An Ordinance granting to Union Pacific Railroad Company, its successors
and assigns the right to construct, maintain and operate a stan-
dard gauge railroad track along Fourth Street from a point 282
feet south of the south line of Elm Street, thence northerly and
over Fourth Street and across the intersection of Elm and Fourth
Street to a point near the south line of Lot 37 on Fourth Street
in the City of Salina, Kansas.
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. Union Pacific Railroad Company is hereby granted the
right to construct, and it and its successors and assigns the right
to maintain and operate a standard gauge railroad track in Fourth
Street in the City of Salina, Kansas in a location described as fol -
lbws:
Beginning at a switch connection said track with the
main line track of the McPherson Branch of Union Pacif-
ic Railroad Company, at a point 282 feet south of the
south line of Elm Street, thence northerly in Fourth
Street parallel with and 15 feet distant easterly from
the center of the main line track of the McPherson
Branch of Union Pacific hailroad Company across the
intersection of Elm and Fourth Streets, thence northerly
in r'ourth Street curbing eastwardly to a point approxi-
mately twenty feet north of the south line of Lot 37
on Fourth Street in said City of Salina, Kansas.
Section 2. Said railroad tracks and the paving, street cross-
ings and drains now or hereafter affected thereby shall be constructed
maintained and operated at a grade to be fixed and approved by the
City Engineer and in accordance with the laws of the State of Kansas
and the ordinances of the City of Salina now in force or hereafter
adopted; it being a condition of this grant, which is accepted by
said Union Pacific Railroad Company, its successors or assigns, that
all such paving, street crossings and drains affected by such con-
struction shall be replaced or constructed in accordance with the
directions and sub,ject.to the approxal of the City Engineer of the
City of Salina, at the expense of said Company, and any paving or
drains hereafter constructed in the streets above mentioned, be-
tween the rails of said track and 1B inches outside of said rails
shall be paid for by said Company, its successors or assigns.
Section 3. This ordinance shall take effect and be in force
from and after its publication in the official City paper.

ORDINANCE NMABER 3134.

successors and assigns, the right to construct, maintain
and operate a standard gauge railroad track along Fourth
Street from a point 282 feet south of the south line of
Elm Street, thence northerly and over Fourth Street and
across the intersection of Elm and Fourth Street to a
point near the south line of lot thirty-seven (37) on
Fourth Street in the city of Salina, Kansas.
BE IT ORDAINED by the Board of Commissioners of the City of
Bali na, Kansas:
Section 1. Union Pacific Railroad Company is hereby
granted the right to construct, and it and its successors and
assigns the right to maintain and operate, a standard gauge
railroad track in Fourth Street in the city of Salina, Kansas
in a location described as follows:
Beginning at a switch connecting said track with the
main line track of the McPherson Branch of Union
Pacific Railroad Company, at a paint 282 feet south
of the south line of Elm Street, thence northerly in
Fourth Street parallel with and fifteen (15) feet
distant easterly from the center of the main line
track of the McPherson Branch of Union Pa c if is 1�a i l -

Fourth Streets, thence northerly in Fourth Street
curing eastwardly to a point approximately twenty
(20) feet north of the south line of lot thirty-
seven (37), on Fourth Street in said City of Salina,
Kansas.
Section 2. Said railroad tracks and the paving, street
crossings and drains now or hereafter affected thereby shall be
constructed, maintained and operated at a grade to be fixed and
approved by the City Engineer and in accordance with the laws of
the State of Kansas and the ordinances of the City of Salina now
in force or hereafter adopted; it being a condition of this grant,
which is accepted by said Union Pacific Railroad Company, its
successors or assigns, that all such paving, street crossings and
drains affected by such construction shall be replaced or construct-
ed in accordance with the directions and subjett,to the approval
of the City Engineer of the City of Salina, at the expense of said
Company, and any paving or drains hereafter constructed in the
streets above mentioned, between the rails of said track and
eighteen (18) inches outside of said rails shell be paid for
by said Company, its successors or assigns.
Section 3. This ordinance shall take effect and be in
force from and after its publication in the official City
paper.
