3082 Regulating Milk SalesPubli An Ordinance regulating the handling and sale of mill:, cream and ice cream and other dairy products in the City of Salina, Kansas; re- quiring inspection and registration of dairy cows; providing a penalty for the violation of said ordinance and repealing Ord- inance Number 2453 of the City of Salina. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: SANT`ARy AND HEALTH OFFICER, ASSISTANTS. MILK INSPECTOR. DUTIES SEC. 1. The duties required by this ordinance to be performed by the Sanitary and Health Officer of the City of Salina, Kansas and the pow- ers conferred upon him by this ordinance shall be performed by and are hereby conferred upon such officer or any duly authorized or appointed assistant or deputy of such officer or any duly appointed Milk Inspect- or of said City and all reference in this ordinance to the Sanitary and Health Officer shall be deemed to refer to any such assistant, deputy or Milk Inspector. PERSONS SELLING OR HANDLING MILK REQUIRED TO REGISTER ANNUALLY. SEC. 2. It shall be unlawful for any person, firm or corporation to sell or offer for sale, vend, deliver, distribute or serve within the City of Salina any milk_, cream or ice cream without first registering annually with the Sanitary and health Officer, in a book_ provided for that purpose the name and address of such person, firm or corporation, together with the trade name if any,.under which business is carried on, and the source from which any such milk., cream or ice cream is ob- tained. Every person, firm or corporation so registering shall pay to the Sanitary and Health Officer a registration fee of 251 and shall re- ceive a receipt or certificate showing such registration, which shall be kept, at all times, in a conspicuous place in the place of business of such person, firm or corporation. COWS TO BE REGISTERED; CERTIF'IQTE OF VETERINARIAN. SEC. 3. Every person, firm or corporation required to register under the preceding Section hereof who shall sell, offer for sale or deliver within the City of Salina milk produced from cows owned by or in the possession of such person, firm or corporat_on, shall register annually with the Sanitary and Health Officer a proper description of each cow from which any milk is produced and such officer shall assign to each cow an indi- vidual number. No cow shall be registered until the owner or person registering the same shall produce the certificate of a. duly registered and commissioned veterinarian, showing that such cow has been, within one year prior to such registration, inspected and tested for tubercu- losis, and has been found to be free from such disease. The number assigned to any such cow shall be on a metal tag which shall be fasten- ed to the ear of such cow and at all times kept thereon during the 0 period of such registration. The owner or person registering any such cow shall pay to the Sanitary and Health Officer 50Z for the first cow and 10I for each additional cove so registered. USE OF F N DS. SLC. 4. xegiatration fees as provided for in Section 3, under the provisions of this ordinance, shall be paid at the time of the first registration of cows, and although a renewal of the registration is required to be made of said cows annually, no registration fee shall be collected on cows previously registered, but on any additional cows acruired by the owner during the year fees as indicated shall be paid at time of first registration, and said fees sha1,1 be turned over to the City treasurer by the Sanitary and Health Officer, and shall be kept in a special fund to be used in defraying the expense of enforcing this ordinance. REGISTER IdUALLY. SEC. 5. TEST COP.'S FOR TUBERCULOSOS, SEC. 6. Any duly registered and commiss- ioned veterinary surgeon approved by the Board of Commissioners of the City of Salina is hereby authorized to make and test for tuberculosis previously required by this ordinance and such veterinary shall place a tag on the cows that successfully pass the test and shall give a certificate to the person in charge of such cows, and such veterinary surgeon shall dispose of any and all coons found to be afflicted with tuberculosis in accordance with the laws of the State of Kansas. DEFIPiITI0NS OF MILK, CREAM AICD ICF: CREAM. SLC. 7. For the purposes of this ordinance the following definitions of milk, cream and ice cream are hereby adopted. MILK is the fresh clean, lacteal secretion obtained by the complete milking of one or more healthy cows, properly fed and kept, excluding that obtained within 15 days before and 10 days after calving (within which per- iods it shall be unl>wful to sell milks and contains not less than 8.5 per cent of solids not fat and not less than, 3.25 per cent of milk_ fat and con- tains no preservative, added water or other foreign substance. r/ CREM is that portion of milk, rich in milk fat, which rises to the