2788 Levy AssessmentsORDINANCE NO. 2788 (`ublished in The Salina Evenina Journal rte_ "no An ordinance relating to and apportioning and levying special assess- ments on certain lots and pieces of ground in the pity of Salina, Kansas to pay`the cost of building and constructing a lateral sanitary sewer in Lateral Sewer District Number 9-F and 3-G in said City, and relating to and providing for the collection and payment of such assessments. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Sect16n 1. For'the' purpose of paying the cost of building and constructing a 10 -inch sanitary lateral sanitary sewer in Lateral Sewer District Number 9-F and 3-G in the City of Salina, Kansas, commencing at the present manhole at intersection of `ourth street and Republic Avenue,'running thence east on Republic -venue to Third Street, 300 feet, with one mahole, there are hereby levied and assessed on the property liable therefor, being all of the lots and pieces of ground situate in and comprising said Lateral Sewer District Number 9-F and 3-u, as heretofore provided for and established by Ordinance Number 2660, which are specially benefited by said sewer according to the appraised value of such lots and pieces of ground without regard to the buildings or improvements thereon, special assessments covering the cost of such work and improvements; said special assessments being based on the special valuation or appraise- ment of said lots and pieces of ground heretofore made by three dis- interested appraisers appointed by the Doard of Commissioners of the City of Salina, Kansas, which said appraisement is hereby referred to and made apart of this ordinance and the several amounts levied, apportioned and assessed against each of said lots and pieces of ground for the purpose aforesaid are hereby found and determined to be as follows: Lot 3, REPUBLIC AVENUE FROIvi FUURTH STREET TO Thlt,D STREET Lot 5, Republic Sunnyside Addition 21.24 Lot 1, Block 41 Avenue $31.86 Lot 2, Mock 42 Avenue 21.24 Lot 3, Block 4, Lot 21.24 Lot 4:; Block 40 21,24 Lot 5, Block 4, 21.24 Lot 6, Block 41 26.55 Addition to Grounds of Kansas Wesleyan University Lot 3, Republic Avenue 21.24 Lot 5, Republic Avenue 21.24 Lot 7, Republic Avenue 21.24 Lot 9, Republic Avenue 21.24 West 372 feet Lot 11, Republic -venue 21.24 Lot 1, Republic Avenue 31.86 Section 2. Said amounts levied, apportioned and assessed afore- said shall be due and collectible in ten equal installments, the first becomin-, due with the taxes for the year 1923 and one of said installments falling due each and every ,year thereafter until all are 9 paid, and all to be -collected with interest as in this ordinance provided, PROVIDED, that the owner of any piece of property liable for any such assessment may redeem his property from such liability by paying tinto the City Treasury the entire amount chargeable against the same, as in this ordinance desig- nated, at any time within thirty days after the publication of this ordinance and before the issuance of the bonds of said City in payment of the balance of said improvements, and his property so paid on shall not thereafter be liable for any further assessments for the cost of said improvements, nor for any part of said bonds. Section 3. 'There is hereby further levied and assessed against each lot and piece of ground described in this ordin- ance 6% interest per annum on all of said installments therein mentioned from the date of the bonds, which may be issued at the end of thirty days, as specified in the preceding section hereof, as by law provided to the time of collection of the last installment, as provided by law, which said interest shall be collected annually at the same time and in the same manner as said installments are collected; and after the taking effect of this ordinance it shall be the duty of the City Clerk of said City to annually at the same time other taxes are certified, and until all of said assessments so apportioned and levied here- inLhave been certified, to certify to the County Clerk of Saline County, Kansas a full list of all property liable to assessment and taxation for such work and improvement except such property on which the special assessments aforesaid have been paid in full, as hereinbefore provided, together with the respective amounts due on each of such lots and pieces of ground, which amounts shall include the annual installments of such special assessments together with the interest for one year at the rate of 6% per annum, on all unpaid balances of such assessments at the beginning of each such year as aforesaid, and such amounts so certified as herein provided shall be placed upon the tax roll by the County Clerk of Saline County, Kansas and collected as all other taxes are collected. Section 4. This ordinance shall take effect and be in full force from and after its publication, once in the official City paper. Introduced for first reading, May 21st, 1923.
