3087 Regulating Excavations Streets and AlleysAn Ordinance amending Section 3 of Ordinance No. 1882, being an ordinance
regulating the making of excavations in the streets and alleys or
other public grounds in the City of Salina, Kansas and repealing said
Section 3 and Sections 4 and 5 of said Ordinance No. 1682, and �re-
pealing Sections 1,.2, 3 and 6 of Ordinance No. 1695 of the City of
Salina, being an ordinance regulating the manner of making and filling
excavations in the streets and alleys of the City of Salina.
BE IT ORDAINED.by the Board of Commissioners of the City of Salina, nansas:
Section 1. That Section 3 of Ordinance No. 1882 of -the Citv of Jalina,
Kansas be and the same is hereby amended to read as. follows: SEC 3. Upon
receipt of the application mentioned in Section 2 of this. ordinance and upon
compliance with all of the other conditions required.by_this.ordinance or an
other ordinance of the City of Salina relating to .street excavations, then
in effect, the City Clerk may.issue a permit to such applicant to make the
excavation referred to in such application; provid.ed.that upon issuing any
such permit the clerk shall deliver a duplicate thereof.to the City Engineer
and provided further that no permit shall be issued .under any of the pro-
visions of this or any other ordinance which will in any way interfer with
the proper regulation of the public streets, alleys and .other public grounds
of the City. All permits issued under the provisions of this.ordinance shal
be returned to the City Clerk on the completion. of _the.work permitted, and
within three days after the .time of expiration mentioned therein, with a cer
tificate thereon signed by the person to whom issued that the work permitted
thereby has been done and performed in conformity therewith and in conformit
with all ordinances relating to such work; whereupon it shall be the duty
of the City Engineer to inspect said work and if he shall find that said wor
has not been done.as certified he shall notify the party to whom such permit
was issued of such fact, and if such party shall fail within the next suttee -
ing 24 hours to put such work in such condition as such Engineer shall dire
such person shall be deemed guilty of a violation of this ordinance. Any of
the duties to be performed by the City Engineer under this ordinance may be
delegated by him to his assistant or to the Street superintendent or the
Building Inspector of the City of Salina and any of such officers shall the
upon have all of the authority conferred by this ordinance upon the City
Engineer. All excavations shall at all tit; -es be protected by barriers, as
by ordinance provided, which barriers shall have painted thereon, on both
sides thereof, the name of the person, firm or corporation doing such work.
Section 2. That original Sections 3, 4 and 5 of Ordinance No. 1882
and Sections 2, 3, 4 and 6 of Ordinance Na. 1695 be and the same are hereby
repealed. '
Section 3. This ordinance shall take effect and be in full force
from and after its publication in the official City paper.

An Ordinance Amending Section 3 of Ordinance No. 1882, being an Ordinance
regulating the making of excavations in the streets and alleys or
other public grounds in the City of Salina, Kansas; and repealing
said Section 3 and sections 4 and 5 of said Ordinance No. 1882, and
repealing sections 1-2-3 and 6 of Ordinance No. 1695 of the City of
Salina, being an Ordinance regulating the mannerrT ing
excavations in the streets and alleys of the City of Salina.
BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. That Section 3 of Ordinance No. 1882 of the City of
Salina, Kansas,�be and the same is hereby amended to read as follows:
"Section 3. Upon receipt of the application mentioned in section 2 of,
this ordinance and upon compliance with all of the other conditions
required by this ordinance or any other ordinance of the City of Salina
relating to street excavations, then in effect, the City Clerk may issue
a permit to such applicant to make the excavation referred to in such
application; provided that upon issAing any such permit the clerk shall
deliver a duplicate thereof to the City Engineer and provided further
that no permit shall be issued under any of the provisions of this or
any other ordinance which will in any way interfer with the proper

person shall be deemed guilty of a violation of this ordinance. Any
of the duties to be performed by the City Engineer under this ordinance
may be deligated by him to his assistant or to the Street Superintendent
or the Building Inspector of the City of Salina, and any of such officers
shall thereupon have all of the authority conferred by this ordinance
upon the City Engineer. All,excavations shall at all times be protected,
