BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas.* Section 1. LATERAL SEWER DISTRICT 141. That there be and there is hereby created a lateral sanitary sewer district in the City of Salina which shall be designated as Lateral Sewer District No. 141 and which shall include all of the property within the following described boundaries in the City of Salina, to -wit: Beginning at the southwest corner of Lot 2 Surveyors Plat C thence north along the west line of said Lot 2, 150 feet to the northwest corner thereof; thence east along the north line of said Lot 2 to the northeast corner thereof; thence north along the west line of Lot 3 Surveyors Plat 0 to the bank of the Smoky Hill River; thence easterly along the bank of the Smoky Hill River to the east line of Lot 15 Smith and Colvard's Addition; thence southeasterly along the east lines of Lots 15 and 16 Smith and Colvard's Addition to the north line of Center Street; thence south across Center Street and along the east line of T?ot 12 Smith. and Colvardts Addition to the southeast corner thereof; thence west along the south line of Lots 9, 10, 11 and 12 Smith and Colvardts Addition to the east line of lot 8; thence south along the east line of said Lot 8 to the southeast corner thereof; thence west along the south line of Lots 2 3 4 5 6, 7 and 8 Smith and Colvard's Addition to a point on the south line of Lot 2 and 25 feet west of the southeast corner thereof; parallel to east line of Lots 1 and 2 to the south line of Center Street; thence west along the south line of Center Street to the east line of -Fourth Street; thence north to place of beginning; the said district comprising Lots 2 to 6 inclusive, Plat C. and the East 25 feet of Lots 1 and 2 and all of Lots 3 to 16 inclusive, Smith and Colvard's Addition. Section 2. That it is necessary and it is hereby ordered that a lateral sanitary sewer with all necessary connections, manholes, headwalls and other appurtenances be constructed and built in said lateral sewer district No. 141 as created by Section 1 of this ordinance along the following described course to -wit: Beginning at a flush tank to be constructed in Center Street at a -point 5 feet east of the east line of Lot 15,, Smith and Colvardts 1 Ll 1 Addition City of Salina; thence nest as an 8" sewer to an existirg sanitary sewer manhole in the intersection at Fourth and Center I Streets. Section 3. LATERAL SEWER DISTRICT 142. That there be and there is hereby created a lateral sanitary sewer district in the City of Salina which shall be designated as Lateral Sewer District l No. 142 and which shall include and be comprised of all of the following described property in the City of Salina, to -wit: All of Block 5 in Depot Addition in the City of Salina, including all of Lots 1 to 34 inclusive, in said Block 5. Section 4. That it is necessary and it is hereby ordered that a lateral sanitary sewer with all necessary inlets, inlet rconnections, manholes., headwalls and other appurtenances be con- structed and built in said lateral sewer district No. 142 as created by Section 3 of this ordinance along the following describil course, to -wit: Beginning at a flush tank to be constructed in the alley north of North Street approximately 20 ft. west of the west line of Ninth Street, thence west as an R" sewer approximate- ly 972 ft. to a manhole to be constructed at the junction of said alley with an alley running north through Block 5, Depot Addition; also beginning at a manhole to be constructed it the alley north of North Street at a point approximately 20 ft. east of the east line of Tenth Otreet., thence east in said alley as an 8t' sewer approximately 971 ft. to the above mentioned manhole at the junc- tion with the alley running north; thence north as an 8" sewer ap- proximately 334 ft. to a manhole to be constructed at the junction of said sewer with the existing sewer in Lincoln Street. Section 5. That the City Engineer shall on or before the 21st day of May, 1929, prepare and file in the office of the City Clerk, plans and specifications for the construction of the later- al sewers provided for in the preceding sections of this ordinance which shall be of the proper character and along the proper courses and at the proper grades to serve the property lying within the dis tricts within which such sewers are to be constructed, and shall on or before said date prepare and submit to the Board of vommis- sioners detailed estimates, under oath, of the cost thereof. That thereafter the City Clerk shall advertise for three consecutive days in the official City paper for sealed proposals for the build. ing and construction of such sewers according to such plans and specifications, which proposals shall be filed with the City Clerk on or before the time fixed in such notice or notices, at which time the Board of Commissioners may let a contract or con- tracts for the building and construction of such sewers or either of them to the lowest responsible bidder or bidders therefor, provided that such bids shall not exceed the estimated cost thereof and provided further that said Board shall reserve the right to reject any and all such proposals and that if not responsible bids shall be received with said estimated cost said Board may proceed and build such sewer or any portion there- of within such estimated cost. Section 6. That for the cost of building and constructing such sewers, special assessments shall be made for the full cost thereof, on all lots or pieces of land within the sewer districts within which any such lateral sewer or portion thereof shall be built, according to the appraised value thereof, without regard to the improvements or buildings thereon. Section 7. ;After the passage and publication of this ordinance, the Board of Commissioners shall appoint three disin- terested appraisers who after having taken an oath to make a true and impartial appraisement of all lots and pieces of land liable to taxation for the cost