2800 Regulating Gas SalesORDINANCE_NO. 2800 (rublished in The Salina Evening Journal o` � 1923) 1 REPEALED _� BY b An Ordinance regulating the sale of gasoline upon the`publie'streets and thoroughfares within the firelimits of the City of Salina, Kansas. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That on and after the taking effect of this ordinance it shall be unlawful for any person, company or corporation, either as principal or as the agent or representative of another, to sell and deliver or to offer to sell and deliver to any motor driven vehicle in or upon any public street, alley or thoroughfare within the fire limits of the City of Salina, nansas, as such fire limits are now or may be hereafter defined by ordinance, any gasoline from,any tank wagon or similar vehicle wherein gasoline is transported for sale; PROVIDED HOWEVER -,,that it is not intended and this ordinance shall not operate against the sale`and delivery of not to exceed three (3) gallons of gasoline upon the public streets and thoroughfares within said fire limits and to a motor driven vehicle in event such vehicle shall be then incapable of operation because of an actual and complete lack of gasoline, provided such emergency shall actually exist, without intent or purpose of the driver thereof to evade the provisions of this or- dinance and PROVIDED FURTHER, that nothing herein contained shall be construed to prohibit the delivery of gasoline to filling stations, grocery stores and other and similar places of business within the fire limits of said City, where gasoline is kept for sale and dispo- sition, but in all instances where exceptions to the provisions of this ordinance are permitted such delivery shall be made in a careful manner with due regard for the protection and safeguard against explosion or combustion and with regard to the public streets and sidewalks of said City. Section 2. That this ordinance shall take effect and be in full force from and after its publication once -in -the official City paper. Introduced for first reading, June 4th, 1923.
