AN ORDINANCE granting to the Shellabarger Terminal Elevator Company
the right to erect and maintain poles and wires over and
along certain streets in the City of Salina.
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas;
Section 1. That the Shellabarger Terminal Elevator Coipany,
its successors and assigns, be and it is hereby permitted, subject to
the conditions and restrictions hereinafter set forth, to erect and
maintain poles and to attach thereto and carry thereon insulated wires
for the purpose of carrying and transmitting electrical current on,
over and along the following named streets and along the following
described course, to -wit:
Commencing at a point on the west line of Santa Fe Avenue
feet, more or less, north of North Street; thence northeasterly
across Santa Fe Avenue to a point from the east line of Santa Fe Avenue
feet, more or less, north of North Street; thence northeasterly
across private property to a point on the east line of Fifth Street at the
intersection of said east line of Fifth Street with the south line ex-
tended, of Lincoln Avenue, (formerly Pacific Street); thence east over
and along the east side of Lincoln Avenue (formerly Pacific Street) to
a point feet, more or less, east of Third Street; thence across
Lincoln Avenue (formerly Pacific Street) to a point on the north line of
Lincoln Avenue feet, more or less, west of Second Street; thence
northeasterly over private ground to a point on the west line of Second
Street feet, more or less, north of Lincoln Avenue (formerly
Pacific Street); thence northeasterly across Second Street to a point
on the east line of Second Street feet, more or less, north of
Lincoln Avenue (formerly Pacific Street); thence northeasterly along
and over the right-of-way of the Atchison Topeka and Santa Fe Railroad
and over and across Front Street, Railroad Avenue, Chester Street and
Ohio Street along the northerly line of the right -ofd -way of said rail-
road to the east city limits in Ohio Street; such line to be erected
and used for the purpose of connecting the Power Plant of the Shellabarger
Mill and Elevator Company with the Elevators of the Shellabarger Terminal
Elevator Company.
Section 2. All such poles shall be set at points to be
designated by the City Engineer, and on streets which are paved shall
be set at the inside edge of the curb line, and all wires shall be not
less than 30 feet from the ground at any point®

Section 3. All such poles and wires shall be erected and
maintained in a good workmanlike and safe manner in accordance with
all existing rules, regulations and ordinances of the City of Salina
now in effect and in accordance with the rules and regulations of
the Public Service Commission of the State of Kansas, and subject
to the approval of the Jity Engineer.
Section 4. The permission herein contained is granted, and
accepted, on the express condition that said Shellabarger Terminal
Elevator Company, its successors and assigns, shall be responsible
for any and all damages caused to the City of Salina or to any other
person by reason of the erection, maintenance and operation of said
line and that it will save harmless the City of Salina from any and
all damages, costs or expenses which may accrue or at any time be
adjudged against the City of Salina by reason thereof, and that if
by reason of any proposed public improvements it shall become,nec-
essary to change the location of any such poles or wires, such
change will be made by the Shellabarger Terminal Elevator Company,
its successors and assigns, at its expense, upon notice given'by the
City Engineer, and that if it shall be any time in the future by the
City of Salina to require all overhead wires of all inlets, located
on or along the streets occupied by said line, to be placed under-
ground, that said grantee, its successors or assigns shall at its
own expense place the line herein provided for underground in accord-
ance with such requirements.
Section 5, This ordinance shall be in force and take effect
after its publication in the official city paper, and upon its
acceptance in writing by The Shellabarger Terminal Elevator Company,
said Company to pay the cost of such publication.

the northerly line of the right-of-way of said railroad to the
east city limits.in Ohio Street; such line to be erected and

the Shellabarger Terminal Elevator Company.
