An Ordinance ratifying and confirming an agreement between the
City of Salina and the Union Pacific Railroad Company relative
to the payment of the cost of paving, curbing and guttering
Fourth Street north of the south line of Lot 120 on r'ourth
Street and across private property belonging to said -Union
Pacific Railroad Company, determining the amount to be paid
and the manner of payment thereof.
WHEREAS, under proceedings heretofore duly had by the hoard of
Commissioners of the City of Salina, provision was made for the paving,
curbing and guttering of Fourth Street in the "ity.of Salina from the
north line of Walnut Street to the intersection of 'ourth Street with
the Smoky Hill River south of Iron Avenue Bridge in said City, and
WHEREAS, by reason of the intersection of said street with said
river there remained no connection between said street and Iron Ave-
nue, except by crossing private property owned by said Union Pacific
Railroad Company, such connection being a public necessity, and
WHEREAS, by an agreement heretofore entered into between the
Board of Commissioners of the Uity of Salina and the Union Pacific
Railroad Company, said Railroad Company agreed to and did lease unto
said City for a term of fifty (50) years a right of way across said
property owned by it, for use as a public street, with the further
agreement between the parties that one-half of the cost of the construc-
tion of the paving, curbing and guttering assessed against the property
north of the south line of Lot 120 on Fourth Street should be paid by
each of said parties, and
WHEREAS, the cost of the paving, curbing and guttering of Fourth
Street from the north line of Walnut Street to the south line of Iron
Avenue, including that part constructed across the private property
of said railroad company has been determined and the amount assessed
against Lots 110, 1122 114, 1162 118 and 120 on Fourth street in said
City, being the property of said railroad company included in the
agreement heretofore made between said company and said City, has been
found to be Two Thousand, Six Hundred Seventy-five and 73/100 Dollars
($2,675.73) of which said amount under the agreement heretofore made,
the Union Pacific Railroad Uompany is to pay one-half and the Uity
of Oalina one-half, NOW THEREFORE;
BE IT ORDAINED by the board of Commissioners of the City of Galina,
nansas:
Section 1. That the agreement heretofore entered into between the
Board of Commissioners of the City of Salina and the Union Pacific
Railroad Company, that each of said parties pay one-half of the cost
assessed against Lots 110-112-114-116-118 and 120 on Fourth Street in
the City of Salina for the paving, curbing and guttering of rourth
Street from the north line of Walnut Street to the south line of
Iron Avenue in said City, including that part thereof, which crosses
the private property of the Union Pacific Railroad Company north
of the south line of Lot 120 on said Nburth Street, be and the
same is hereby ratified, conformed and approved.
Section 2. 'That the cost of said improvement assessed against,
said Lots 110-112-114-116-118 and 120 in the.sum of $2,675.73 be
paid one-half in the sum of p1,337.86 by the City of Salina and-
one-half
ndone-half in the sum of $1,337.87 by said Union Pacific Railroad
Company.
Section s. That the amount to be paid by said City of Salina
as provided for in the preceeding section hereof be paid in ten
X10) annual installments as provided for in Ordinance No. 2809 of
the City of Salina, Kansas.
Section 4. This ordinance shall take effect and be in full
force from and after its publication once in.the official City
paper.

BE IT ORDAINED by the board of Commissioners of the pity of Salina,
Kansas:

the Board of Commissioners of the City of Salina and the Union Pacific
Railroad Company, that each of said parties pay one-half of the cost
assessed against Lots 110-112-114-116-118 and 120 on Fourth street
in the Uity of Salina for the paving, curbing and guttering of
Fourth Street from the north line of Walnut Street to the south line
of. Iron Avenue in said City, including that part thereof which crosses
the private property of the Union Pacific Railroad Company north
of the south line of Lot 120 on said Fourth Street, be and the same
is hereby ratified, confirmed and approved.
Section 2. That the cost of said improvement assessed against
said Lots 110-112-114-116-118 and 120 in the sun of $2,675.73 be
paid one-half in the sum of $1,337.86 by the City of Salina, and one-
half in the sun of $1,337.87 by said Union Pacific Railroad Company.
Section 3. That the amount to be paid by said pity of Salina
as provided for in the preoeeding section hereof be paid in ten (10)
annual installments as provided for in Ordinance No. 2809 of the
City of ,aline, nansas.
Section 4. 'Phis ordinance shall take effect and be in full
force from and after its publication once in the official City paper.
