2829 Construction of Railroad Tracks- ORDINANCE NO. 2829. An Ordinance granting to The Salina Northern Railroad Company, its successors and assigns the right to construct, maintain and operate railway tracks upon and across certain streets, alleys and public grounds in the City of Salina, Kansas. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the right is granted The Salina Northern Railroad Company, its successors and assigns to construct, maintain and operate railway tracks over, along and across the following streets, alleys and public ground in the Gity.of Salina, Kansas for a period of twenty years from the date of this ordinance be- comes effective, to -wit: (A) Three railroad tracks over.College Street, now 15th Street as now constructed and maintained north of Elm Street and tracks connecting The Salina Northern Railroad Company with the tracks of the Atchison, Topeka and Santa Fe Railway Company, Chicago, Rock Island and Pacific Railway Company and The Missouri Pacific Railroad Company. (B) Three tracks on the north and south alley and east and west alley in Weaver's Second Addition in block bounded by College Street, now 15th Street, Elm Street, Railroad Street and The Atchi- son, Topeka and Santa Fe Railway and Union Pacific Railroad. (C) Three tracks over and across Railroad Street north of Elm 6treet as now constructed and maintained. (D) Three tracks over and across Elm Street west of Railroad Street and over and across its intersection with Uhicago Street, as now constructed and maintained. (E) Three tracks over and across Chicago Street and its intersection with Elm Street as now constructed and maintained. (F) Three tracks over -and across the east and west alley in Block 14, Elmdale, a subdivision of land as designated on the recorded plat of said subdivision. (G) Three tracks over and across Olive Street, north of Park Street. (H) Three tracks over and across the street or alley south- westerly of Park 1, in Elmdale. All of the tracks mentioned in above Sections. "A" to "H" inclusive being now located and situated 8n and within the,limits of the pres- ent existing right of way of said Salina Northern Railroad Company. In connection with the aforesaid tracks, said grantee may maintain and operate all existing switches and cross -overs connecting said tracks on said streets, alleys and public grounds and may con- struct, operate and maintain such additional switches and connecting tracks between the present existing tracks and within the limits of the present existing right of way of said Railroad Company as may in the future be necessary to the convenient operation of all present existing tracks. Section 2. Said Railroad Company, its successors and assigns are authorized to hereafter Yrwa time to tune during the existence of this grant, construct, maintain and operate over all of the streets, alleys and public grounds hereinbefore mentioned, but on its present existing right-of-way, which is north of Park Street at its inter- section with Olive and Chicago Streets, and north of Elm Street at its intersection with Railroad Street and north of the east and west alley in Weaver's 2nd Addition north of.h1m Street at its inter- section with College or 13th Street.and south of the main line right- of-way of the Atchison, Topeka and Santa Fe Railway Company, any tracks which it from time to time requires, witn all necessary and convenient switches, crossing tracks and turnout tracks, all to be within the limits of the present a xisting right-of-way. Section ;5. That said railroad company, its successors and assigns by accepting this ordinance, hereby agrees to provide and maintain sufficient crossings over its tracks.iur each of the streets and alleys above mentioned, when and if such crossings are ordered in by said City of "alina and to comply with all ordinances now in force or hereafter enacted by the City of Galina regulating the use of all of such crossings or providing for the safety of pedestrians or ve;- hicular traffic and of une public in general at or on said crossings. They shall install and maintain sufficient and suitable drainage under said tracks for the purpose of properly draining said streets and alleys; the matter of such drainage to be under the control of the Uity of Salina. Said City reserves unto itself the right to extend its water mains and pipes under said tracks on said public grounds and to at any time in the fNture build or extend its sewer system under said tracks, upon such streets, alleys and public grounds and to place its light poles and wires across the tracks on such streets and alleys. Section 4. 'ibis ordinance shall take effect and be in force from and after its passage and publication once in the official paper of said City and the filing of the acceptance hereof with the amity of Salina by the 0alina Northern Railroad Company. All of the tracks mentioned in above Sections A to H inclusive being now located and situated on and within the limits of the present existing right of way of said Salina Northern Railroad Company. Section 3.