surface of milk on standing or is separated from it by centrifugal force, is fresh snd clean, contains rotless than 1B% of milk fat and contains no preservative or other foreign_ substance. ICE CREAM is a frozen product of the above defined cream, sugar, natural flavoring and such other ingredients as may be permitted by the lavas of the State of Kansas, which shall contain not less than 10% of butter fat. WHIPPING CREM SEC. 8. It shall be unlawful for any person, firm or corporation to sell or offer for sale as "whipping cream" or to label or designate any cream sold or offered for sale as whipping crean unless such cream shall contain not less than 30% milk fat. DIRT OR SEDLI':.EPI'P IN MILK. BLC'TERIA COUNT. SOLIDS. SEC. 9. It shall be unlawful for any person, firm or corporation to sell or offer for sale or to have in possession for sale any milk_ or cream containing a preservative or visible dirt,or,dark co to reds ediment or to which water has been added or which: has been otherwise diluted or any milk showing less than 8.5% of solids not fat, or which contains less than 3.25* fat, or containing less than 11.75 % total solids (unless branded in correct letters and figures the per cent of fat which the milk contain: or any milk which contains more than 2.00,000 bacteria per cubic centi- meter or'sny pastuerized milk which contains more than 500',000 per cubic centimeter or any rp.w cream containing more than 500000 bacteria per cubic centimeter, or any pasteurized cream containing more than 250000 bacteria per cubic centimeter, or any milk, cream, ice cream or other dairy product which does not in all respects comply with all of the provisions of this ordinance. PASTL:URIZED MILK DEFINED. SEC. 10. Only such milk shall be regard- ed as pasteurized as has; been subjected to a temperature of net less than 145 degrees Fahrenheit and kept at such temperature for at least 30 minutes and immediately thereafter cooled to less than 50 degrees Fahrenheit. It shall be unlawful for any person, firm or corporation to sell or offer for sale as pasteurized milk any milk not to treated or to buy, receive or have in possession for pasteurization, any milk which contains more than 500,000 bacteria per cubic centimeter. PASTEURIZING PLt`_NTS. AUTON'OATIC DEVICES. SEC. 11. That in every in milk or cream pasteurizing plant the Cit;- of Salina the automatic tem perature recording devices shall. be installed of such design as rlay be approved by the Sanitary and Health Officer and such devices shall be operated and records kept thereof in such, manner as may be directed' by such officer. It shall be unlawful to sell -or offer for sale any milk or cream or product thereof in the City of Salina, produced in any pas- teurizing plant which has failed to comply with the orders of said officer or with the provisions of this section. PASTEURIZED P�1ILR SOLD wITT1111 36 HOURS. Df -^1E ON CAP. SEC. 12. It shall be unlawful for any person, firm or corporation to sell or offer for sale an) milk or cream except whole raw milk or cream in the City of Salina unless such milk or cream is sold within 36 hours after the same is pastueirzed or otherwise treated or prepared and unless there be. ste.mped or printed on the stoimer or cap of the bottle containing such milk or cream the day of the week when such mile: or cream was pasteurized, treated or prepared or bottled, and no r::ilk shall be sold or kept for sale later than the first day after. the day shown on such cap. TEMPER6.TURF.S OF ElT1.F ITOT OVER 50 DEGREES. SEC. 13. It shall be unlawful for any person, firm or corporation to sell or offer for sale any milk or cream, the temperature of which has been permitted, at any time subsequent to one hour after, the same has been drawn (except during the process of pas- teurization) to arise to 50"degrees Fahrenheit or higher. UNWFOLESOME OR UNFIT PRODUCTS. SALE PROHIBITED. SFC. 14. It shall be unlawful to sell, offer for sale or have in possession for sale for human consumption any butter, butter milk or other dairy product which has spoiled or is unwholesome or unfit for use as food. HOTE1.•S, RESTAURANTS, BOARDING HOUSES ETC. SEC.. 15. It shall be unlawful for any keeper, proprieter or eriployee of a hotel, restaurant, boarding house, lunch counter, or other place where meals are served, to serve or place before any guest, customer or boarder any milk which fails to conform to the standards herein defined unless a placard bearing the words "skimmed milk served here" in plain black letters riot less than 4 inches high on a white back ground is posted conspicuously in such place or to serve or place before any such guest, customer or boarder any cream for use in coffee or for other table use, which fails to conform with the requirements of this ordinance, with reference to cream unless a placard bearing the words "no cream served 'here for coffee or for other