3559 Construction of Storm Sewers #7-A & 8-A503 ORDINANCE N0. 3559 AN ORDINANCE ratifying and confirming a contract for the building and construction of certain storm sewers in the City of I Salina described as Storm Sewers Numbers 7-A and 8-A and providing for the issuance of temporary notes to pay the cost thereof, pending, the issuance and sale of bonds for the payment of such cost. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance by the City of Salina of the proposal of C. T. Snyder hereinafter referred to as the "Contractor's as submitted to the Board of Commissioners on June 11th, 1928, which is hereby found and determined to be the lowest and best bid for such work, and the contract awarded by the Board of Com- missioners of said city to said contractor and signed on behalf of the city by the Mayor, June 12th, 1928, for the building and con- struction of Storm Sewers 7 numbered n . e A and 8v -&A with No. 1, D. S. V. S Pipe, as provided for in Ordinance No. 3540, at and for the unit prices contained in said proposal for such construction, which proposal and contract are hereby referred to and made parts of this ordinance, be and the same are hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimate of the City Engineer filed in the office of the City Clerk June 4th, 1928, which estimate is hereby referred to and made a part of this ordinance. Section 2. That said Storm Sewers shall be built and con- structed in accordance with the plans and specifications therefore prepared by the City Engineer on file in the office of &e City Clerk and in accordance with the proposal of said contractor and under the terms of said contract entered into between the city and said contractor on June 12th, 1928, which said plans, specifications, proposal and con- tract are hereby referred to and made parts of this ordinance, said work to be done and the material, equipment, appliances and appurtenances necessary and required in connection therewith to be performed and furnished in accordance with said plans and specifications, conditioned however upon the furnishing by the contractor of the contract, maintenance and statutory bonds within the time required by said contract. Section 3. That Temporary Notes signed by the Mayor and attested by the City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the contract price for such work, such notes to bear interest at 4'% per annum and to mature not later than November lst, 19282 and to be issued in such amounts and at such time as money for the payment of j the cost of such work may be required, such notes to be issued to said contractor and to be redeemed and cancelled at the time that permanent bonds are issued in lieu thereof. f 504 Section 4. This ordinance shall take effect and be in force from and after itis publication in the official city paper.
