2731 Improving Claflin AveORDINANCE _(Publishpd in The Salina Emeninw Jour al i Lav _ An Ordinance specifying and selecting the paving material to be used and letting a contract for the excavating, grading, curb- ing, guttering, park -curbing and paving of.CLAFLIN AVENUE in the City of Salina, Kansas from the west.line of Santa Fe Avenue to the west line of Highland Avenue in said City. BE IT ORDAINED by the Board of Commissioners.of.the City of Salina, Kansas: Section 1. That it is hereby determined that CLP_FLiN AVENUE in the City of Salina, Kansas from the west line of Santa. Fe Avenue to the west line of Highland Avenue in said. City.shall..be paved with one - course vitrified vertical fiber plain wire out brick,.not less than three (3) inches deep, with asphalt filler laid on a foundation of five (5) inches in depth of Portland Cement Concrete base with one (1) inch sand cushion, such pavement within the limits above defined to be thirty-six (36) feet in width excluding curb and gutter and excluding twenty (20) feet of parking in center of street. Section 2. That it is hereby determined that CLAFLIN AVENUE in the City of Salina, Kansas from the west line of Santa Fe Avenue to the west line of Highland Avenue in said. City shall be curbed and guttered with one-piece combination cement curb and gutter, said combined curb and gutter shall be comprised of a curb six (6) inches thick at the top and six and one-half (62) inches thick at the throat with gutter twenty-four (24) inches wide, six (6) inches thick at the throat and seven (7) inches thick next to the pavement. Section 3. that it is hereby determined that,the parking in the center of CLAFLIN AVENUE in the City of Salina, Kansas from the west line of Santa Fe Avenue to the west line of Highland Avenue in said City shall be curbed with one piece Portland Cement Concrete curb. Said curb shall be six (6) inches thick at the top' seven (7) inches thic$ at the bottom and fifteen (15) inches high. Section 4. All excavating, filling and rolling necessary for the proper construction of such improvements shall be done and all of such improvements shall be made and done in strict conformity to and in compliance with the plans and specifications heretofore made by the City Engineer of salina,'hansas and now on file with the City Clerk of said City, which plans and specifications are hereby incor- porated in and made a part hereof in all respects as fully and com- pletely as though written out at length herein; which said plans and specifications are hereby adopted as and for the plans and specifica- tions of such work and improvements. Section 5. That a contract is hereby awarded to M. R. Amerman for the curbing, guttering, excavating, grading, paving and pa rk-curbf .1, Yti$,3YpL the above mentioned street in the limits aforesaid with the mater- I ials hereinbefore specified, for the liR ving actually laid and put in place, for the labor actually performed and the materials actually furnished at the following prices: For excavating and grading seventy cents (700) per cubic ykrd;.for.Portland Cement Concrete combined curb and gutter eighty_cents.(80�) per lineal foot; for Portland Cement Concrete.curb forty cents (40�) per lineal foot and for paving actually laid and -put -in place Three and 18/100 Dollars ($3.18) per square yard.. All of said work shall be paid for according to the measurement., made by the City Engineer of the'City of Salina. It is.hereby determined and found that the prices to, be paid for. the improvements. as aforesaid is less than the.estimated prices of each and all.of said improvements as now on file with the City Clerk of the City.of..Salina, Yansas. Section 6. Such contract is -awarded upon the express condi- tion that such work and improvements shall be done in strict a- ccordance with and in compliance with,the plans and specifications if the City Lngineer therefor, which plans and specifications are hereby made a part of this ordinance and of the contract awarded and upon further conditions among others that the person to whom said contract is awarded shall.furnish to the City of Salina a surety company bond in the approximate sum of the cost of such improvements guaranteeing the prompt, proper and workmanlike con- struction of all the same together with a surety company bond guaranteeing such pavement against all defects in material and workmanship for a period of five k5) years from the date of its completion and acceptance by said City; and said contract is a- warded upon a further condition that said M. R. Amerman shall furnish the City of Salina a good and sufficient surety company bond'guaranteeing said cure and gutter and said park -curb against all defects in material and workmanship for a period of two (2) years from the date of its completion and acceptance oftsuch work by the City; together with a good and sufficient surety company bond running to the State of Kansas in an amount approximately equal to the contract price of' said improvements and conditioned that said M. R. Amerman shall pay all indebtedness for labor and material furnished in making the improvements provided for herein. Section 7. The Board of Commissioners of the City of Salina are hereby authorized to make and enter into on behalf of said City all written agreements necessary in order to secure the construction of the improvements herein provided for. Section 8. This ordinance shall take effect and be in full force from and after its publication once in the official City paper. Introduced for first reading, March 12th, 1923.
