging or giving away of opium or coca leaves, salt, derivative or preparation thereof or any compoundor of other nar- cotio drugs mentioned in said ordinance, and making the violation thereof a misdemeanor and providing for a penalty for such violation: Section 1. That it shall be unlawful for any person to keep or have in his possession or under his controll for per- sonal use or otherwise any opium, coca leaves, or any coumpond, salt, derivative or preparation thereof or any other narbotio including morphine, heroin, cocaine -or codein, and such possession shall be presumptive evidence or the violation of this ordinance;: or to permit another to have or keep or use any of said drugs upon any premises owned by or controlled by him, or to sell, give avay or furnish any of said drugs to another, except physicians, dentists, veterinary surgeons, '0 and registered pharmi- cists as hereinafter provided. Section 2. Nor shall anything in said preceding section apply to the dispensing or distribution of any of the aforesaid drugs to.s. patient by a physician, dentist or veterinary suggeou registered under the laws of the State of Kansas in the course of his professional practice only, provided that such physician, dentist, or veterinary surgeon shall keep a record of all such drugs dispensed or distributed in accordance with the provisions of Section 65-616 of the Revised Statutes of Kansas, 1Q23; Nor shall anything in said preceding section apply to the sale, dispen- sing or distribution of any of the aforesaid drugs by a registered pharmicist4v a consumer under and in pursuance c*; a written pre- scription by a physician, dentist or veterinary surgeon registered under the laws of the State of Kansasi; PROVIDED HOWEVER, that such prescription shall be dated as of the day on which it is signed and shall be signed by the physician, dentist or veterinary surgeon, who shall have issued the same, and PROVIDED FURTHER, that such regis- tered pharmicist shall preserve such prescription on the blank pro- vided for by Section 65-616 of the Revised Statutes of Kansas, 1923. Section 6. The provisions of this ordinance shall not be construed to apply to the sale, distribution, giving away, dis- pensing or possession of preparations or remidies which do not contain more than two grains of opium, or more than one-fourth of a grain of heroin, or more than one grain of codeine, or derivative of any of them in one fluid ounce, or, if a solid or *Ixz semi-solid` preparation, in one avoirdupois ounce; or to linaments, ointments, or other preparations which are prepared for external use onlyp except linaments, ointments and other preparations which contain cocaine or any of its salts or alpha or beta -eucaine or any of their salts; or any synthetic substitute for them, Provided that such remedies and preparations are sold, distributed, given away, dispensed or possessed as medicines and not for the purpose of evading the intentions and provisions of this act. The provisions of this ordinance shall not apply to decocainized cocoa leaves or preparations made therefrom or to other preparations of _coca leaves which do not contain cocaine. Section 4. Any person .violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction there- of shall be fined in any sum not exceeding $500.00 or be imprisoned in the city jail for a term not to exceed six months or shall be subject to both —such fine and imprisonment. iSection. This ordinance shall take effect and be in full force from and after its publication once in the official city paper. Introduced for first reading, January`;34th, 1924.
