3528 Issuance of Temporary NotesE 1 ORDINANCE NO. 3528 AN ORDINANCE confirming and ratifying a contract for the improve- ment of certain streets in the City Of Salinas Kansas and providing for the issuance of temporary notes to pay the cost thereof as the work progresses, pending the issuance and sale of bonds for the payment of the cost thereof as provided by law. BE IT ORDAINED by the Board of Commissioners of the City Of Salinas Kansas: Section 1. That the acceptance by the City of Salina of the proposal of L. W. Rexroad hereinafter referred to as the "Contractor" which is hereby found and determined to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said city to said contractors and signed on behalf of the city by the Mayor on April 16th, 1928, for the building and construction of the following described street improvements in the City of Salina, to -wit: The excavatingo grading, curbing, guttering and pavingwith seven inch reinforced concrete of Lincoln Avenue from the west line of Santa Fe Avenue to the east line of Ninth Street, as provided in Ordinance No. 3515. The excavating, grading$ curbing, guttering and Paving with six inch reinforced concrete, of Oakdale Avenue, from south line of Iron Avenue to north line of Gypsum Avenue, as provided in Ordinance No. 3518. The excavating, grading, curbingsi.guttering and paving with six inch reinforced concrete, of Minneapolis Avenue from west line of Highland Avenue to east line of Ninth Street, as provided in Ordinance No. 3517. The excavating, grading and paving of War Street from west line of Phillips Street to east line of College Avenue, with six inch reinforced concrete as provided by Ordinance No. 3516. The excavating, grading, curbing and guttering of Center Street east of Fifth Street, as provided in Ordinance No. 3514. The excavating, grading and Paving of the unpaved portion of the center of Ninth Street, from Lincoln to North Street with 212 inch brick on 4 inch concrete base, as provided in Ordinance No. 3513. The excavating, grading and paving of the alley between Seventh and Eighth from Ash Street to Elm Streetwith 7 inch reinforced concrete, as provided in Ordinance No, . 3512. all of said work to be done at the unit prices therefor contained in the proposal of said contractor dated April 14th, 1928, in which contract is hereby referred to and made a part of this ordinance, by and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimate of the City Engineer filed in the office of the City Clerk on April 2nd, 1928, which estimate is hereby referred to and made a part of this ordinance. Section 2. "hat said street improvements shall be built and constructed in accordance with the plans and specifications therefor prepared by the City Engineer on file in the office of the City Clerk and in accordance with the proposal of said contractor and under the terms of said contract entered into between the",C4tyl:,and said contractor on April 16th, 1928, which said plans, specifications, proposal and contract are hereby referred to and made parts oft his ordinance., said work to be done and the material, equipment, appliances and appurtenances necessary and required in connection therewith to be performed and furnished in accordance with said plans and specification, and the contract maintenance and statutory bonds furnished by said contractor as required by said contract, are hereby approved. Section 3. That temporary notes signed by the Mayor and attested by the City Clerk be issued from time to time as the work progresses in the manner and form as required by la -vis the total amount thereof not to exceed the contract price for such work, such notes to bear interest at the rate of 4e� per annum and to mature not later than August 1st, 1928, and to be issued in such amounts and at such time as money for the payment of the cost of such work may be required, such notes to be issued to said contractor and to be redeemed and cancelled at the time that permanent bonds are issued in lieu thereof.
