An Ordinance specifying and selecting the material to be used and
letting a contract for the curbing and guttering of Prescott
Avenue in the City of Salina, Kansas from the west line of
lei venth Street to the east line of Twelfth Street in said
City. a
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. That it is hereby determined that Prescott 'venue
in the City of Salina, Kansas from the west line of Eleventh Street
to the east line of Twelfth Street in said City shall be curbed
and guttered with one piece combination cement curb and gutter.
Said combined curb and gutter shall be comprised of a curb six
inches at the top, six and one-half inches thick at the throat
and twelve inches deep, with gutter twenty-four inches wide, six
inches thick at the throat and seven inches thick next to the pave-
ment.
Section 2. All excavating, filling and rolling necessary
for the proper construction of such improvements shall be done and
all of such improvements shall be made and done in strict conformit
to and in compliance with the plans and specifications heretofore
made by the City Engineer of aalina, Kansas and nova on file with th
City Clerk of said City, which plans and specifications are hereby
incorporated in and made a part hereof in all respects as fully and
completely as though written out at length herein, which said plans
and specifications are hereby adopted as and for the plans and spe-
cifications of such work and improvements.
Section 3. That a contract is hereby awarded to L. W. Rexroa
for the curbing, guttering and excavating and filling the above
mentioned street in the limits aforesaid with the materials herein-
before specified, for the curbing and guttering actually laid and
put in place, for the labor actually performed and the materials
actually furnished at the following prices: For excavating and
grading 60¢ per cubic yard. For Portland Cement Concrete combined
curb and gutter 75� per lineal foot. All of said work shall be
paid for according to measurement made by the City Engineer of the
City of Galina. It is hereby found and determined that the prices
to be paid for the improvements as aforesaid are less than the
prices of each and all of said improvements as shown by the sworn
estimate of the City Engineer as now on file, .with the City Clerk of
the City of Salina, Kansas.
Section 4. Such contract is awarded upon the express condi-
tion that such work and improvements shall be done in strict ac-
cordance and in compliance with the plans and specifications of the
City Engineertherefor, which plans and specifications are hereby
made a part of this ordinance and of the contract awarded, and
upon further conditions among others that the person to whom said
contract is awarded shall furnish to the City of Oalina a surety
bond in the approximately sum of the cost of such improvements,
guaranteeing the prompt, proper and workmanlike construction -
of all the same, together with a surety company bond guaranteeing
such curb and gutter against all defects in material and work-
manship for a period of two years from the date of its completion
and acceptance of such work by the City, together with a good
and sufficient surety company bond running to the State of Kansas
in an amount approximately equal to the contract price of said
improvements and conditioned that said L. W. Rexroad shall pay
all indebtedness for labor and material furnished in making
the improvements herein provided for.
Section 5. The Board of Commissioners of the City of
Salina, are hereby authorized to make and enter into on behalf
of said City all written agreements necessary in order to secure
the construction of the improvements herein provided for.
Section (; This ordinance shall take effect and be in
full force from and after its publication once in the official
City paper.

13E IT OR'DkINED by the Board of Gowmissioners of the City
of Salina, Kansas:
Section 1. That it is hereby determined that
Prescott Avenue in the City of -alina, Kansas from the
west line of Eleventh Street to the east 'Line of Twelfth
StrOet in said City shall be curbed and guttered with

above mentioned- street in the limits aforesaid with the mater-
ials hereinbefore spe'--Jfi.edj for the curbing and guttering
actually laid and put in place,, for the labor actually perform-
ed and the materials actually I furnished at the following prices:
