That it is hereby determined that BELOIT AVENUE in the City of Salina, Kansas from the east.lire. of Santa Fe Avenue to the west line of the McPherson Branch.Right-of-Vlay of the Union Pa- cific Railroad Company in said City shall be paved with one -course vitrified vertical fiber plain wire cut brick, not less than three (3) inches deep, with asphalt filler laid on a foundation of five (5) inches in depth of Portland Cement Concrete base with one (1) inch sand cushion, such pavement within the.limits above defined to be twenty-six (26) feet in width excluding curb and gutter. Section 2. That it is hereby determined that BELUIT AVENUE in the City of Salina, I:ansas from the east, line of Santa Fe Avenue to the west line of the It7cPherson branch Right -of -Way of the Union Pa- cific Railroad Company in said City shall be curbed and guttered with one piece combination cement curb and gutter, said combined curb and gutter shall be comprised of a curb six (6) inches trick at the top and six and one-half (612) inches thick at the throat, with gutter twenty-four (24) inches wide, six (6) inches thick at the throat and seven (7) inches thick next to the pavement. Section 3. All excavating, filling and rolling necessary for the proper construction of such improvements shall be done and all of such improvements shall be made and done in strict conformity to and in compliance with the plans and specifications heretofore made by the City Engineer of Salina, Kansas and now on file with the City Clerk of said City, which plans and specifications are hereby incorporated in and made a part hereof in all respects as fully and completely as though written out at length herein; which said plans and specifica- tions are hereby adopted as and for the plans and specifications of such work and improvements. Section 4. That a contract is hereby awarded to M. R. Amerman for the paving, curbing, guttering, excavating and filling the above mentioned street in the limits aforesaid with the materials herein- before specified for the paving actually laid and put in place, for the labor actually performed and the materials actually furnished at the following prices: For excavating and grading seventy eents.(70�) per cubic ,yard; for Portland Cement Concrete combined curb and gutter eighty cents (BOP) per lineal foot and for paving actually laid and put in place Three and 18/100 Dollars ($3.18) per square ,yard. All of said work shell be paid for according to the measurement made by the City Engineer of the City of Salina. It is hereby determined and found that the prices to be paid for the improvements aforesaid is less than the estimated prices of each and all of said improvements as now on file with the City Clerk of the City of Salina, Yansas. Section 5. Such contract is awarded.upon the express condi- tion that such work and improvements shall be done in strict accordance with and in compliance with the plans and specifica- tions of the City Engineer therefor, which plan: and specification are hereby made a part of this ordinance and of the contract awarded and upon further eonditions.among others that the person to whom said contract is awarded shall furnish to the City of Salina a surety company bond in the approximate sum of the cost of such.improvements guaranteeing the prompt, proper and workman- like construction of all the same, together with a surety company bond guaranteeing such pavement against all defects in material and workmanship for a period of five (5) years from the date of its completion and acceptance by said City; and said contract is awarded upon a further condition that said M. R. Amerman shall furnish the City of Salina a good and sufficient surety company bond guaranteeing said curb and gutter. against all defects in material and workmanship for a period of two (2) years from the date of its completion and acceptance of such work by the City; together with a good and sufficient surety company bond running to the State of Kansas in an amount approximately equal to the contract price of said improvements and conditioned that said M. R. Amerman shall pay all indebtedness for labor and mater- ial ater-ial furnished in making the improvements provided for herein. Section 6. The Board of Commissioners of the City of Salina are hereby authorized to make and enter into on behalf of said City all written agreements necessary in order to secure the con- struction of the improvements herein provided for. Section 7. This ordinance shall take effect and be in full force from and after its publication once in the official City paper. Introduced for first reading, March 12th, 1923.
