3127 Improving Cedar StreetG.RDINA
An Ordinance specifying and selecting the material to be used and
letting a contract for the curbing and guttering of CEDAR
STREET in the City of Salina, Kansas from the west line of
Phillips Street to the.east line of College "venue in said
City.
BE IT ORDIINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. That it is hereby determined that CEDAR STREET in
the City of Salina, kansas from the west line of Phillips Street to
the east line of College avenue in said City shall be curbed and ..
guttered with one piece combination cement curb and gutter, said com-
bined curb and gutter shall be comprised of a curb 6 inches thick at
the top and 6Q inches thick at the throat and 12 inches deep, with
gutter 24 inches -wide, 6 inches thick at the throat and 7 inches
thick next to the pavement.
Section 2. All excavating, filling and rolling necessary for
the proper construction of such improvements shall.be done and all
of such improvements shall be made and done in strict conformity to
and in compliance with the plans and specifications heretofore made
by the City Engineer of Salina, Kansas and now on file with the City
Clerk of said City, which.plans and specifications are hereby incor-
porated in and made a part hereof, in all respects as fully and
completely as though written out at length herein: which said plans
and specifications are hereby adopted as and for the plans and speci-
fications of such work and improvements..
Section 3. That a contract is hereby awarded to I. W. nexroad
for the curbing, guttering, excavating, and filling the above mention
ed street in the limits aforesaid with the materials hereinbefore
specified, for the curbing and guttering actually laid and put in plat
for the labor actually performed and materials actually furnished at
the following prices:- For excavating and grading, 70� per cubic yar
For portland cement concrete combined curb and gutter, 81:C per lineal
foot. All of said work shall be paid for according to measurement
made by the City Engineer of the City of Salina. It is hereby deter-
mined and found that the prices to be paid for the improvements as
aforesaid is less than the estimated prices of each and all of said
improvements as now on file with the City Clerk of the City of Salina

Section 4. Such contract is awarded upon the express condition
that such work and improvements shall be done in strict accordance ani
in compliance with the plans and specifications of the City Engineer
therefor, which plans and specifications are hereby made a part of thJ
ordinance and of the contract awarded, and upon further conditions
among others that the person to whom said contract is awarded shall
furnish to the City of Salina a surety bond in the approximate sum of
the cost of such improvements, guaranteeing the prompt, proper and work-
manlike construction of all the same, together with a surety company
bond guaranteeing such and curb and gutter against all defects in
material and workmanship for a period of two years..from the date of
its completion and acceptance of such work by the City; together with
a good and sufficient surety company bond running to the State of
Kansas in an amount approximately equal to the contract price of said
improvements, and conditioned that said L. W. kexroad shall pay all
indebtedness for labor and material furnished in making the improve-
ments herein provided for.
Section 5. The Board of Commissioners of the City of Salina are
hereby authorized to make and enter into on behalf of said Uity all
written agreements necessary in order to secure the construction of
the improvements herein provided for.
Section 6. This ordinance shall take effect and be in full
force from and after itspublication once in the official City paper.