table use," in plain black letters not less than 4 inches high on a white back ground is posted consipcuously in such place and in all such cases all such milk er crean; as shall be servk shall conform in all respects other than fat content, to all of the provis- ions of this ordinance. SANITLRs RECEPTACLES, DEi.IVERY. COOLING. SEC. 16. All milk, crearn and ice cream kept, sold or offered for sale shall be at all times Bert and han- dled only in clean and sanitary receptacles, measures and utensils and all such receptacles, measures and utensils shall at all. times be kept in a clean and sanitary place, and protected from dirt, dust and from other con- taminating substances, and during delivery of such milk, cream and ice cream measures and utensils shall be kept inside of a sanitary covered wagon or in a tight box or in a closed compartment having a close fit- ting lid. It shall be unlawful to bottle milk or cream until it has cooled to a temperature of 60 degrees Fahrenheit or, lower. It shall be unlawful to bottle milk or cream from other containers or to transfer milk from one receptacle to another while enroute or to bottle milk or cream or to manufacture ice cream in any room or place which ;s unsan- itary or uniftted for such Purpose. DELIVERED IN SEFLED HFCE11T1,CLES. NAMES ON CEPS. SEC. 17. All milk and cream sold in leas than 1 r:allon lots shall be delivered in sealed receptacles to the purchaser. All milk or cream sold in bottles shall have caps on which shall be printed the name of the person, firm or cal poration bottling the same. STERILIZE RECEPTACLES. SEC. 18. Any person in the City of Salina receiving or having' milk, cream or ice crean: for sale shall keep said products in clean sanitary receptacles, free from rust and in a clean well ventilated sanitary place and it shall be the duty of.said per- sons to thoroughly cleanse and sterilize all milk or cream receptacles and utensils as soon as empty. INSPECTION OF PREP+IISES. ORDERS. REVOCF_TION OF CERTIFICATE. SEC. 19 The Sanitary and Health Officer shall inspect all premises of dairys furnishing milk to the City of Salina and all other places from which any milk, cream or ice cream or other products" thereof are sold, deliv- ered or served in the City of Salina as often as he deems necessary, and shall have authority to prohibit the sale of milk or cream from any dairy in which cows are kept or milk produced or kept in an uns2.nitary place or in violation of the provisions of this ord"irapce. He shall have authority to prohibit the sale of milk kept or delivered in any unclean or unsanitary room, place or vehicle or in vessels not properly cleansed or which is kept, delivered or offered for sale in any manner in violation of the terms of this ordinance. He shall have: the power to enter without previous notice any dairy, milk depot, milk sales room or any place where milk, cream, ice cream "or other products thereof is kept or sold and take such amount thereof as will prove a sufficient sample for the necessary tests. He is hereby authorized to cancel with- out previous notice the registration certificate of any person, firm or corporation who shall vaiolate any of the provisions of tl!is ordin- ance or any of the orders of the Sanitary and Health Officer and it shall thereafter be unlawful for any such person, firm or corporation to sell, offer for sale, deliver or serve or have in possession for sale any milk, cream or ice cream or other products thereof in the City of Jalina un- til such registration certificate shall have been reinstated by order of the Sanitary and Health Officer. DAIRY -BARNS KEDS CLEAN. DISEASSFD AN111TLLS..ORDERS OF'.INSPECTOR. SEC. `20e Banns where dairy cows are housed; where the milk from said cows is to be' sold:in the City. of. Salina�shall.be kept in'a`sufficiently clean'.and_sanitar3 condition at all times so as.to meet with the approval and comply with the directions ,of the sanitary and health officer with 1reference to .the care and condition of such premises. The manure from such barns shall be removed twice -'daily to a distance of at least ;50 feet, from the 'dairy barn..andsha'l1 be•,located or-enclos.ed;'to-_pr,e'vent the -cows from conning in coihtact{'with'it;r Itlshall,;be unlawful, for any person; firm or corporation to sell or offer fol sale or trade or exchange in the City of Salina any milk or cream produced b cows kept in any barn not complying with the foregoing provisions or the owner or which has failed to refuse to keep such, barn or premises clean and to com - ly with or obey the. orders given with reference thereto by the sanitary and Health, or which shall be produced by unhealthy cows or by cows milked or han- dled in the same stable, corral or place of milking where such diseased cows are kept. The heal-th of any such cow shall. be determined by the 6anitery and Health Officer or by any regularly