ORDINANCE _NO..2765
An Ordinance relating to and apportioning and levying.special
assessments on certain lots and pieces._of.ground in the
City of Salina, Kansas to pay.the cost of excavating,
grading and paving Ash btreet in the -City of Salina,
Kansas from the east line o Penn Avenue to the west
line of Ohio Street in said City, and relating to and
providing for the collection and payment of such assess-
ments.
BE IT ORDAINED by the Board of Commissioners of the City of
Salina, Kansas:
Section 1. For the purpose of paying for the cost of exca-
vating, grading and paving Ash Street in the City of Salina,
Kansas from the east line of Penn Avenue to the west line of
Ohio Street in said City, there are hereby levied and assessed
on the property liable therefor, being all of .the lots and pieces
of ground lying on either side of said Ash street for the dis-
tance improved as aforesaid to the center of the block on either
side thereof, according to the appraised value -of such lots and
pieces of ground without regard to .the.buildings or improvements
thereon, special assessments covering the.cos,t_of such work and
improvements, said special assessments being,.based on the special
valuation and appraisement of said lots and pieces of ground
heretofore made by three disinterested appraisers, appointed by
the Board of Commissioners of the City of Salina, Kansas, which
said appraisement is hereby referred to and made a part of this
ordinance and the several amounts levied, apportioned and
assessed against each of said lots and pieces of ground for the
purpose aforesaid are hereby found and determined to be as follows:

Section 2. Said amounts leLiled, apportioned and assessed
afores;.id shall be due and collectible in ten equal install-
ments, the first becoming due with the taxes -levied for the
,year 1923"and one of said installments falling due each and
every year thereafter until all are paid, and all to be
collected with interest as in this ordinance provided; PRO-
VIDED, that the owner of any piece of property liable for any
such assessment may redeem 4his property from such liability by
paying into -the City Treasury the entire amount chargeable
against the same, as in this ordinance designated, at any time
within thirty days after the publication of this ordinance and
before the issuance of the bonds of'said'City in payment of the
balance of said improvements, and his property so paid on shall
not thereafter be liable for any further assessments for the cost
of said improvements, nor for any part of said bonds.
Section 3. 'there is hereby further levied and assessed
against each lot and piece of ground described in this ordinance
6 interest per annum on all of said installments therein mention-
ed from the date of the bonds, which may be issued at the end
of thirty days as specified in the preceding seetiori hereof, as
by law provided to the time of collection of the last install-
ment, as provided by law, which said interest shall be collected
annually at a same time and in the same manner as said install-
ments are collected; and after the taking effect of this ordinance
it shall be the duty of the City Clerk of said City'to annually
at the same time other taxes are certified and until all of said
assessments so -apportioned and levied herein have been certified,

all property liable to assessment and taxation for such work and
improvements, except such property on which the special assessments
aforesaid have been paid in full as hereinbefore provided, together
with the respective amounts due on each of such lots and pieces of
ground, which amounts shall include the annual installments of such
special assessments together with the interest for one year at the rate
of 6%' per annum, on all unpaid balances of .such assessments at
the beginning of each such year as aforesaid, and such amounts so
certified as herein provided shall be placed upon the tax roll by the
County Clerk of z5aline County, Kansas and collected as all other
taxes are collected.
Section 4.' This ordinance shall take effect and be in full
foree'from and after its publication once.in the official City paper.

Salina, Kansas, to pay the cost of excavating, grading and
paving ASH STREET from the east line of Penn Avenue to'the
