ORDINANCE NO. 2929.

An Ordinance specifying and selecting the paving material to be
used and letting a contract for the curbing, guttering, ex-
cavating, grading and paving of Beloit Avenuein the City
of Salina, Kansas from the west 33-ne ol! ganEa Fe Avenue
to the east line of ninth Street in mid City,
BE IT ORDAINED by the Board of Commissioners of the City of
Salina, Kansas:
Section 1. That it is hereby determined that Beloit Avenue
in the City of Salina, Kansas from the west line of Santa Re avenue
to the east line of Ninth Street ins aid City shall be paved with
one course vitrified vertical fiber plain wire out brick, not less
than (3) inches deep, with asphalt filler liad on a foundation of
five (5) inches in depth of Portland Cement Concrete base with
one (l) inch sand cushion, such pavement wi t a,in the limits above
defined to be twenty-six (26) feet in width excluding curb and
gutter.
Section 2. That it is hereby determined that Beloit Avenue
in the City of Salina, Kansas from the west line of Santa Fe Avenue
to the east line of Ninth Street in said City shall be curbed and
guttered with one piece combination cement curb and gutter, said
combined curb and gutter shall be comprised of a curb six (6 )
inches thick at the top and six and one-half (6RA) inches thick
at 'the throat, with gutter twenty-four (24) inches wide, six (6 )

inches thick at the throat and seven (1) inches thick next to the
paveme n.t .
Section 3. All excavating, filling and rolling,necessary for
the proper construction of such improvements shall be done and all
of such improvements shall be made and done in strict conformity
to and in compliance with the plans and specifications heretofore
made by t City Engineer of Salina, Kansas and now on file with
the City Clerk of said City, which plans and specifications are
hereby incorporated in and made a part hereof in all respectss
as fully and completely as though written out at length herein;
which said plans and specifications are hereby adopted as and for

the plans and specifications for such work and improvements.
Section 4 That a contract is hereby awarded to C. P. Barring-
ton for the paving, curbing, guttering, excavating and filling the
above mentioned street in the limits aforesaid with the materials -�
hereinbefore specified, for the paving actually laid and put in
place, for the labor actually performed: and the materials actually
furnished at the following prices: For excavating and grading
One and No/loo ($1.00) Dollarci per cubic yard; for rortland Cement
Concrete combined curb and gutter Ninety cents (94¢) per lineal
foot, and for paving actually laid and put in place Three and

23/100 Dollars ($3,23) per square ;yard. All of said work shall
be paid for according to the measurement made by the -_City -!�ngineer
of the City of Salina. It is hereby determined the and found that
the prices to be paid for the improvements as aforesaid is less than
the estimated prices of each and all of •said improvements as now
on file with the City Clerk of Salina, Kansas.
Section 5. Said contract is awarded upon the express condition
that such work and improvements shall be done in strict accordance
with and in compliance with the plans and specifications of the
City Engineer therefor, which plans and specifications are hereby
made a part of this ordinance and of the contract awarded, and upon
further condtions among others that the person to whom said contract
is awarded shall furnish to the City of Salina a surety company
bond in the approximate sum of the cost of such improvements guaran-
teeing the prompt, proper and workmanlike construction of all the
same together with a surety company bond guaranteeing such pavement
against all defects in material and workmanship for a period of five
(5) years from the date of its completion and acceptance by said
City; and mid contract is awarded upon a further condition that said
C P. Barrington shall furnish the dity of Salina a good and suffic-
ient surety company bond guaranteeing said curb and gutter against
all defects in material and workmanship for a period of two (2)
years from the date of its completion and acceptance of such work
by the City; together with a good and sufficeitne surety company
bond running to the State of Kansas in an amount approximately
egial to the contract price of said improvements and conditioned
that said C. P. Barrington shall pay all indebtedness for labor and
material furnish in making the improvements provided for herein.
Section 6, The Board of Con3rnissioners of the City of Salina
are hereby authorized to make and enter into on behalf of said
City all written agreements necessary in order to secure the
construction of the improvements hterin provided for.
Section 7. This ordinance shall take effect and be in
full force from and after its publication once in the official City
paper.
