3158 Improving 12th Streeti ORDINANCE_NUtMER_3158 (.Pu_b_l3sh_ed_in_TheSa.lina_Evening=dour-nal ae_p�ambe.r�_1825) An Ordinance specifying and selecting the material to be used and letting a contract for the curbing and guttering of Twelfth Street in the City of Salina, Kansas from the south line of Washington Avenue to the north line of Prescott Avenue in said City. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:, Section 1. That it is hereby determined that Twelfth Street in the City of Salina, Kansas from the south line of Washington'Avenue to the north line of Prescott Avenue in said City shall be curbed and guttered with one piece combination cement curb and gutter. Said combined curb and gutter shall be comprised of a curb six inches thick at the top, six and one-half inches thick at the throat and twelve inches deep, with gutter twenty-four inches wide, six inches thick at the throat and seven inches thick next to the pavement. Section 2. All excavating, filling and rolling necessary for the proper construction of such improvements shall be done and all of such improvements shall be made and done in strict conformity to and in compliance with the plans and specifications heretofore made by the City Engineer of Salina, Kansas, and now on file with the City Clerk of said City, which plans and specifications are hereby incorporated in and made a part here- of in all respects as fully and completely as though written out at length herein, which said plans and specifications are hereby adopted as and for the plans and specifications of such work and improvements. Section 3. That a contract is hereby awarded to L. W. xexroad for the curbing, guttering, excavating and filling the above mentioned street in the limits aforesaid with the materials hereinbefore specified, for the curbing and guttering actually laid and put in place, for the labor actually performed and the materials actually furnished at the following prices: For exca- vating and grading 60� per cubic yard. For Portland Cement Concrete combined curb and gutter 75¢ per lienal foot. All of said work shall be paid for according to measurement made by the City Engineer of the City of Salina. It is hereby found and de- termined that the prices to be paid for the improvements as afor( said are less than the prices of each and all of said improve- ments as shown by the sworn estimate of the City Engineer now on file with the City Clerk of the City of Salina, Kansas. Section 4. Scuh contract is awarded upon the express con- dition that such work and improvements shall be done in strict accordance with and in compliance with the plans and specificatic of the City Engineer therefor, which plans and specifications are hereby made a part of this ordinance and of the contract awarded, and upon further condiL ions among others that the per- son to whom said contract is awarded shall furnish to the City of Salina a surety bond in the approximate sum of the cost of such -improvements, guaranteeing the prompt, proper and work- manlike construction of all the same, together with a surety company bond guaranteeing such curb and gutter against all defects in material and workmanship for a period of two years from the date of its completion and acceptance of such work by the City, together with a good and sufficient surety company bond running to the State of Kansas in an amount approximately equal to the contract price of said improvements and conditioned that said L. W. Rexroad shall pay all indebtedness for labor and material furnished in making the improvements herein provided for. Section 5, The Board of Commissioners of the City of Salina are hereby authorized to make and enter into on behalf of said City all written agreements necessary in order to secure the construction of the improvements herein provided for.
