2804 Improving Ash StreetORDINANCE NO. 2804.
An Ordinance specifying and selecting the paving material to be
used and letting a contract for the excavating, grading,
park -curbing and paving of Ash Street in the ity of Salina,
Kansas from the west line of Oakdale Avenue to the west line
of Penn Avenue in said City.
BE IT ORDAIiNED by the Board of Commissioners of the0ity of oalina,
Kansas:
Section 1., That it is hereby determined that Ash Street in
the City of Salina, Kansas from, the west line of Oakdale Avenue to
the west line of Penn Avenue in said City shall be paved with one
course vitrified vertical fiber plain wire cut brio not less than
3 inches deep, with asphalt filler laid on a foundation of five
(5) inchnsand cushion, such pavement within the limits above de-
fined to be thirty-one (31) feet in width excluding curb and gutter
and excluding ten (10) feet of parking in center of the street.
Section 2. That it is hereby determined that the parking
in the center of Ash Street in the City of Salina, Kansas from the
west line of Oakdale Avenue to the west line of Penn Avenue in
said City shall be curbed with one-piece Portland Cement concrete
curb. Said curb shall be six (6) inches thick at top, seven (7)
inches thick at the bottom and fifteen (15) inches high.

Section 3. All excavating, filling and rolling necessary
for the proper construction of such improvements shall be done
and all of such improvements shall be made and done in strict con-
formity to and in compliance with the plans and specifications here-
tofore made by the City Engineer of Galina, Kansas and now on file
with the pity Olerk of said City, which plans and specifications
are hereby incorporated in and made a part hereof in all respects
as fully and completely as though written out at length herein;
which said plans and specifications are hereby adopted as and for
the plans and specifications of such viork and improvements.
Section 4. That a contract is hereby awarded to M. R. Amerma
for the excavating, grading, park -curbing and paving the above
mentioned street in the limits aforesaid with the materials herein
before -mentioned for the paving actually laid and put in place and
for the labor actually performed and the materials actually fur-
nished at the following prices: Por excavating and grading seventy
cents (70�) per cubic yard; for Portland Cement Ooncrete curb
Forty cents (40�) per lineal foot and for paving actually laid and
put in place Three and 18/100 Dollars ($3.18) per square yard.
All of said work_ shall be paid for according to the measurement
made by the Uity engineer of the City of Galina. It is hereby
determined and found that the prices to be paid for the improvements
as aforesaid is less than the estimated prices of each and all of
said improvements as now on file with the City Clerk of Salina, Kansas.
Section 5. Such contract is awarded upon the express condition
that such work and improvements shall be done in strict accordance
with and in compliance with the plans and specifications of the
Oity Engineer therefor, which plans and specifications are hereby
made a part of this ordinance and of the contract awarded, and upon
further conditions among others that M. R. Amerman to whom said
contract is awarded shall furnish to the City of Salina a surety
company bond in the approximate sum of the cost of such improvements
guaranteeing the prompt, proper and workmanlike construction of
all the same together with a surety company bond guaranteeing such
pavement against all defects in material 'and workmanship for a period
of five (5) years from the date of its completion and acceptance
by said City; and said contract is awarded upcn a further condition
that said M. R. Kmerman shall furnish the City of Salina a good and
sufficient surety company bond guaranteeing said curb against all
defects in material and workmanship for a period of two (2) years
from the date of its completion and acceptance of such work by the
City; together with a good and sufficient sur:,ty company bond running
to the State of Kansas in an amount approximately equal to the contract
price of said improvements and conditioned that said M. R. "Morman
shall pay all indebtedness for labor and material furnished in making
the improvements provided for herein.
Section 6. The board of Cor:miissioners of the City of Salina
are hereby authorized to make and enter into on behalf of said City
all written agreements necessary in order to secure the construction
of the improvements herein provided for.
Section 7. This ordinance shall take effect and be in full
force from and after its publication once in the official City paper.
