That it is hereby determined that SECOND STREET in the City.of Salina, Kansas from the south. line of .Walnut Street to the north line of Mulberry Street in said.City be ... paved with Portland Cement Concrete (Reinforced) One Course,. six.inches thick, as provided by the plans and specifications of the.City Engineer ..of.said City. Such pavement to be 31 feet in width, excluding. curb .and gutter. Section 2. All excavating, filling and. rolling necessary for the proper construction of such improvements shall...be done and all of such improvements shall be made and done in -strict conformity and in compliance with the plans and specificatians..o.f...the pity engineer of Salina, Kansas, and now on file_with_the.City Clerk -.of said City, which plans and specifications are hereby incorporated. in and made a part hereof in all respects as fully and completely as though written out at'length herein; which said plans and specifications are hereby adopted as and for the plans and specifications.of such work and improvements. Section 3. That a contract is hereby awarded to L. -W. hexroad for the excavating, grading and paving the above mentioned street in the limits aforesaid with the materials hereinbefore specified, for the paving actually laid and put in place, for the labor actually performed and the materials actually furnished at the following prices:- For excavating and grading, 70� per cubic yard and for paving actually laid and put in place, 1$2.03 per .square ,yard. All of said work shall be paid for according to the measurement made by the City 4ngineer of the City of Salina. It is hereby determined.. and found that the prices to, be paid for the improvements as aforesaid is less than the estimated prices of each and ell of said improvements as now on file with the City Clerk of the City of Salina, Kansas, Section 4. Such contract is awarded upon the express condition that such work and improvements shall be done in strict accordance with and in compliance with the plans and specifications of.the City Engine ai therefor, which plans and specifications are hereby made a part of this ordinance and of the contract awarded, and upon further conditions among others that the person to whom said contract is awarded shall furnish to the City of Salina a surety company bond in the approximate sum of the cost of such improvements guaranteeing the prompt, proper and workmanlike construction of all the same, together with a surety c company bond guaranteeing such pavement against all.defec.ts in material and workmanship for a period of five years from the date of its comple- tion and acceptance by said City, together with a good and sufficient surety company bond running to the State of Kansas in an amount approxi- mately equal to the contract price of said. improvements and conditioned that said L. W. Rexroad shall pay all indebtedness for.labor and mater- ial furnished in making the improvements provided for herein. Section 5. The Board of Commissioners of .the City of Salina are hereby authorized to make and enter into on behalf..of said City all written agreements necessary in order to secure the -construction of the improvements herein provided for.
