3116 Issue Improvement Bondsv An Ordinance providing for the issuance of Improvement Bonds of the City of Salina, Kansas, in the sum of 012,189.42 to pay the cost of improving Fifth Street from the north line of Walnut Street to the south line o? Ash Street in said City. WHEREAS, in pursuance of proceedings duly had aecoring to law, contracts have been let and performde for the re -curbing, guttering and re -paving Fifth Street in the City of Salina, Kansas from the north line of Walnut Street to the south line of Ash Street in said City; and WHEREAS, the total cost of said improvements has been ascertained and the portion thereof to be paud by a general tax to be levied -upon all of the taxable property within said City for the improvement of sq uares and areas formed by the crossing of streets and alleys and for City property for which bonds are to be issued as hereinafter provided, has been ascertianed and is hereby determined and found to be the sum of $2,441.68, and; WHEREAS, the portion thereof to be paid by special assessments levied upon the lots and pieces of ground liable therefor has been ascertained and is hereby found and determined to be the sum of $15,133.62, which said last amount has been heretofore duly assessed and apportioned to the several lots and pieces of ground on such streets liable therefor, payable in ten equal installments according to law and as provided in ordinances of the City of Salina, Kansas duly passed and -approved, and; WHEREAS, the amount of said special assessments for which bonds are to be issued as herein provided in anticiapa- tion of said special assessments which remain unpaid has been ascertained and is hereby determined.and found to be the sum of `9,747.74 the difference between last two named amounts having been paid by the property owners of said above named street whose property has been discharged from any further assessments for the -cost of said improvements_in the amount so paid, NOW THEREFORE, BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1.' That the cost of such improvements, after deducting therefrom the assessments heretofore paid thereon as aforesaid, including the cost of the improvements of the squares and areas formed by the crossings of streets and alleys and of City property, shall be paid in ten substiantially equal annual installments instead of levying the entire cost at one time; the first installment of which is to be paid with the tqxes for the year 1925 and one installment with the taxes for each succeeding year thereafter until the whole amount thereof shall have been paid and that for such installment there shall be and are hereby issued Improvement Bonds of the City of Salina, Kansas in the aggregate sum of $12,189.42 as hereinafter pro- vided. Section 2.. Said issue of bonds shall consist of twenty (20) bonds all bearing interest at the.rate of four and three- quarters per cent (4-3/4a) per annum, interest payable semi- annually on the 1st days of March and September of each year after the date of said bonds; except that the first interest payment as hereinafter described shall be due and payable on I the 1st day of March 1926, and thereafter all interest shall be payable semi-annually as above provided for. All of said bonds shall be dated March 1st, 1925. INTERNAL IMPROVEMENT BOND KNOW ALL MEN BY THESE PRESENTS: That the City of Salina, in the County of Saline, State of Kansas, for value received hereby acknowledges itself to be indebted and promises to pay the bearer the sum of 4 in lawful money of the United States of America on the first day of March 192 with interest thereon from the date hereof at the rate of tour and three-quarters (4-3/4/) per cent per annum, payable semi-annually on the first days of March and September of each year after the date hereof until the said principal sim shall have been paid, (except that the first interest coupons shall become due on March 1st, 1926) upon pre sentation and surrender of the interest coupons hereto attached, bearing the lithographed signatures of the "ayor and City Clerk of said City, as said coupons severally become due; both principal and interest of this bond being payable at the office of the State Treasurer in the City of Topeka, Kansas. AND IT IS HEREBY DECLARED AND CERTIFIED, that all acts, conditions and things required to be done and to exist precedent to and in the issuance of this bond, have been done and performed and do exist in due and regular form, and manner and that the total indebtedness of said City, including this series of bonds does not exceed any constitutional or statutory limitation.
