An Ordinance specifying and selecting the paving material to be used
and letting a contract for the excavating, grading and paving of
THIRD STREET in the'City of Salina, Yansas from the south line of
Walnut Street to the south line of Mulberry Street in said City.
BE iT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. That it is hereby determined that THIRD STREET in the
City of Salina, Y.ansas from the south line of Walnut Street to the
south line of Mulberry Street in said City shall be paved with one -
course vitrified vertical fiber plain wire cut brick, not less than
three (3) inches deep with asphalt filler laid on a foundation of
five (5) inches in depth of Portland Cement Concrete base with one
(1) inch sand cushion, succi pavement withinthe limits above defined
to be thirty-one (31) feet in width excluding curb.and gutter.
Section 2. All excavating, filling and rolling necessary for
the proper construction of such improvements shall be done and all
of such improvements shall be made and done in strict. conformity to
and in compliance with the plans and specifications heretofore made
by the City Engineer of Salina, Kansas and now on file with the City
Clerk of said City, which plans and specifications are hereby incor-
porated in and made a part hereof in all -respects as fully and com-
pletely as though written out at length herein; which said plans
and specifications are hereby ad.optedas and for the plans and speci-
fications of such work and improvements.
Section 3. That a contract is hereby awarded to U,I. R. Amerman
for the excavating, filling, grading and paving the above mentioned
street in the limits aforesaid with the materials hereinbefore spe-
cified for the paving actually laid and put in place, for the labor
actually performed and the materials actually furnished at the foll-
owing prices; For excavating and grading,seventy cents (70�) per cu-
bic yard;. and for paving actually laid.and put in place Three and
18/100 Dollars ($3.18) per square yard. All of said work shall.be
paid for according to the measurement made by the City Engineer of
the City of Salina. It is hereby determ4_ned and found that the prices
to be paid for the improvements as aforesaid is less than the esti-
mated prices of each and all of said improvements as now on file with
the City Clerk of the City of Salina, Kansas.
Section 4. ,uch contract is awarded upon the express conditions
that such work.and improvements shall be done in strict accordance
with and in compliance with the plans and specifications of the City
Engineer therefor, which plans and specifications are hereby made a
part of this ordinance and of the contract awarded, and upon fur-
ther conditions among others that the person to whom said contract
is awarded shall furnish to the City of Salina:a surety company
bond in the approximate sum of the cost of such improvements,
.guaranteeing the prompt, proper and workmanlike construction of
all the same together with a surety company bond guaranteeing
such pavement against all defects in material.and workmanship
for a period of five (5) ,years from the date of its completion
and acceptance of such work by the City; together with a good
and sufficient surety company bond running to the State of.Kansas
in an amount approximately equal to the contract price of said
improvements and conditioned that said Bt. R. Amerman shall pay ell
indebtedness for labor and material furnished in making the im-
provements nrovided for herein.
Section 5. The Board of Commissioners of the City of
Salina are hereby authorized to make and enter into on behalf
of said City all written agreements necessary in order to secure
the construction of the improvements herein provided for.
Section 6. This, ordinance shall take effect and be in full
force from and after its publication once in the,official City
paper.

An Ordinance specifying and selecting the paving material to be

man for the excavating, filling,s=gradint,::�and paving the above men-
tioned street in the limits aforesaid with the materials hereinbef:6r:e
specified, for the paving actually laid and put in place, for the
labor actually performed and the materials actually furnished at the
following prices: For excavating and grading seventy cents (70¢x)
per cubic yard and for paving actually laid and put in place Three
and 18/100*Dollars ($3.18) per square yard. A11 of said work shall
be paid for according to the measurement made by the City Engineer
of the City of Salina. It is hereby.determined and found that
the prices to be paid for the improvements as aforesaid is less
than the estimated prices of each and all of said improvements as
now on file with the City Clerk of the City of Salina, Kansas.
Section j, Such contract is awarded upon the express condition
that such work and improvements shall be.done in strict accordance
with and in compliance with the plans and specifications of the
City Engine.er therefor, which plans and specifications are hereby
made a part of this ordinance and of the contract awarded, and
upon further conditions among others that the person to whom said
'contract is.awarded shall furnish to the City of Salina a surety
company bond in the approximate sum of the cost of such improve-
ments guaranteeing the prompt, proper and workmanlike construction
of all the same together with a surety company bond guaranteeing
