2783 Levy Assessments_ORD.INANCE NO. _2783 An ordinance relating to and apportioning and levying special assessments on certain lots and pieces of ground in the City of Salina, Kansas to pay the cost of building and construct- ing a lateral sanitary sewer in Lateral Sewer District Number 4-F in saidCity, and relating to and providing for the collection and payment of such assessments. BE IT ORDA1NED..by the _Board of Commissioners of the City of Salina, Kansas. Section 1. For the purpose of payinE; the cost of building and constructing an 8 -inch sanitary lateral sewer in Lateral Sewer District Number 4-F in the City of Salina, Kansas, commencing at the present manhole at the intersection of Ninth Street and Charles Street with two manholes, there are hereby levied and assessed on the property liable therefor, being all of the lots and pieces of ground situate in and comprising said Lateral Sewer District Number 4-F as heretofore provided for and established by ordinance Number 2640, which are specially benefited by said sewer, according to the appraised value of such lots and pieces of ground without regard to the buildings or improvements thereon, special assessments covering the cost of such work and improvements; said special assessments being based on the special valuation or appraisement of said lots and pieces of ground heretofore made by three disinterested appraisers appointed by the Board of Commissioners of the city of Salina, Kansas, which said appraisement is hereby referred to and made a part of this ordinance, and the several amounts levied, appor- tioned and assessed against each of said lots and pieces of ground for the purpose aforesaid are hereby found and determined to be as follows: CHARLES STREET FROM NIPiTH STREET TO ELEVENTH STREET South Park Addition. Said amounts levied, apportioned and assessed afore- said shall be due and collectible in 10 equal installments, the first becoming due with the taxes levied for the year 1923 and one of said installments falling due each and every year thereafter until all are paid, and all to be collected with interest as in this ordinance pro- vided; PRuVIDED, that the owner of any piece of property liable for any such assessment may redeem his property such liability by paying into the City Treasury the entire amount chargeable against the same as in this ordinance designated, at any time within 30 days after the publi- cation of this ordinance and before the issuance of the bonds of said City in paymtne of the balance of said improvements and his property so paid on shall not thereafter be liable for any further assessments for the cost of said improvements nor for any part of said bonds. Section 3. 'There is her�!by further levied and assessed against each lot and piece of ground described in this ordinance 6% interest per annum on all of said installments therein mentioned from the date of the bonds, which may be issued at the end of thirty days, as specifie& in the preceding section hereof as by law provided, to the time of coll- ection of the last installment, as provided by law, which said interest shall be collected annually at the same time and in the same manner as said installments are collected; and after the taking effect of this ordinance it shall. be the duty of the City Clerk of said City to annu- ally at the same time other taxes are certified and until all of said assessments so apportioned and levied herein have been certified to certify to the county Clerk of Salina County, Kansas a full list of all property liable to assessment and taxation for such work and im- provements, except such property on which the special assessments afore- said have been paid in full as hereinbefore provided, together with the respective amounts due on each of such lots and pieces of ground, which amounts shall include the annual installments of such special assessments together with the interest for one year at the rate of 6% per annum, on all unpaid balances of such assessments at the beginning of each such year as aforesaid, and such amounts so certified as nerein provided shall be placed upon the tax roll by the county Clerk of Saline County, Kansas and collected as all other taxes are collected. Section 4. 'phis ordinance shall take effect and be in full force from and after its publication once in the official City paper. Introduced for first reading, May 21st, 1923.
