2734 Improving 11th StreetORDINANCE NO. 2734 (Published in The oalina Evening Journal. i_ 1923) An Ordinance specifying and selecting the paving material to be used and letting a contract for the excavating, grading and paving of ELEVENTH STREET in the City of Salina, Kansas from the south line of Iron Avenue to the north line of walnut Street in said City. BE IT uRDA TED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That it is hereby determined that ELEVENTH STREET in the City of Salina, Kansas from the south line of Iron Avenue to the north line of Vla.Lnut Street in said City shall.be paved with one course vitrified vertical fiber plain wire cut brick, not less than three (3) inches deep with asphalt filler laid on a foundation of five (5) inches in depth of Portland Cement Concrete base with.one (1) inch sand cush- ion, such pavement within the limits above defined to be thirty-six (36) feet in width excluding curb and gutter. .!Section 2. All excavating, filling and rolling necessary for the proper construction of such improvements shall be.done and all of such improvements shall be made and done in strict-ounformity to and in com- pliance with the plans and specifications heretofore made by the City Engineer of Salina, Kansas and now on file with the City Clerk of said City, which plans and specifications are hereby incorporated in and made a part hereof in all respects as fully and completely as though written out at length herein; which said plans and specifications are hereby adopted as and for the plans and specifications of such work and improvements. Section 3. That a contract is hereby awarded to M. R. Amerman for the paving, excavating and filling the above mentioned street in the -limits aforesaid with the materials hereinbefore specified, for the paving actually laid and put in place, for the labor actually performed and the materials actually furnished at the following prices: For excavating and grading seventy cents (70�) per cubic yard and for paving actually laid and put in place Three and 18/100 Dollars ($P3.18) per square yard. All of said work shall be paid for according to the measurement made by the City Engineer of the City of Salina. It is hereby determined and found that the prices to be paid for the improvements as aforesaid is less than the estimated prices of each and all of said improvements as now on file with the City Clerk of the City of Salina, Kansas. Section 4. Such contract is awarded upon the express condition that such work and improvements shall be done in strict accordance with and in compliance with the plans and specifications of the City Engineer therefor, which plans and specifications are hereby made a part of this ordinance and of the contract awarded, and upon further conditions among others that the person to whom said contract is awarded shall furnish to the City of Salina a surety company bond in the approximate sum of the cost of such improvements guaranteeing said pavement against all defects in material and workmanship for a period of five (5) years from the date of its completion and acceptance of such work by the City; together with a good and sufficient surety company bond running to the State of Kansas in an amount approximately equal to the contract price of said improvements and conditioned that said M. R. Amermam shall pay all indebtedness for 'Labor and material furnished in making the improvements provided for herein. section 5. The hoard of Commissioners of the Uity of Salina are hereby authorized to :;sake and enter into on behalf of said Uity all written agreements necessary in order, to secure the construction of the improvements herein provided for. Section 6. This ordinance shall tape effect and be in full force from and after its publication once in the official City Paper. Introduced for first reading, March 12th, 1923.
