An Ordinance specifying and selecting the material to be used
and letting a contract for the excavating and grading,
curbing and guttering and surfacing with sand clay
Jewell Avenue in the Cjty of Salina, Kansas from the
east line of Santa Fe venue to the west line of
Osborne Street in said City.
BE IT ORDAINED BY THE Board of Commissioners of the City of
Salina, Kansas:
Section 1. That it is hereby determined that Jewell Avenue
in the City of Salina, Kansas from the east line of Santa Fe
Avenue to the west line of Osborne Street in said City shall be
surfaced with sand clay. Souh surface shall be six inches deep,
and shall be 26 feet in width, excluding the curb and gutter.
Section 2. That it is hereby determined that Jewell Avenue
in the City of Salina, Kansas from the east line of Santa Fe
Avenue to the west line of Osborne Street in said City shall be
curbed and guttered with one piece combination cement curb and
gutter. Said combined curb and gutter shall be comprised of a
curb six inches thick at the top, six and one-half inches thick
at the throat and twelve inches deep, with gutter. twenty-four
inches wide, six inches thick at the throat and seven inches
thick next to the pavement.
Section 3. All excavating, filling and rolling neeesssry
for the proper construction of such improvements shall be done
and all of such improvements shall be made and done in strict
conformity to and in compliance with the plans and specification:
of the City Engineer of Salina, Kansas and now on file with the
City`Clerk of said City', which plans and specifications are here•
by incorporated in and made a part hereof in all respects as
fully and completely as though written oilt at length herein,
which said plans and specifications are hereby adopted as and
for the plans and specifications of such work and improvements.
Section 4. That a contract is hereby awarded to L. W.
Rexroad for the curbing, guttering, excavating and filling the
above mentioned street in the limits aforesaid with the mater-
ials hereinbefore specified, for the curbing and guttering actu-
ally laid and put in place, for the labor actually performed and
the materials actually furnished at the following prices: For
excavating and grading 60/ per cubic yard.' For surfacing with
sand clay, 02:20 pr. square yard. For Portland Cement Concrete
combined curb and gutter 75� per lineal foot. All of said work
shall be paid for according to measurement made by the City
Engineer of the City of Salina. It is hereby found and determin
that the prices to be paid for the improvements as aforesaid an
less than the prices of each and all of said improvements as

shown by the sworn estimate of the City Engineer now on file with
the City Clerk of the City of Salina, Kansas.
Section 5. Such contract is awarded upon the express con-
dition that such work and improvements shall be done in strict ac-
cordance with and in compliance with -the -plans and specifications
of the City Engineer therefor, which,plans and specifications are
hereby made a part of this ordinance and of the contract awarded,
and upon further conditions among others that the person to whom
said contract is awarded shall furnish to the City of Salina a
surety bond in the approximate sum of the cost of such improvements,
guaranteeing the prompt, proper and workmanlike construction of all
thes ame, together with a surety company bond guaranteeing such
curb and guttering against all defects in material and workmanship
for a period of two years from -the date of its completion and
acceptance of such worik by the City,.together with a good and suf-
ficient surety company bond running to the State of.Kansas in an
amount approximately equal to•the contract price of said improve-
ments and conditioned that said L. W. Rexroad shall pay all in-
debtedness for labor and material furnished in making the improve-
ments herein provided for.
Section 6. The Board of Commissioners of the City of Salina
are hereby authorized to make and enter into on behalf of said
City all written agreements necessary in order to secure the con-
struction of the improvements herein provided for.
Section 7. This ordinance shall take effect.and be in
full force from and after its publication once in the official
City paper.
