3506 Approving Eleventh StreetORDINANCE NO. 3506 (Published in the Salina inurnal Tr_ltl� 3 AN ORDINANCE relating to the condemnation of certain private property for the purpose of opening, widening and extend- ing Eleventh Street, south of Park Street; designating a Benefit District, and providing for the appointment of Commissioners to make an appraisement and to assess damages and benefits. WHEREAS, pursuant to the provisions of Ordinance No. 3502 duly adopted on February 13th, 1928, the City Engineer of the City of Salina has made and filed in the office of the City Clerk a survey and description of the land to be appropriated as described in said ordinance, for the purpose of opening, widening and ex- tending Eleventh Street from the south line of Park Street to a point 130 feet; south of said south line of Park Street; and WHEREAS, in the opinion of the governing body certain property will be specially benefited by said proposed improvement, and a benefit district to include the property specially benefited should be fixed, and Commissioners to appraise the land taken, and assess damages and benefits should be appointed, as required by law; NOW THEREFORE, w. BE IT ORDAINED by the Board of Commissioners of the pity of Salina, Kansas: Section 1. That the following described property, to -wit: Lot 2 and the east 18 feet of Lot 1 in Abbott and William's Addition to the City of Salina, in Saline County, Kansas be and the same is hereby condemned and appropriated for the purpose of opening, widening and extending Eleventh Street in said City from the south line of Park Street to a point 130 feet south of said south line of Park Street. Section 2. That all of the private property lying within the benefit district hereinafter described is in the opinion of the Board of Commissioners specially benefited by the opening, widening and extending of Eleventh Street as hereinabove provided for, and that said benefit district be and the same is hereby designated and fixed as follows: Commencing at the northeast corner of Lot 1 on Elm Street in Weavers Addition; thence west along the south line of Elm Street to the northwest corner of Lot 3 on Elm Street in said Addition; thence south along the west lines of Lot 3 on Elm Street and Lot 3 on Park Street in said addition to the southwest i. line of said Lot 3 on Park Street; thence sou-thwardly to the north- west corner of Lot 5 on Park Street in Wilson Addition; thence south along the south lines of Lot 5 on Park Street and Lot 6 on Ash Street in Wilson Addition to the southwest corner of said Lot 6 on Ash Street; thence southwardly to the northwest corner of Lot 3 on Ash Street in University Addition; thence south along the west lines of Lot 3 on Ash Street and Lot 3 on State Street in University Addition to the southwest corner of said Lot 3 on State Street; thence east along the north line of State Street to the southeast corner of Lot 2 on State Street in Bishop's Second Addition; thence north along the east lines of Lot 2 on State 360 Street, Lot 3 on Eleventh Street, and Lot 2 on Ash Street in Bishop's Second Addition to the northeast corner of said Lot 2 on Ash Street; thence northeasterly to the southeast corner of Lot 8 on Ash Street in Bristol Addition; thence north along the east line of said Lot 8 on Ash Street and along the center of the alley running north and south along the east side of Lots 1. 3 and 5 on Eleventh Street in said Bristol Addition, and along the east line of Lot 7 on Park Street in Abbott and William's Addition ti the northeast corner of said Lot 7; thence northwardly to the southeast corner of Lot 19 on Eleventh Street in Bishop's Third Addition, thence north along the east lines of Lots 19, 212 232 250 270 29, 31, 33, 35 and 37 on Eleventh Street in Bishop's Third Addition to the northeast corner of said Lot 37; thence west along the north line of said Lot 37 to the northwest corner thereof; thence northwesterly to the northeast corner of Lot I on E&m Street in Weavers Addition, being the point of beginning; said benefit district comprising , all the following described private property to -wit: Lots 11 2 and 3 on Elm Street and Lots 1. 2 and 3 on Park Street, Weaver's Addition; a d Lots 1, 3 and 5 on Park Street and Lots 2, 4 and 6 on Ash Street in Wilson Addition; Lots 12 2 and 3 on Ash Street and Lots 12 2 and 3 on State Street in University Addition; and Lots 2 and 3 on State Street, Lot 3 on Eleventh Street, and Lots 2 and 3 on Ash Street in Bishop's Second Addition; Lon; and Lots 7 and 8 on Ash Street and Lots 1, 3 and 5 on Eleventh Street in Bristoal Addition; and Lots 32 42 51 6 and 7 on Park Street in Abbott's and Williams Addition, and Lots 19, 21, 23, 25, 270 29, 310 33s 35 and 37 on Eleventh Street in Bishop's Third Addition. Section 3. That the City Attorney be and he is hereby authorized and directed as soon as this ordinance takes effect, to present a written application to the Judge of the District Court of Saline County, Kansas, describing the land sought to be taken as aforesaid for said impovement and setting out the benefit district in full as herein fixed, and praying for the appointment of three commissioners to appraise the value of the land so taken, and to assess the damages therefor, a to assess against the City at large the amount of the benefit to the public generally, if any, and to assess'against the property in said benefit district the cost of such condemnation except that portion assessed against the City, as provided by law, and that all other and further actIon of any kind necessary in connection with the appropriation and condemnation of said land for said purposes be and they same is hereby authorized and directed to be doneandperformed.
