City Planning Commission for the City of Salina providing for the appointment of the members of and defining the duties of such Commission, providing for the approval of such Commission of all plats or replats of lands or additions in or adJoi.r.ir.g; the City of Salina: and repealing; all ordinances or parts of ordinances in conflict herewith. BE IT ORDF.INED by the Board of Conirnissioners of the City of Salina, Kansas: CITY PLANNING COMNIISSION CRFJ.TED. SEC. 1. That there be and there is hereby created a Commission to be known as the City Planning Commi- ssion of the City of Salina. DIC;YBERS OF CGRhISSION. APPOINTMENT. SEC. 2. The City Planning Com- mission shall consist of 7 members, all. of whom shall. be tax payers and residents of the City of Salina and shall be appointed by the klayor and with the consent of the Board of Commissioners. That said members shall serve for terms of 3 years from the lst day of May of the year in which they are appointed and that not more than 2 of such. members shall be appointed in any 1 ,year, provided however that vacancies caused by the death, resin,)ation'or tother disability of any member shall be filled for the unexpired term only. 'gnat the members of such commission shall serve without compensation and shall perform the duties and have the powers hereinafter provided for: and provided further that the members of the City Planning Commission now holding, office as such shall. con- tinue to hold such offices as members of the Commission hereby created until the expiration of the t -cans for which they were heretofore app- ointed. ORGIdJZATION OF CONWISSION. SEC. 3. The members of the City Plan- ning Commission shall meet at least once a month at such time and place as they may fix by resolution. They shall select one of their number as Chairman and 1 as vice chairman, who shall serve 1 year, or until. their successor has been selected. Special meetings may be called at any time by the Chairman or in his absence by the Vice -Chairman. A ma- ,ority of the Commission shall constitute a forum for the transaction of business. The Commission shall cause a proper record to be kept of its proceedings. DUTIES OF CONMISSION. SEC. 4. The powers and duties of the Comm- ission shall be to make plans and maps of the whole or any portion of the City of Salina and of any land outside of the City which, in the opinion of the Commission bears relation to the Planning of the City of Salina and to make changes in such plans or maps when it deems the san=e advisable/Such maps or plans shall show the Commission's reconm- endations fox, new streets, alleys, ways, viaducts, bridges, sub -ways, park -ways, parks, playgrounds or any other public g=round or public im- movement and the removal, relocation, widening or extension of such works then existing with a view to the systematic planning of the municipal- ity, and the Commission shall make recommendations to the Lcard. of Commiss- ioners of the City of Salina concerning the location of streets, transporta- tion and communication facilities, public'buildings and grounds and other ciA is improvements and matters affecting the appearance of the City; and shall make such recommendations as the': deem prorerty relative to any matters con- cerning the location of buildings or other matters which may be referred to them b,,= the Board of Comn;issioners. whenever the Commission shall have made and agreed upon a plan for the development of the municipai-ity or any por- tion thereof, such plan or plans shall be. submitted to the Board of Commiss- ioners for their consideration and action. PLATS END ADDITIONS SUBMI`1'TED TO C0STISSION. SFC. 5. All maps, plats, or re -plats of land laid out in building lots and the streets, alleys or othe portions of the same, intended to be dedicated to public use, or for the use of purchasers or owners of lots fronting thereon or adjacent " there to and lo- cated within the City Limits of the City of Salina or any addition adjoining and connecting with such City shall be submitted to theCity Planning Commis: ion for their consideration and their recommendations, and shall then be sub. raitted to the Board of Corrmrissioners of the City of Salina for the official consideration e.nd action of such Board. No such plat or re -plat shall be filed with the Register of Deeds, protrided by law, until such plat or re -plat shall have the endorsement upon it of the fact that it has been first sub- mitted to the City Planning Commission and by the City PlanninE, Commission to the Governing Board or Body of such City, and by such Governing Body duly approved, in accordance with the requirements of Section of the Revised Statutes of Kansas 1923. PLATS APPROVED BY BOARD OF COMfnjjSlc'�IONERS. P'TLED IFITF REGISTER OF DEEDS. SEC. 6. Any person or corporation desiring to subdivide any tract of land within or touching t'ne boundary line of the City shall plat the same so as tc conform to plats, streets and alleys of said City next adjoining said land and shall submit the plat thereof, together with an abstract of title to the Governing Body of said City for approval before filing said plat in the offic of the Register of Deeds. No reservation shall be made in the dedication of the streets, alleys or public grounds by said grantor in any of such streets, alleys or public grounds for any purpose -whatsoever. When any such plat is filed with the Board of Commissioners of the City of oalina for approval the same shall be referred to the City Planning Commission for their recomm- endation as provided by the preceding Section of this ordinance. No plat or any land of which the streets and alleys do not conform to the streets and alleys next adjoining shall be legal unless the same be submitted to the Board of Commissioners of the City of Salina and by such Board of Comm- issioners approved, or if any reservation is made by the grantor in . any street, alley or public ground contained in any such plat. CITY OPM! STREETS. PLFTS ILLEGAL. SEC. 7. Whenever any plat is filed, the streets or alleys of which do not conform to the streets and alleys of the City of Salina previous17r platted and next adjoining,; such plat, the City of Salina shall have the right, if such plat was not duly approved by the Board of Commissioners of the City of Salina, to open any street or alley through such land, which main conform to the streets or alleys adjoining/such plat and in opening any such street such plat shall be regarded as not having been filed, and the owners of the property through which such streets or alleys are opened or of any other property affected by such opening, shall have recourse for such damages as they may sustain against the grantor or grantors in said plat in accordance with the provisions of Section 13-113 of the Hevised Statutes of Kansas, 1923. CONFLICTING ORDINANCES REPErLED. SFC. S. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and the same are hereby repealed. TAKE EFFECT. SEC. 9.
