2806 Improving Phillips StreetORDINANCE NO. 2806 AnOrdin{:-nce specifying and selecting the paving material to be used and letting a contract for the curbing, guttering, ex- cavating, grading and paving Phillips Street in the City of Salina, Kansas from the north line of Ash Street to the south line of Park Street in said City. BE IT ORDAINED by the board of Commissioners of the. City of Salina, Kansas: Section 1. That it is hereby determined that Phillips Street in the City of Salina, Kansas from the north -line of Ash otreet to the south line of Park Street in said City shall.be paved with one coursevitrified vertical fiber plain wire cut.briek.not less than three (3) inches deep, with asphalt filler laid on.a foundation five (5) inches in depth of Portland Cement Concrete base with one (1) inch sand cushion, such pavement within the limits. above defined to be thirty-three (33) feet in width excluding curb -and gutter. Section 2." That it is hereby determined that Phillips Street in the City of Salina, Kansas from the north line of Ash Street to the south line of Park Street in said City shall be curbed and gut- tered with one-piece combination cement curb and gutter, said com-a bined curb and gutter shall be comprised of a curb six (6) inches thick at the top and six and one-half'(6E) inches thick at the thr- oat with gutter twenty-four (24) inches wide, six (6) inches thick at the throat and seven (7) inches thick next to the pavement. Section 3. All excavating, filling and rolling necessary for the proper construction of such improvements shall be done and all-ef such improvements shall be made and done in strict eonformi* to and In compliance with the plans and specifications heretofore made by the City Engineer of Salina, Kansas and now on file with the City Clerk of said City, which said plans and specifications are hereby incorporated in and made a part hereof in all respects as fully and completely as though written out at length herein and, which -plans and specifications are hereby adopted as and for the plans and"speeific4tions of such work and`'improvements. Section 4. That a contract is hereb, awarded to M. R. Amer- man for the curbing, guttering, excavating, grading and paving the above mentioned street in the limits aforesaid with the materials hereinbefore specified, for the paving actually laid and put in . place, for the labor actually performed and the materials actually furnished at the following prices: For excavating and grading sev- enty cents (70V)"'per cubic yard'; -for Portland Cement Concrete com- bined curb and gutter eighty cents (800)'per lineal foot and for paving actually laid and put in place Three and 18100 Dollars ($3.]$ per square yard. All of said work shall be paid for according to the measurement of the City Engineer of the City.of Qalina. It is here- by determined and found that the prices to be paid for the improve- ments as aforesaid is less than the estimated prices of each and all of said improvements as now on file with the City Ulerk of said City of Salina, Kansas. Section 5. Such contract is awarded upon the express condition that such work and improvement shall be done in strict accordance with and in compliance with the plans and. specifications of the City Engin- eer therefor, which plans and specifications are hereby made a part of this ordinance and of the contract awarded, and upon further conditions among others that M- R. Amerman to whom said contract is awarded shall furnish to the City of Salina a surety company bond in the approximate sum of the cost of'such improvements, guaranteeing.the prompt, proper and workmanlike construction of all the same, together with a surety company bond guarateeing such pavement against all'defeets,in material and workmanship for a period of five (5) years from the date of its completion and acceptance by said City; and said contract is awarded, upon a further condition that said M. R--6-merman shall furnish the City of Salina a good and 'sufficient surety company bond guaranteeing said curb and gutter against all defects in material and workmanship for a period of two (2) years from the date of its completion and acceptance of such work by the City; together with a good and: sufficient Surety Company bond running to the State of Kansas in an amount approximately e qual to the contract price of said improvements and conditions that said M. R- Amerman shall pay all indebtedness for labor and material fur nished in making the improvements provided"for herein. Section 6. The board of Commissioners of the City of Salina are hereby authorized to make and enter into on behalf of said City all written agreements necessary in order to secure the construction of the improvements herein provided for. 6ection 7. This ordinance shall take effect and be in full force from and after its publication once in the official City paper. Introduced for first reading.- June 18th, 1923. That it is hereby determined that Phillips Street in the City of Salina, Kansas from the north line of Ash Street to the south line of Park Street in said City, shall be paved with one course vitrified vertical fiber plain wire cut brick not less than three (3) inches deep, with asphalt filler laid on a foundation five (5) inches in depth of Portland Cement Concrete base with one (1) inch sand cushion, such pavement within the limits above defined to be thirty-three (33) feet in width ex- cluding curb and gutter. Section 2. That it is hereby determined that Phillips Street in the City of Salina, Kansas from the north line of Ash Street to the south line of Park Street in said City, shall be curbed and guttered with one-piece combination cement curb and gutter, said combined curb and gutter shall be comprised of a curb six (6) inches thick at the top and six and one-half (6Q) inches thick at the throat, with gutter twenty-four (24) inches wide, six (6) inches thick at the throat and seven (7) inches thick next to the pavement.