Licensed veterinary surgeon duly app- ointed by such officer for that purpose, whose decision shall be final unless reversed by the State Live Stock Sanitary Commissioner. PRODUCTS IN BARNS, LIVING ROOMS ETC. SALE PROHIBITED. SEC. 21. It shall be unlawful for any person, firm or corporation to sell, offer for sale or have in their possession with intent to sell any milk, cream or ice cream or products thereof bottled, stored or manufactured in any barns, living room, wagon or in any other room or place used for any other than the handling of milk and its products, and any such room or place used for such purpose sha have proper drainage and adequate protection against flies. No milk, cream or ice cream or products thereof shall be sold or offered or kept for sale in any room, any part of which is used for living purposes. DISEASES IN FAMILY. S!.LE OF MILK STOPPED. SEC. 22. Whenever typhoid fe er, scarlet fever, diptheria or other malignant infectious or contagious dis- ease existsamong people living in a family where milk or cream is produced or handled the sale of such milk or cream or product thereof in the City of Salina shall immediately cease and shall not be resumed until an approved physicians- certificate if furnishdd to the Sanitary and Health Officer, show- ing that all danger from infection from such disease is over. DIS^1RIBUTORS FURNISH LIST OF PRODUCERS. SEC. 23, t creamery or other corporation or individual acting as Wilk distributor shall furn- ish to the Sanitary and health Officer of the City of Salina a full list of all producers furnishing m' -1k to them and said list shall be kept up to date from month to month for reference and for a checking system on the part of the Sanitary and Health Officer. SIGNS ON DELIVERY WAGONS. SEC. 24. Every Terson, firm or corpora- tion who shall deliver or distribute any milk, cream or ice cream with in the City of Salina by means of any conveyance shall display on each side of such conveyance in plain readable lettering not less than 4 inches in height the name of such person, firm or, corporation or the trade name which shall have been registered as provided for in erection 2 hereof and it shell be unlawful to deliver or distribute or to sell any milk, cream or ice cream in or from any such conveyance unless such name shall be shown thereon as required by this .section. RETAILERS FURNISH ROUTE SHEETS. SEC. 25. Every person, firm or cor poration selling or delivering milk from house to house or to individu- al consumers at retail within the City of Salina shall furnish at least every 6 months to the unitary and .Health Officer a route: sheet stating the route followed by such person, firm or corporation in the delivery of milk and shall notify the Sanitary and Health Officer at any time of any material change in any such route. Cfi~IsIICL.L AND BACTERIOLOGICAL ANALYSIS. SEC. 26. The Sanitary and Health Officer, or his assistants shall make a chemical and becteriolo g ical analysis of the milk, cream and ice cream supplied or to be fur= r.-ahed and sold in the City of Galina as often as he deems necessary. The Sanitary and Health Officer shall make a report of these investiga- tions and as to the sanitary condition of the dairies furnishing dairy products to the City of Salina ante a month tc the Commission and said findings may be published in one or more of the local newspapers. RULES OF 0011MISSION & SANITARY AND HEALTH OFFICER. SEC. 27. The City Commissioners and Sanitary and Health Officer shall have authority and it shall be their duty to make such reasonable rules and regulation relative to scoring of dairies and grading of milk and cream as shall to found necessary to carry out th.e intent and provisions of this ordinane± VIOLL.TION OF ORDINPNCE. PENALTY. SEC. 28. Any person, including the agent, employee, manager, member, officer or, other representative of any firm or corporation who shall violate any of the provisions of this ordinance or the rules and regulations promulgated by the Board of Commissioners or by the Sanitary and Health Officer of the City of Salina, as provided by this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall, for each offense be punished by a fine of not less than X10.00 nor more than $100.00 and shall be confined to the City .jail until such fines and costs are paid. Milk is the fresh, clean, lacteal secretion obtained by the complete milking of one or more healthy cows, properly fed and kept, excluding that obtained within fifteen (15) days before and ten {10) days after calving (within which periods it shall be unlawful to sell m -ilk) and contains not less than eight and one-half (8.5) per cent of solids not fat, and not less than three and one-quarter (3.25) per cent of milk fat and contains no preservative, added water or other foreign substance. Cream is that portion of milk, rich in milk fat, which rises to the surface of