An ordinance providing for the construction of certain sewers in
the City of Salina, Kansas.
11JILTEREAS, by certain resolutions duly adopted on the 20th
day of April, 1923 and on the 8th day of October 1923,, the Board
of Commissioners of the City of Salina, Kansas have declared
that the construction of certain lateral seloiers to be situate
within the City of Salina., Kansas and within certain lateral

are improvements necessary to be made, and

BE IT ORDAIHE�D by the Board of Commissioners of the City of
Salina, Kansas:
Section 1. That the following described sewers be constructed,
laid and built in the City of Salina, Kansas, to -wit:
An 8 -inch sanitary sewer lateral in lateral Sewer District
11=ber 8-C con-r-encing at the present manhole at the intersection
of Thirteenth Street and State Street running thence north 400
feet. ILLTIanholes as designated on plans.
A 10 -inch sanitary sewer lateral in -Lateral Sevier District
A
Number 10-F corr?iencing at the present manhole on Prescott venue
at 7leveiTth Street, running thence west on Prescott Avenue to
Twelfth Street 500 feet, anholes as designated on plans.
An 8 -inch sanitary sewer lateral in -lateral Sewer District
Number 5-G commencing at the present manhole in alley between
1111sworth Avenue and Jewell Avenue, running east to usborne
Street 600 feet. 11'anholes as designated on plans.

Number 12-F and 6-G commencing at the present manhole at the
intersection of NinEh Street and Republic venue running thence
west to Highland Circle, 900 feet. 1Tanholes as designated on1,

A 10 -inch sanitary severer lateral in Lateral Sevier District
Number 13-F co=.encing at the present manhole at intersection
of Fourth Street and Center Street running east 700 feet. 11anholes

A 10 -inch sanitary sevier lateral in Lateral Sewer District
Number 14-F commencing at the present manhole at the intersection

An 8 -inch sanitary sewer lateral in Lateral Sevier District
Number 4-G commencing at the present manhole at the intersection
of Ninth greet and Sunset Drive., running thence v. -rest on Sunstt
Drive 900 feet. 1,11anholes as designated on plans.
Section 2. For the viork and improvement herein provided
for the City Engineer shall make and file with the City Clerk on
ii or before the l7th day of Defember 1923, complete plans and
specifications for the construction of the above named work, and
that on or before the last said -named date said City Engineer
shall submit to the Board of Cosi ssioners under aoth, detailed
estimates of the cost of such sewer construction as mentioned in
Section One (1) of this ordinance.

Section'3. That after such plans and specifications shall
have been made and prepared by the City Engineer and filed with
the City Clerk as aforesaid., the Board of Comissioners may ad-
vertise by advertisement published in the official U ity paper fo
the City of Salina for five consecutive days for the receipt of
sealed proposals for the construction of the sezers as mentioned
in Section One (1) hereof; and after the receipt of such proposals
the Board of Commissioners may and are hereby authorized to let
a contract for the construction of said sewers to the lowest
responsible bidder therefor; said Board of Commissioners shall
and are hereby reserved the right to reject any and all bids.
Section 4. That for such sewer construction special assess-
rnents shall be made in regard to each separate seiner herein pro-
vided for., for the full cost thereof, on all lots and pieces of
land to the center of the block on either of the street for the
distance to be improved according to the appraised value of said
lots and pieces of land without regard to the buildings or in,-
provem-en"u-s thereon, said appraisem-ent to be 7made in the manner as
hereinafter provided for.
Section 5. After the passage and publication of this ordi-
nance the Board of Commissioners shall appoint't1aree disinterest-
ed appraisers, who, after having taken an oath to make a true and
impartial appraisennent of all lots and pieces of land liable to
assessment and taxation for the c ost of the Improvement herein
provided for shall y°rithin five days after habing been notified of
their appointment proceed to appraise said lots and pieces of land
liable to assessment and taxation as aforesaid and as may be
designated by the Board of Coi-Imiissioners of said City,, without
regard to the buildings or improvem-ents thereon., and after making
such appraisement shall return the same to the Board of Commission-
ers at the first meeting of said Board after such appraisement
shall have been completed, and after said app.-aisement is returned
to the Board of Commissioners said Board of Cori-nnissioners shall
designate a time for holding a special session of such Board for
the ,purpose of hearing any complaints that may be made as to the
value of any lot or piece of land appraised as aforesaid, of which
special session due notice shall be given in the official City
paper, at which special session the Board of Commissioners May
alter the valuation of any lot or piece of land if, in their opin-
ion the same has been appraised too high or too low.

Section 6. For the purpose of paying for the viork -n('- in. -
provement in this ordinance provided for, the Board of CoTmiission-
ers are hereby authorized and directed to issue internal improve-
ment bonds of the City of Salina in an amount not to eXceed the
contract price of such improvement, and to run for a period of
not less than ten years and be payable in ten equal installments,
together with the interest not to exceed five (5%) per cent per
annuri., which bonds shall be made payable at the fiscal agency of
the State of Kansas; and for the purpose of paying principal and

interest on said bonds as they severally become due and payable
the Board of Commissioners shall apportion and assess against the
lots and pieces of land within the taxing district of such improve-
mnents, special assessments covering the cost of such improvements,
and the apportiorrient therein contained shall hold good for all
the installments that are to be collected from the specific property
chargeable with said improvement. Such assessment and apportion-
ment ordinance shall contain the total amount of tax apportioned to
each tract, piece and parcel of land within the taxing district
and shall state the ntu.Lber of annual installments in which such
'It -lax is to be collected; and thereafter the City Clerk shall annu-
ally, at the same time taxes are to be certified, certify to the
County Clerk of Saline County, lKansas a full list of all property
liable for such work and improvement together with the respective
amounts due on each of said tracts and parcels of land, which
amounts shall include the annual installments and interest on all
unpaid balances for one year at the rate of six (6%) per cent per
anntro-, and such amounts so certified shall be collected as other
taxes are collected.
Section 7. This ordinance shall take effect and be in full
force from and after its publication once in the official City
paper.

WHEREAS, by certain resolutions duly adopted on the 20th

Section 2. For the work and improvement herein provided
for the City Engineer shall make and file with the City Clerk on
or before the =day of ZQ2eP-�1923, complete plans
and specifications for the construction of the above named sew-
ers, and that on or befot•e the last said named date said City
Engineer shall submit to the Board of Commissioners under oath,
detailed estimates of the cost of such sewer construction as
mentioned in Section One (1) of this ordinance.
Section 3 That after such plans and specifications shall
have been made and prepared by the City Engineer and filed with
the City Clerk as aforesaid, the Board of Commissioners may ad-
vertise by advertisement published in the official City paper of
the City of Salina for consecutive days for the receipt of
sealed proposals for the construction of the sewers as mentioned

the Board of Commissioners may and are hereby authorized to let

assessment and taxation for the cost of the improvement herein
provided for shall within five days after having been notified of
their appointment proceed to appraise said lots and pieces of land
laible to assessment and taxation as aforesaid and as may be
designated by the Board of Commissioners of said City, without
regard to the buildings or improvements thereon, and after making
such appraisement shall return the same to the Board of Commission-
ers at the first meeting of said Board after such appraisement
shall have been completed, and after said appraisement is returned
to the Board of Commissioners said Board of Commissioners shall
designate a time for holding a special session of such Board for
