3531 Street Improvements North StreetORDINANCE NO. 3531 AN ORDINANCE providing for the grading and paving of North Street from the east line of Twelfth Street to the city limits at the intersection of North Street with the Union Pacific Railroad right-of-way, and providing for the cost thereof, how the same shall be paid and assessed, and the manner of payment therefor. WHEREAS, by resolution No. 442 duly introduced on March 27th, 1928, and duly adopted by the Board of Commissioners of said city on April 23rd, 1928, said Board of Commissioners have declared that it has become expedient and a public necessity to curb, gutter, grade and pave North Street from the east line of Twelfth Street in the City of Salina to the city limits of said city at the inter- section of North Street with the Union Pacific Railroad right-of- way, so as to connect the existing pavement on Twelfth Street at North Street with the county road lying between the north half of Section 11 and the south half of Section 11, in Township 14 south, Range 3 west, in Saline County and extending west from said city limits at the intersection of North Street with the Union Pacific Railroad right-of-way, the above portion of said street being less than one-half mile in length; and WHEREAS, before the final adoption of said resolution by said Board of Commissioners, twenty days notice thereof was duly given by publication in the Salina Journal, the official city paper as required by Section 13-1033 Revised Statutes 1923; and WHEREAS, after the adoption of said resolution by said Board of Commissioners, the same was duly submitted to the Board of County Commissioners of Saline County, Kansas, and was duly adopted by said Board of County Commissioners at a regular meeting of said Board on April 24, 1928, and was duly published thereafter in three consecutive issues of the Salina Journal, the official city paper and in three consecutive issues of the Salina Journal, the official county paper, such publication commencing on April 25th, 1928, NOW THEREFORE BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas. Section 1. That it is necessary and it is hereby ordered that North Street in the City of Salina from the east line of Twelfth Street to the city limits at the intersection of said North Street with the right-of-way of the Union Pacific Railroad be graded and paved so as to connect the existing pavement on Twelfth Street at North Street with the County road in Saline County, Kansas, lying west of the city limits at the intersection of North Street with the Union Pacific Railroad right-of-way and extending west from the city limits at said point between and adjacent to the north one-half of Section 11 and the south one- half of. Section 11 in Township 14 south, Range 3 west, of the sixth PM in said county; and that said paving shall be of con- crete 30 ft., to be built and constructed in accordance with the plans and specifications of the City Engineer of the City of Salina, Kansas, as hereinafter provided for. Section 2. That for the work and improvement herein provided for the City Engineer shall make and file with the City Clerk on or before May 21st, 1928 complete plans and specifications for the grading of said steeet and for the paving thereof with the following materials: 427 711 Portland Cement Concrete Vt Portland Cement Reinforced Concrete 7" Vibrolithic Concrete and that on or before said date last named the City Engineer of said city shall submit to the Board of Commissioners, under oath, detailed estimates of the cost of such paving including the excava- tion and grading necessary therefor with the different kinds of materials mentioned herein. Section 3. That after the plans and specifications shall have been made and prepared by the City Engineer and filed with the City Clerk as aforesaid the Board of Commissioners shall ad- vertise, by advertisement published in the official city paper of Salina, Kansas for three consecutive days for the receipt of sealed proposals for the excavation and grading necessary for the completion of such paving, and for the paving of said street with the kind of material named and specified hereinabove, 4ndafter the receipt of such proposals the said Board of Commissioners may and are hereby authorized to let contracts for the improving of said street with the materialaI selected b y them to the lowest responsible bidder r or bidders therefor, as determined by said Board of Commissioners, and for such x d c excavating an grading. That the cost of the improvements herein above provided for shall be paid as follows: 30 per cent by the City of Salina, Kansas, 30 per cent by Saline County, Kansas and for the remaining 40 per cent special assessment shall be made for the full amount thereof on all lots and pieces of land to the center of the block on either side of said street according to the value of such lots and tracts of land without regard to the buildings or improve- ments thereon, for the distance to be improved, the same being here- by fixed as the benefit district for said improvement as provided by law, .such value and appprtionment of such cost to be made by the appraisers appointed as hereinafter provided for. Section 5. After the passage and publication of this ordinance, the Mayor of the City of Salina shall appoint three disinterested property owners, who shall be approved by the Board of Commissioners of the Cit of Salina and b the Board of � y Count Commissioners Y y Co mer of Saline County, Kansas, who after having taken an oath to make a true and impartial appraisement of all lots and pieces of land liable to assessment and taxation for the cost of the improvements herein pro- vided for, shall within five days after having been notified of their appointment proceed to appraise said lots and pieces of land 1 LJ 1 liable to assessment and taxation as aforesaid as herein designated without regard to the buildings or improvements thereon, and after making said appraisement shall return the same to the Board of Commissioners of said city and said Board of Commissioners shall designate a time for holding a special session of such Board for the purpose of hearing any complaints that may be made as to the value of any lots or pieces of land appraised as aforesaid, of which special session due notice shall be given in the official city paper, at which special session the Board of Commissovers may alter any valuation of any lot or piece of land if, in their opinion, the same has been appraised too high or too low, Section 6. That for the purpose of paying for the 30 per cent of the cost of said work and improvement to be paid for by the City of Salina, and the 40 per cent of said cost to be paid for by special assessment against the property in the benefit district herein provided for, the Board of Commissioners of the City of Salina are hereby autiorized and directed to issue Internal Improvement Bonds of the City of Salina in an amount not to exceed 70 per of the contract price of such improvements, and to run for a period of ten years and be payable in ten equal installments together with interest not to exceed 5 per cent per annum, which bonds shall be made payable at the fiscal agency of the State of Kansas; and for the purpose of paying principal and interest on said bonds as they severally become due and payable the Board of Commissioners shall apportion and assess against the lots and pieces of land within the taxing district of such improvements special assessments covering 40 per cent of the cost of such im- provements and the apportionment therein contained shall hold good for all the installments that are to be collected from the specific property chargeable with said improvements. Such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece and parcel of land within the tax- ing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually at the same time other taxes are certified, certify to the County Clerk of Saline County, Kansas, a full list of all property liable for such work and improvement, together with the respective amounts due on each of said tracts, pieces and parcels of land, which amounts shall include the annual installments and interest on all unpaid balances for one year at the rate of not to exceed 5% per annum, on such amounts so certified, which shall be collected as other taxes are collected; PROVIDED, however that the R_ owner of any lot or pieces of land liable to any such special assess- ment may redeem his property from such liability by paying the entire amount chargeable against his property at any time within 30 days after such assessment which has been made, or at any time before the issuance of said bonds, and any property upon which any such assess - went shall have been paid shall not thereafter be liable to further special assessment for the cost of such improvement, and provided further that for the 39 per cent of such cost to be paid by the City of Salina, the assessment will be made against all taxable property of the city and paid by the city at large.