milk on standing, or is separated from it by cen- trifugal force, is fresh and clean, contains not less than eighteen (18) per cent of milk fat, and contains no preservative or other foreign substance. Ice Cream is a frozen product of the above defined cream, sugar, natural flavoring and such other ingredients as may be permitted by the laws of the State of Kansas, which shall contain not less .than ten (10) percent of butter fat. Whipping Cream. Sec. 8. It shall be unlawful for any person, firm or corporation to sell or offer for sale as "whipping cream" or to label or designate any cream sold or offered for sale as "whipping Ceaam" unless such cream shall contain not less than thirty (30) per cent milk fat. Dirt or Sediment in Milk. Bacteria Count. Solids. Sec. 9. It shall be unlawful for any person, firm or corporation to sell or offer for sale or to have in possession for sale any milk or.cream containing a preservative or visible dirt or dark_ colored sediment or to which water has been added or which has been otherwise diluted, or any milk showing less than eight and one-half (8.5) per cent of solids not fat, or which contains less than three and one-quarter (3.25) per cent fat, or containing less than eleven and three-quarters (11.75) per cent total solids, (unless branded in correct letters and figures the per cent of fat.which the milk contains) or any milk which contains more than 200,000 bacteria per cubic centimeter or any pasteur- ized milk which contains more than 50,000 bacteria per cubic centi- meter, or any raw cream containing more than 500,000 bacteria per cubic centimeter, or any pasteurized cream containing more than 250,000 bacteria per cubic centimeter, or any milk, cream, ice cream or other dairy product which does not in all respects comply with all of the provisions of this ordinance. Pasteurized Milk Defined. Sec. 10. Only such milk shall be re- garded as pasteurized as has been subjected to a temperature of not less than 145 degrees Fahrenheit and kept at such temperature for at least thirty minutes, and immediately thereafter codled to less than fifty degrees Fahrenheit. It shall be unlawful for any person, firm or corporation to sell or offer for sale as pasteurized milk any milk not so treated, or to buy, receive or have in possession i for pasteurization, any milk which contains more than 500,000 bacteria per cubic centimeter. Pasteurizing Plants. Automatic Devices. Sec. il. 2hat in every milk or cream pasteurizing plant in the City of Galina automatic tem- perature recording devices shall be installed of such design as may be approved by the Sanitary and Health officer and such devices shall be operated and records kept thereof in such manner as may be directed by such officer. It shall be unlawful to sell or offer for sale any milk or cream or product thereof in the City of Salina, produced in any pasteurizing plant which has failed to comply with the orders ov u,.ctSC of said officernw 2 the pr visions of this section. Pasteurized milk sold within hours. Date on Cap. Sec. 12. It shall be unlawful for any person, firm or corporation to sell or or offer for sale any milk,/cream except whole raw milk or cream in the `'ity of Jalina unless such milk or cream is sold within thirty-six hours after the same is pasteurized or otherwise treated or prepared, and unless there be star;ped or printed on the stopper or cap of the bottle containing such milk or cream the day of the week when such milk or cream was pasturized, treated or prepared or bottled, and no milk shall be sold or kept for sale later than the first day after the day shown on such cap. Temperature of milk not over 50 degrees. Sec. 13. It shall be unlawful for any person, firm or corporation to sell or offer for sale any milk or cream, the temperature of which has been permitted, at any time subsequent to one hour after the same has been drawn, (except during the process of pasteurization) to arise to fifty degrees 1ahrehheit or higher. Unwholesome or Unfit Products. Sale Prohibited. Sec. 14. It shall be unlawful to sell, offer for sale or have in possession for sale, for human consumption, any butter, butter milk or other dairy product which has spoiled or is unwholesome or unfit for use as food. Hotels, Restaurants, Boarding houses, etc. Sec. 15. It shall be unlawful for any keeper, proprietor or employee of a hotel, res- taurant, boarding house, lunclz counter, or other place where meals are served, to serve or place before any guest, customer or boarder any milk which fails to conform to the standards herein defined, unless a placard bearing the words "skimmed milk served here" in plain black letters, not less than four inches high on a white back ground is n posted conspicuously in such place, o.r to serve or place before any such guest, customer or boarder any cream for use in coffee or for other table use, which fails to conform