ORDINANCE NO. 3527

C AN ORDINANCE confirming and ratifying a contract for the building
and construction of a certain storm sewer in the City of
Salina described as Storm Sewer No. 8 and providing for the
issuance of temporary notes to pay the cost thereof as the
work progresses, pending issuance and sale of bonds for the
payment of the cost thereof, as.provided for by law.
BE IT ORDAINED by the Board of commissioners of the City of Salina,
Kansas:
Section 1. That the acceptance by the City of Salina of
the proposal of Harry J. Taylor doing business as H. J. Taylor
Construction Company, hereinafter referred to as the "Contractor's
which is hereby found and determined to be the lowest and best bid
for such work, and the contract awarded by the Board of Commissioner&
of said city to said contractor, and. signed on behalf of the City
by the Mayor on April 16th, 1928 for the building and construction
of Storm Sewer No, 8 as provided for in Ordinance No. 3521, at and
Y for the unit prices contained in said proposal for No. 2 D.S.V.S

pipe sewer for sizes 12 to 27 inch inclusive, and for No. 1 Vitri-
fied Segment Bloch for sizes 30 inch and 42 inch, which contract
is hereby referred to and made a part of this ordinance'! be and
the same are hereby ratified and confirmed, said proposal being

within the estimated cost of said improvements as shown by the
sworn estimate of the City Engineer filed in the office of the
City Clerk on April 2nd, 1928, which estimate is hereby referred
to and made a part of this ordinance.
Section 2. That said Storm Sewer shall be built and con -
structed in accordance with the plans and specifications therefore
prepared by the City Engineer on file in the office of the City
Clerk and in accordance with the -proposal of said contractor and
under the terms of said contract entered into between the city and
said contractor on April 16th, 1928, which said plans and specifi-
cations, proposal and contract are hereby referred to and made
parts of this ordinance, said work to be done and the material,
equipment, appliances and appurtenances necessary and required
in connection therewith to be performed and furnished in accord -
ante with said plans and specificiations, and the contract, mainten.
ante and statutory bonds furnished by said contractor, as required
by said contract, are hereby approved.
Section 3. That temporary notes signed by the Mayor and
attested by the City Clerk be issued from time to time as the
work progresses in the manner and form as required by law, the
total amount thereof not to exceed the contract price for such
work, such notes to bear interest at 44% per annum and to mature

Section 4. This ordinance shall take effect and be in force from
and after its publication in the official city paper.

not later than August 1st; 1928 and to be issued in such
amounts and at such time as money for the payment of the cost -of
such work may be required, such notes to be issued to said con-
tractor and to be redeemed and cancelled at the time that per-
manGht bonds are issued in lieu thereof.
Section 4 This ordinance shall take effect and be in force
from and after its publication in the official city paper.