of such improvements, shall within five days after having been notified of their appointment proceed to appraise all of the lots or pieces of land within such districts, liable to assessment and taxation as aforesaid, without regard to the buildings or improvements thereon, and after making said appraisements shall return the same to the Board of Commissioners of said city and said Board shall designate a time for holding a special meeting of said Board for the purpose of hearing any complaints that may be made as to the Value of any lot or piece of land appraised as aforesaid, of which special session due notice shall be given in the official city paper, and at which special session said Board may alter any valuation of any lot or piece of land, if, in their opinion, the same has been appraised too high or too low. Section S. The special assessments herein provided for may be paid by the person liable therefor in ten approximately equal annual installments but the owner of any property liable to such assessment may within thirty days from the date of determining the amount assessed against his property pay the same in full and his property shall not be liable for any assessment for the cost of such. improvements remaining unpaid at the end of thirty days from the time such assessment is fixed. Section 9. For the purpose of paying for the work and im- provements in this ordinance provided for, the Board of Comnissior4 ers are hereby authorized and directed to issue improvement bonds of the City of Salina in an amount not to exceed the cost of such improvement and to run for a period of ten years and be payable in ten approximately equal annual installments, together with SII interest not to exceed five per center annum, which bonds shall be issued and payable according to law; and for the purpose of paying the principal and interest on siad bonds as they severally become due andpayable, the Board of Commissioners shall apportion and assess against the lots or pieces of land within the taxing districts of such improvements, special assessments covering the cost of such improvements and the apportionment therein contained shall hold good for all of the installments that are to be collect. ed from the specific property chargeable with said improvement. Such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece or parcel of land within the taxing district and shall state the number of an- nual installments in which such tax is to be collected; and there- after the City Clerk shall annually, at the same time other taxes are certified certify to the County Clerk of Saline County, Kansas a fall list of all property liable for such work and improvements together with the respective amounts due on each of said tracts pieces or parcels of land, which amounts shall include the annual installments and interest on all unpaid balances for one year at the rate of not to exceed 5 per cent per annum on such amounts so certified which shall be collected as other taxes are collected. Section 3. LATERAL SEWER DISTRICT 142. That there be and there is hereby created a lateral sanitary sewer district in the City of Salina which shall be designated as Lateral Sewer District No. 142 and which shall include and be comprised of all of the following described property in the City of Salina, to -wit: All of Block 5 in Depot Addition in the City of Salina, including all of Lots 1 to 34, inclusive, in said Block 5. Section 4. That it is necessary and it is hereby ordered that a lateral sanitary sewer with all necessary inlets, inlet connections, manholes, headwalls and other appurtenances be con- structed and built in said lateral sewer district No. 142 as created by Section 3 of this ordinance along the following described course, to -wit: Beginning at a flush tank to be constructed in the alley north of North Street approximately 20 ft. west of the west line of Ninth Street, thence west as an 8" sewer approximately 97h, ft. to a manhole to be constructed at the junction of said alley with an alley running north through Block 5, Depot Addition; also beginning at a manhole to be constructed in the alley north of North Street at a point approximately 20 ft. east of the east line of Tenth Street, thence east in said alley as an 8" sewer approximately 9721 ft. to the above mentioned manhole at the Junction with the alley running north; thence north as an 8" sewer approximately 334 ft. to a man- hole to be constructed at the junction of said sewer with the existing sewer in Lincoln Street. Section 5. That the City Engineer shall on or before the 22st day of May _1928, prepare and file in the office of the City Clerk, plans and specifications for the construction of the lateral sewers provided for in the preceding sections of this ordinance which shall be of the proper character and along the proper courses and at the proper grades to serve the property lying within the districts within which such sewers are to be con- structed, and shall on or before said date prepare and submit to the Board of Commissioners detailed estimates, under oath, of the cost thereof. That thereafter the City Clerk shall advertise for three consecutive days in the official City paper for sealed pro- posals for the building and construction of such sewers according to such plans and specifications, which proposals shall be filed with the City Clerk on or before the time fixed in such notice or notices, at which time the Board of Commissioners may let a contract or contracts for the building and construction of such sewers or or either of them to the lowest responsible bidder or bidders there- for, provided that such bids shall not exceed the estimated cost thereof and provided further that said Board shall reserve the right, to reject any and all such proposals and that if not responsible bids shall be received with said estimated cost said Board may proceed and build such sewer or any portion thereof within such estimated cost. 0 Section g.