with the requirements of this ord- inance rd-inance with reference to cream unless a placard bearing the words "no cream served here for coffee or for other table use," in plain black letters not less than four inches high on a white back ground is posted conspicuously in such place, and in all such cases all such milk or cream as shall be served shall conform in all respects other than fat content, to all of the provisions of this ordinance. Sanitary Receptacles, Delivery. Cooling. Sec. 16, All milk, cream and ice cream kept, sold or offered for sale shall be at all times kept and handled only in clean and sanitary receptacles, measures and utensils, and all such receptacles, measures and utensils shall, at all times, be kept in a clean and ` sanitary place, and protected from dirt, dust and from other cont'kminating substances, and during delivery of such milk, cream and ice cream measures and utensils shall be kept inside of a sanitary covered wagon or in a tight box, or in a closed compartment having a close fitting lid. It shall be unlawful to bottle milk or cream until it has cooled to a temperature of sixt77 degrees Fahrenheit or lower. .It shall be unlawful to bottle milk or cream from other containers or to transfer milk from one recep- tacle to another while enroute or to bottle milk or cream or to manu- facture ice cream in any room or place which is unsanitary or unfitted for such purpose. Delivered in Sealed "eceptacles. Names on Caps. Sec. 17. All milk and cream sold in less than one gallon lots shall be delivered in sealed receptacles to the purchaser. tll milk or cream sold in bottles shall have caps on which shall be printed the name of the person, firm or corporation bottling the same. Sterilize eceptacles. Sec. 18. Any person in the City of Salina receiving or having milk, cream or ice cream for sale shall keep said products in clean sanitary receptacles, free from rust; and in a clean well ventilated and sanitary place, and it shall be the duty of said persons to thoroughly cleanse and sterilize all milk or cream recep- tacles and utensils as soon as empty. Inspection of Premises., Orders. Revocation of Certificate. Sec. 19 The Sanitary and health Officer shall inspect all .premises of dairys furnishing milk to the City of Galina and all other places from which any milk, cream or ice cream or other products thereof are sold, deliv- ered or served in the City of Salina as often as he deems necessary, _,nd shall have authority to prohibit the sale of milk or cream from any dairy in which cows are kept or milk produced or kept in an unsanitary place or in violation of the provisions of this ordinance. He shall have authority to prohibit the sale of milk kept or delivered in any unclean or unsanitary room, place or vehicle or in vessels not properly cleansed, or which is kept, delivered or offered for sale in any manner in violation of the terms of this ordinance. He shall have the power to enter without previous notice any dairy, milk depot, milk sales room or any place where milk, cream, ice cream or other products thereof is kept or sold and take such amount thereof as will prove a sufficient sample for the necessary tests. IIe is hereby authorized and it shall be his duty to cancel without previous notice the registration certi- ficate of any person, firm or corporation who shall violate any of the provisions of this ordinance or any of the orders of the Sanitary and nealth Officer and it shall thereafter be unlawful for any such person, firm or corporation to sell, offer for sale, deliver or serve or have in possession for sale any milk, cream or ice cream or other products thereof in the City of Salina until such registration certi- ficate shall have been reinstated by order of the z1anitary and Health Officer. Dairy Barns Kept Clean. Diseased knimals. Orders of Inspector. Sec. 20. Barns where dairy cows are housed, where the milk from said cows is to be sold in the City of 6alinfi• shall be kept in a sufficiently clean and, sanitary condition at all times so as to meet with the approval and comply with any directions of the sanitary and Health' officer with rt!ference to the care and condition of such premises. 