2781 Levy AssessmentsORDINANCE NO. 2781_ An Ordinance relating to and apportioning and levying special assess- ments on certain lots and pieces of ground in the City of Salina, Kansas to pay the cost of building and constructing a lateral sanitary sewer in lateral sewer District Number 5-C in said City, and relating,to and providing for the collection and payment of such assessments. BE IT ORDAINED by the board of Commissioners of the City of Salina, xaneas: Section 1. For the purpose of paying the cost of building and constructing an eight -inch sanitary lateral sewer in Lateral Sewer Distriet'Number 5-C in the City of Salina, Kansas, commencing at the present manhole at the intersebtion of University Place and Railroad Ytreet, running thence south to Walnut Street, 425 feet, with one man- hole there are hereby levied and assessed on the property liable there- for.. being all of the'lots and pieces of ground situate in and comprising said Lateral Sewer Distiriet Number 5-C heretofore provided and estab- lished by Ordinance Number 2639, which are specially benefited by said sewer according to the appraised value of such lots and pieces of ground without regard to the buildings or improvements thereon, special assess- ments covering the cost of such work and improvemtns; said special asses: ments being based on the special valuation or appraisement of said lots and pieces of ground heretofore made by three disinterested appraisers appointed by the hoard of Commissioners of the City of Salina, Kansas, which said appraisement is hereby referred to and made a part of this ordinance, and the several amounts levied, apportioned and assessed against each of said lots and pieces of ground for the purpose afore- said are hereby found and determined to be as follows: RAILROAD STREET -FROM UNIVERSITY TO WALNUT Leavenworth Addition Lot 1, block 14, $53.64 Lot 2, block 140 40.23 Lot 3, Block 14,, 40.23 Lot 4, Block 14, 40.23 Lot 51 Block 14, 40}.23 Lot 6, block 140 40.23 Lot 70 Block 14, 53.64 Section 2. The said amounts levied, apportioned and assessed afore said, shall be due and collectible in ten installments, the first be- coming due with the taxes levied for the year 1923 and one of said instar gnents falling due each and every year thereafter until all are paid, and all to be collected with interest as in this ordinance provided; PROVIDED, that the owner of any piece of property liable for any such assessment may redeem his property from such liability by paying into the City Treasury the entire amount chargeable against the same as in this ordinance designated, at any time within thirty days after the pub- licationof this ordinance and before the assurance of the bonds of said City in payment of the balance of said improvements, and his property so paid on shall not thereafter be liable for further assessments for the cost of said improvements nor for any part of said bonds. Section 3. There is hereby further levied and assessed against each lot and piece of ground described in this ordinance 6$ interest per annum on all of said installments therein mentioned from the date of the bonds, which may be issued at the end of thirty days, as specified in the preceding section hereof as by law pro- vided to the time of collection of the last installment, as provided by law, which said interest shall be collected.annually at the same time and in the same manner as said installments are collected and after the taking effect of this ordinance it shall be the duty of the City Clerk of said City to annually at the same time other taxes are certified, and until all of said assessments so apportioned and levied herein have been certified, to certify to the County Clerk of Salina County, Kansas a full list of all property liable to assew ment, & taxation for such work and improvement, except such property on which the special assessments aforesaid have been paid in full as hereinbefore provided together with the respective amounts due on each of such lots and pieces of ground, which amounts shall include the annual installments of such special assessments together with the interest for one year at the rate of 6% per annum, on all un- paid balances of such assessments at the beginning of each such year as aforesaid and such amounts so certified as herein provied shall be placed upon the tax roll by the County Clerk of Salina County, -Kansas and collected as all other taxes are collected. Section 4. This ordinance shall take effect and be in full force from and after its publication once in the official City paper. Introdueed for first reading, May 21st, 1923.
