An ordinance specifying and selecting the paving material to be
used and letting a contract for the curbing, guttering, ex-
cavating, grading and paving of TWELFTH STREET in the City
of Salina, nansas from the south line of South Street to the
north line of Morrison Avenue in said City.
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. That it, is hereby determined that TWELFTH STREET
in the City of Salina, ransas from the south line of South Street
to the north line of Morrison Avenue in said City shall be paved
with one course vitrified vertical fiber plain wire cut brick, not
less than three (3) inches deep, with asphalt filler laid on a
foundation of five (5) inches in depth of Portland Cement Concrete
base with one (1) inch sand cushion, such pavement within the lim-
its above defined to be twenty-six (26) feet in width excluding
curb and gutter.
Section 2. 'That it is hereby determined that TWELFTh STREET
in the City of Salina, nansas from the south line of South 'Street
to the north line of Morrison Avenue in said City shall be curbed
and -guttered with one piece combination cement curb and gutter,
said combined curb and gutter shall be comprised of a curb six (6)
inches thick at, the top and six and one-half (62) inches thick at
the throat, with gutter twenty-four (24) inches wide, six (6)'in-
ches thick at the throat and seven (7) inches thick next to the
pavement.
Section 3. All excavating, filling and rolling necessary for
the proper construction of such improvements shall be done and all
of such improvements shall be made and done in strict conformity
to and in compliance with the plans and specifications heretofore
made by the City Engineer of Salina, nansas and now on file with
the City Clerk of said City, which said plans and specifications
are hereby incorporated in and made a part hereof in all respects
as fully and completely as though written out at length herein, which
plans and specifications are hereby adopted as and for the plans
and specifications of such work and improvements.
Section 4. That a contract is hereby av1,,t,rded to E. R. Amerman
for the curbing, guttering, excavating, grading and paving the
above mentioned street in the limits aforesaid with the materials
hereinbefore specified, for the paving actually laid and put in
place, for the labor actually performed and the materials actually
furnished atthe following prices: For excavating and grading seventy
cents (70�) per cubic yard; for Portland Cement Concrete combined
curb and gutter eighty cents (80�) per lineal foot and for paving
actually laid -and put in place Three and 18100 L%ollars ($3.18)
per square yard. All of said work shall be paid for according
to the measurement made by theCity Engineer of the City of Salina.
It is hereby determined and found that the prices to be paid for
the improvements as aforesaid is less than the estimated prices
of each and all of said improvements as now on,file with the City
Clerk of said City of Salina, Kansas.
Section 5. Such contract is awarded upon the express condi-
tion that such work and improvements shall be done in strict
accordance with and in compliance with the plans and specificati-
ons of the City Engineer therefor, which plans and specifications
are hereby made a part of this ordinance and of the contract
awarded, and upon further conditions among others that M. R. Amer-
man, to whom said contract is awarded, shall furnish to the City
of Salina a surety company bond in the approximate sum of the
cost of such improvements, guaranteeing the prompt, proper and
workmanlike. construction of all the same together with a surety
company bond guaranteeing such pavement against all defects in
material and workmanship, for a period of five (5) ,years from the
date of its completion and acceptance by said City; and said con-
tract is awarded upon a further condition that said M. R. Amer-
man shall furnish the City of Salina a good and sufficient surety
company bond guaranteeing said curb and gutter against all defects
in material and workmanship for a period of two (2) years from
the date of its completion and. acceptance of such work by the City,
together with a good and sufficient surety company bond running to
the State of Kansas in an amount approximately equal to the con-
tract price of said improvements and conditioned that said M. R.
Amerman shall pay all indebtedness for labor and material fur-
nished in making the improvements provided for herein.
Section 6. The Board of Commissioners of the City of Salina
are hereby authorized to make and enter into on behalf of said
City all written agreements necessary in order to secure the con-
struction of the improvements herein provided for.
Section 7. This ordinance shall take effect and be in full
force from and after its publication once in the official City
paper.