'lhe manure from such barns shall be removed twice daily to a distance of at least 50 feet from the dairy barn and shall be located or enclosed to prevent the cows from coming, in contact with it. It shall be unlaw-_ ful for any.person, firm or corporation to sell or offer for sale or_ trade or exchange in the Pity of Salina any milk or cream produced by cows kept in any barn not complying with the foregoing provisions, or the owner of which has failed or refused to keep such barn or premises clean or to comply with ar obey the orders given with reference thereto by the Sanitary and health Officer, or which shall be produced by unheal- thy cows or by cows milked or.handled in the same stable, corral or place of milking where such diseased cows are kept. The health of any such -cow shall be determined by the unitary and Health Officer or by any'regularly licensed veterinary surgeoh duly appointed by such officer for that purpose, whose decision shall be final unless reversed by the State Live'Stock Sanitary Commissioner. Sec. 21 Products -in Barns, Living Rooms, etc. Sale Prohibited. /It shall be unlawful for any person, firm or corporation to sell., offer for sale or have in their possession with intent to sell any milk, cream or ice cream or products thereof, bottled, stored or manufactured in any barns, living room,_wagon or in any other room or place used for any other than the handling.of milk and its' products,, and any such room or place used for such purpose shall have proper drainage and adequate protection against flies. No milk, cream or tce cream or products thereof shall, be sold or offered or kept for sale in any room; any pert of which is #6 used for living purposes. Diseases in Family. Sale of Milk Stopped. Sec. 22. whenever typhoid fever, scarlet fever, diptheria or other malignant infectious or contagious disease exists among people living in a family where milk or cream or any product of milk or cream is produced or handled, the sale of such milk or cream or product thereof in the amity of Salina shall immediately cease, and shall riot be resumed until an approved physician's certificate is furnished to the Sanitary and Health Officer, showing that all danger from in ection from such disease is over. Distributors furnish List of Producers. Sec. 23. tiny creamery or other corporation or individual acting as milk distributor shall fur- nish to the Sanitary and Health Officer of the City of Salina a full list of all producers furnishing milk to then: and said list, shall be kept up to date from month to month for reference and for a check- ing system on the part of the banitary and health Officer. Signs on Delivery Wagons. Sec. 24. Every person, firm or corpora- tion who shall deliver or distribute any milk, cream or ice cream within the City of Salina by means of any conveyance shall display on each side of such conveyance in plain readable 'lettering not less than inches in height, the name of such person, firm or corporation or the trade name which shall have been registered au provided for in Section 2 hereof, and it shall be unlawful to deliver or distribute or to sell any milk, crearn or ice cream in or from any such convey- ance unless such name shall be shown thereon as required by this see - tion. Retailers Eurnish Route Sheets. Sec. 25. Every person, firm or corporation selling or delivering milk from house to house or to indi- vidual consumers at retail within the City of Salina shall furnish at least every six months to the Sanitary and Health Officer a 'route sheet" stating the route followed by such person, firm or corporation in the delivery of milk and shall notify the Sanitary and Health officer at any time of any material change in any such route. Chemical and Bacteriological Analysis. Sec. 26. The "anitary and health Officer, or his assistants shall make a chemical and bac- teriological analysis of the milk, cream and ice cream supplied to or furnished and sold in the City of yalina as often as he deems necessary. 'lhe Sanitary and health Officer shall make a report of these investi- gacions and as to the sanitary condition of the dairies furnishing dairy products to the City of Salina once a month to the City Commiss- ion, and said findings.may be published in one or more of the local newspapers. Rules of Commission and Sanitary and Health Officer. Sec. 27 The City Commissioners and Janitary and health Officer sha11 have auth- ority and it shall be their duty to make such reasonable rules and reg- ulations relative to the scoring of dairies and grading of milk and cream as shall be found necessary to carry out the intent and provis- ions of this ordinance. Violation of Ordinance. Penalty. Sec. 28. Any person, including the agent, employee, manager, member, officer or other representative of any firm or corporation, who shall violate any of the, provisions of this ordinance or the rules and regulations promulgated by the Board of Commissioners or by the Sanitary and Health Officer of the City of Salina, as provided by this ordinance, shall be deemed guilty of a mis- demeanor and upon conviction thereof shall, for each offense, be punished by a fine of not less than $10.00 nor more than,%$100.00 and shall be confined to the Oity .jail until such fines and costs are paid. Priot Ordinance Repealed. Sec. 29. That Ordinance Number 2663 of the City of Galina be and the same is hereby repealed. take effect. Sec. 30. This ordinance shall take effectandbe in full force from and after its publication in thel aP,ces-of the City of balina. Introduced for first reading, February 2nd, 1925.
