An Ordinance specifying and selecting the material to be used
and letting a contract for the curbing and guttering of
Phillips Street in the City of Salina, Kansas from the
south line of Washington Avenue to the north line of
Morrison Avenue in said City.
BE IT ORDAINED by the Board of Commissioners of the City of
Salina, Kansas:
Section 1. That it is hereby determined that Phillips
Street in the City of Salina, Kansas from the south line of South
Street to the north line of Morrison Avenue in said City shall
be curbed and guttered with one piece combination cement curb and
gutter. Said combined curb and gutter shall be comprised of a
curb six inches thick at the top, six and one; -half inches thick
at the throat and twelve inches deeo, with gutter twenty-four
inches wide, six inches thick at the throat and seven inches thick
next to the pavement.
Section 2. All excavating, filling and rolling necessary
for the proper construction of such improvements shall be done and
all of such improvements shall be made and done in strict confor-
mity to and in compliance with the plans and specifications hereto-
fore made by the City Engineer of Salina, Kansas, and now on file
with the City Clerk of said City, which plans and specifications
are hereby incorporated in and made a part hereof in all respects
as fully and completely as though written out at length herein,
which said plans and specifications are hereby adopted as and for
the plans and specifications of such work and improvements.
Section 3. That a contract is hereby awarded to L. W. Rexrose
for the curbing, guttering, excavating and filling the above men-
tioned street in the limits aforesaid with the materials herein-
before specified, for the curbing and guttering actually laid and
put in place, for the labot actually performed and the materials
actually furnished at the following prices: For excavating and
grading 60� per cubic yard. For Portland gement Concrete combined
curb and gutter 75� per lineal foot. All of said work shall be
paid for according to measurement made by the City Engineer of the
City of Salina. It is hereby found and determined that the prices
to be paid for the improvements as aforesaid are less than the
prices of each and all of said improvements as shown by the sworn
estimate of the City Engineer; now on file with the City Clerk of
the City of Salina', Kansas.
Section 4. Such contract is awarded upon the expiress con-
dition that such work and improvements shall be done in strict ac-
cordance and in compliance with the plans and specifications of the
City Engineer therefor, which plans and specifications are hereby
made a part of this ordinance and of the contract awarded, and
upon further conditions among others that the person to whom
said contract is awarded shall furnish to the City of Jalina a
surety company bond in the approximate sum of the cost of such
improvements, guaranteeing the prompt, proper and workmanlike
construction of all the same, together with a surety company
bond guaranteeing such curb and gutter against all defects in
material and workmanship for a period of two years from the date
of its completion and acceptance of such work by the City, to-
gether with a good and sufficient surety company bond running to
the State of Kansas in an amount approximately equal to the con-
tract price of said improvements and conditioned that said L. W.
Rexroad shall pay all indebtedness for labor and material fur-
nished in making the improvements herein provided for.
Section 5. The Board of Commissioners of the City of
Salina are hereby authorized to make and enter into on behalf
of said City all written agreements necessary in order to secure
the construction of the improvements herein provided for.
Section 6. This ordinance shall take effect and be in
full force from and after its publication once in the official
City paper.
