An Ordinance specifying and selecting the paving material to be used and letting a contract for the excavating, grading, park -curbing and paving of CLAFLIN AVENUE in the City of Salina, Kansas from the east line of Santa -Fe Avenue to the west line of Fourth Street in said City. BE 1T uRDA11,iED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That it is hereby determined -that CLAFLIN AVENIN in the City of Salina, Kansas from the east line.of Santa Fe Ave- nue to the west line of Fourth Street in said City shall be paved with one -course vitrified vertical fiber plain.wire out brick, not less than three (3) inches deep, with asphalt filler laid on a foundation of five (5) inches in depth of Portland Cement Con- crete base with one (1) inch sand cushion,.such pavement within the limits above defined to be thirty-six (36),:.feet in widthex- eluding curb and gutter and excluding.twenty (20) feet of parking in center of street. Section 2. That it is hereby determined that the parking in the center of CLAFLIN AVENUE in the City of Salina, Eansas from the east line of Santa Fe Avenue to the west line of Fourth Street in said City shall be curbed with one-piece t'or•tland Cement Concrete curb. Said curb shall be six (6) inches thick at the top and seven (7) inches thick at the bottom and fifteen (15) inches high. Section 3. All excavating, filling and rolling necessary for the proper construction of such improvements shall be done and all of such improvements shall be made and done in strict conformity to and in compliance with the plans and specifications heretofore made by the City Engineer of Salina, t<_ansas and now on file with the City Clerk of said City, which plans and specifica- tionsare hereby incorporated in and made a part hereof in all respects as fully and completely as though written out at length herein; which said plans and specifications are hereby adopted as and for the plans and specifications of such work and improvements. Section 4.. That a contract is hereby awarded to M. R. Amerman for the excavating, grading, park -curbing and paving the i above men- tioned street in the limits aforesaid with the materials hereinbe- fore specified for the paving actually laid and put in place, for the labor actually performed and the materials actually furnished at the following prices: For excavating and grading seventy cents (70�) per cubic yard; for Portland Cement Concrete curb forty cent (40�) per lineal foot and for paving actually laid and put in place Three and 18/100 Dollars ($3.18) per square yard. All of said work shall be paid for according to the measurement.made by the City Eng- ineer of the City of Salina. It is hereby determined and.found that the prices to be paid for the improvements as aforesaid is less than the estimated prices of each and all of said improvements as now on file with the City Clerk of the City of Salina, yansas. Section 5. Such contract is awarded upon the express condition that such work and improvements shall be done in strict accordance with , and in compliance with the plans and specifications of.the City Engineer therefor, which plans and specifications are hereby made a part of this ordinance and of the contract awarded, and upon further conditions among others that the person to whom said contract is awarded shall furnish to the City of Salina a surety company bond in the approximate sum of the cost of such improvements guaranteeing the prompt, proper and workmanlike construction of such pavement against all defects in material and workmanship for a period of five (5) years fromthe date of its completion and acceptance by said City; and said contract is awarded upon a further condition that said M. R. Amerman shall..furnish the City of Salina a good and sufficient surety company bond guaranteeing said curb against all defects in material and workmanship for a period of two (2) ,years from the date of its completion and acceptance of such work by the City; together with a good and sufficient surety company bond running to the State of Kansas in an amount approximately equal to the contract price of said improvements and conditioned that said I+I. R. Amermanshall pay all indebtedness for labor and material fur- nished in making the improvements provided for herein. Section 6. The Board of Commissioners of the City of Salina are hereby authorized to make and enter into on behalf of said City all written agreements necessary in order to secure the construction of the.improvements herein provided for. Section 7. This ordinance shall take effect and be in full force from and after its publication once in the official City paper. Introduced for first reading, 1:4arch 12th, 1923. BE IT ORDAIDTED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That it is hereby determined that Claflin Avenue in the City of Salina, Kansas from the east line of Santa Fe Avenue to the west line of Fourth Street in said City shall be paved with one -course vitrified vertical fiber plain wire cut brick, not less than three (3) inches deep, with asphalt filler laid on a foundation of five (5) inches n -depth of Portland Cement Concrete base with one (1) inch sand cushion, such pavement within the limit-s,above defined to be thirty -sig (36) feet in width excluding curb and gutter, and e2cluding twenty (20) feet of parking in center of street. Section 2. That it is hereby determined that the parking in the center of Claflin Avenue in the City of Salina, Kansas from the east line of Santa Fe Avenue to the west line of Fourth Street in said City shall be curbed with one-piece Portland Cement Concrete curb.
