3161 Issue Improvement Bonds3
An Ordinance providing for the issuance of Improvement Bonds of
the City of Salina, Kansas in the sum'of $7517.04 to pay
the cost of improving certain streets in said City.
WHEREAS, in pursuance of proceedings duly had according
to law, contracts have been ley and performed for the re -curbing
and guttering Santa Fe Avenue in the City of Salina, Kansas from
the south line of Walnut Street to the north line of mulberry
Street;
For the excavating, grading and paving the alley running
north and south between Santa Fe Avenue and °eventh Street in
the City of Salina, Kansas from the south line of Walnut Jtreet,
south 225 feet in said City;
r'or the curbing and guttering Cedar °treet in the City of.
Salina, Kansas from the west line of Phillips treet to the east
line of College Avenue in said City;
For the excavating, grading and paving Second Street in the
City of Salina, Kansas from the south line of Walnut Street to
the north line of Mulberry Street in said City; and
WHEREAS, the total cost of said improvements has been
ascertained and the portion thereof to be paid by a general tax
to be levied upon all of the taxable property within said City
for the improvement of squares and areas formed by the crossing
of streets and alleys for which bonds are to be issued as herein-
after provided, has been ascertained and -is hereby determined and
found to be the sum of $179.81, and;
WHEREAS, the portion thereof to be paid by special assess-
ments levied upon all the lots and pieces of ground liable there-
for has been ascertained and is hereby found and determined to
be the sum of $9262.44, which said last amount has been hereto-
fore duly assessed and apportioned to the 'several lots and pieces
of ground on such streets liable therefor., payable in ten equal
installments according to law and as provided in ordinances of
the City of Salina, Kansas, duly passed and approved, and;
WHEREAS, the amount of said special assessments for which
bonds are to be issued as herein provided in anticipation of said
special assessments which remain unpaid has been a acertained and
is hereby determined and found to be the sum of 07337.23, the
difference between said last two named amounts having been paid
by the property owners of said ablve named streets whose property
has been discharged from any further assessments for the cost of
said improvements in the amount so paid, NOW THEREFORE,
BE -IT ORDAINED by the Board of Commissioners of the City of
Salina, Kansas:
Section 1. That the cost of such improvements, after
deducting therefrom the assessments heretofore paid thereon
as aforesaid, including the cost of the improvement of the
squares and areas formed by the crossing of streets and alleys
and of City property, shall be paid in ten substantially equal
annual installments instead of levying the entire cost at one
time; the first installment of which is to be paid with the
taxes for the year 1925 and one installment with the taxes
for each succeeding year thereof until the whole amount there-
of shall have been paid and that for such improvements there
shall be and are hereby issued Improvement Bonds of the City
of Salina, Kansas in the aggregate sum of 072517.04.
Section 2. Said issue of bonds shall consist of twenty
(20) bonds all bearing interest at the rate of four and three-
quarters per cent (4-/34%) per annum, interest payable semi-
annually on the 1st days of June and December of each year
after the date of said bonds; except that the first interest
payment as hereinafter described shall be due and payable on
the 1st day of June 1926, and thereafter all interest shall be
payable semi-annually as above provided for. All of said bonds
shall be dated June lst, 1925.
Said bonds shall be numbered, the amount due each year
and the dates of maturity of said bonds shall be as follows:

Section 3.said bonds shall be signed by the Mayor and
attested by the Clerk of the City of Salina, Kansas and shall
have the corporate seal of said City attached thereof. Interest
coupons to"said bonds shall be signed by the lithographed signature
of said Mayor and Clerk and both bonds and coupons shall be paid
at the fiscal agency of the State of Kansas in the City of Topeka,

shall contain recitals substantially as follows:

KNOW ALL MEN BY THESE PRESENTS: That the City of Salina,
in the County of Saline, State of Kansas, for value received
hereby acknowledges itself to be indebted:and promises to pay
the bearer the sum of $
in lawful money of the United States of America on the first
day of June 192 with interest thereon from the date hereof
at the rate of four and three-quarters per cent (4-3/4%) per
cent per annum, payable semi-annually on the first days of
June and December of each year after the date hereof until
the said principal sum shall have been paid, (except that the
first interest coupons shall become due on June 1st, 1926)
upon presentation and surrender of the interest coupons hereto
attached; bearing the ligthographed signatures of the Mayor
and City Clerk of said City, as said coupons severally become
due; both principal and interest of this bond being payable
at the office of the State Treasurer in the City of Topeka,
Kansas. And said City of Salina in the State of Kansas is held
and firmly bound by these presents, and the full faith, credit
and resources of said City are hereby irrevocably pledged for
the prompt payment of said principal and interest at maturity.
THIS BOND is one of a series of 20 bonds of like date
and tenor, except denomination and maturity aggrwgating the
principal sum of $7517.04 issued by the City of alina, Kansas,
for the purpose of paying the cost of.improving Certain streets
in said City by the authority of and in full compliance with the
provisions, restrictions and limitations of the Constitution
and Laws of the State of Kansas includ" Sections 10-101 to
10-115 and Sections 12-601 to 1�-610 and ection 13-1011 of
the Revised Statutes of Kansas, 1923, and -all other provisions
of the Laws of said State applicable,thereto, and this bond
and all of the other bonds of said series and all interest
thereon are to be paid by the City of Salina, Kansas.
AND IT IS HEREBY DECTA RED AND CERTIFIED, that all acts,
conditions and things required to be done and to exist precedent
to and in the issuance of this bond, have been done and performed
and do exist in due and regular form and manner and that the
total indebtednes of said City, including this series of bonds
does not exceed any constitutional or statutory limitation.
IN WITNESS WHEREOF .the said City of Jalina in the State
of Kansas by its Board 01 Commissioners -has caused this bond
to be signed by its Mayor and its corporate seal to be hereto
affixed, attested by its City Clerk, and the coupons hereto
attached to be signed with the lithographed signatures of said
officers and this bond to be dated this first day of June
1925.

Section 6. The Mayor and City Clerk are hereby authorized,
directed and empowered without unnecessary delay, to prepare
and execute said bonds, and coupons as in this ordinance provided
and when executed, said bonds shall be registered with the City
Ulerk of the City"of Palin , Kansas and with the Auditor of the
State of Kansas as required by Law, and shall be by the Mayor of
said City delivered to the contractor or contractors constructing
such improvements in proportion to the amounts due such contract-
or or contractors in payment of the amount due them for such work
and improvements; PROVIDED, however that such bonds shall not be
sold or delivered to such contractor or contractors at less than
par value thereof nor in a greater sum or amount than the whole
amount due to said contractor or contractors under their respective
contracts with said City, or the Board of Commissioners may sell
said bonds at not less than their par value and out of the proceeds
thereof pay said contractor or contractors for said work and im-
provements.
Section 7. Said Board of Commissioners shall make provis-
ions for the payment of the principal and interest on said bonds
as the same becomes due and payable by levying a tax on the
property liable therefor.
Section 8. This ordinance shall take effect and be in full
force from and a fter its publication once in the official City
paper.
