3048 Licensing VehiclesAn ordinance regulating the licensing and limiting the operation
of vehicles upon th-, streets and avenues of the City of
Salina, Kansas engaged in the carrying of passengers for
hire between fixed points within the City of Salina,
Kansas or between points within the City of Salina, Kansas
and without said City of Salina, Kansas, or between points
wholly without the City of Salina, Kansas but whose route
lies over and through the streets and avenues within said
City of Salina, and providing penalties for the violation
of this ordinance.
BE IT ORDAINED by the Board of Commissioners of the City of
Salina, Kansas:
Section 1. That the word "vehicle" as used in this ord-
inance shall include any vehicle, however propelled, except
such as run upon tracks or rails, employed.in the business of
transporting passengers for -hire between.points within the City

wholly without the City of Salina, �Fan`sf� but whose route lies
over and through the streets and avenues of said 6ity,s uch
vehicles being commonly known as busses or stages.
Section 2. No person, firm or corporation shall engage
in the business of driving or operating any vehicle within the
meaning of this ordinance and for the purposes hereinbefore
specified upon, the strests and avenues of the City of Salina,
liansas without first procuring from said City a license so to
do, and paying the license:fees hereinafter specified, and
complying fully with -the requirements of this ordinance.
Section 3. Before any such license shall be granted to
the applicant therefor, such applicant shall file with the City
Clerk a statement setting out the type of vehicle to be used
the make, horse power, factory number, the state license number
there of if a motor vehicle, the seating capacity according to
its trade rating or the actual seating capacity thereof if the
same be different from said trade rating, the name, age and
residence of the -person or persons to be in immediate charge
thereof as driver, and a statement showing that such person has
attained the age of at least 21 years, the qualifications and ex-
perience of said person or persons, the name of the owner or
owners of said vehicle or vehicles, the streets or avenues upon
which it is intended to operate said vehicle, which sand state-
ment shall be made on oath, and there shall be filed with the
City Clerk a schedule of all fares proposed to be charged, which
schedule shall be considered as part of the license if granted.
Section 4. Such application and schedules shall be sub-
mitted to the Board of Commissioners, who may grant or reject
any such application, and if rejected other applications may be
made and either granted or rejected.
Section 5. The owners of all vehicles procuring a license
hereunder, after the application therefor has been approved as
herein provided, and before any license is issued, shall pay to
the City Clerk of Salina, in advance, an annual license fee for
each vehicle as follows:- For each vehicle with a seating capacity
of 7 passengers or less, $20,00; for each vehicle with a seating
capacity of more than 7 and not more than 16 passengers, 430.00;
for each vehicle with a seating capacity of more than 16 and not
more than 20 passengers, $40.00; and for each vehicle with a seating
capacity of more than 20 passengers, 450,00. All such license fees
shall be due and payable on the 1st day of January of each year or
whenever during the year the opeation of any such vehicle within the
City of Salina is commenced, PROVIDED HOWEVER, that after the 1st day
of July one-half of the license fee above provided for shall be paid
e. for the remaining portion of any such year.
Section 6. The license 6s herein provided shall be issued by
the City Clerk and signed by him, and shall describe and give the name
of the owner or owners of the vehicle licensed and shall cor,,tain a
description of said vehicle, stating the make, motor number, carrying
capacity thereof and the state license number when ascertained shall
be inserted therein, and shall certify that the owner or owners thereof
have complied with the provisions of this ordinance.
Section 7.. The license so issued shall be posted in a conNpicu-
ous place in such vehicle and shall be carried therein at all times,
and it shall be unlawful for any person, firm or corporation driving
or operating any such vehicle to post or to carry any such vehicle
license issued for any other vehicle.
Section G. After a license has been granted to operate any such
vehicle and before the same shall be driven or operated upon the stree
or avenues within the City of Salina, Kansas, a printed schedule of
fares shall be posted in a conspicuous place in said vehicle, and it
shall be kept so posted at all times while the same is in operation
within the City of Salina, Kansas.
Section 9. Any person, firm or corporation owning or oper-
ating any such vehicle shall, whenever a change is made in the
schedule of rates or in the route within the City of Salina to
be used -or followed by said vehicle or in the person driving
6r 'in charge of the same within the City of ?alina, notify the
City Clerk of said City in writing of such change, and it shall
be. unlawful for any person, firm or corporation operating or d riv-
ing any such vehicle to operate or drive the same within the City
of Salina o.ver streets other than those mentioned in the appli-
cation for a license or in any written, notice of change addressed
to the City Clerk, except temporarily and in case ofan unforseen
emergency or to charge any other different rateari;from.those con-
tained in any schedule of rates filed with the City Clerk of the
City of Salina, any such changes 'to be approved by the Board of
Commissioners.
Section 10. If any vehicle which is being operated under
the provisions of this ordinance shall be driven off of the route
designated in the schedule required herein to be filed, for the
purpose of taking on or discharging passengers, it shall be deemec
to be operating as a taxi -cab, and shall be subject to the pay-
ment of a liceense fee as required for taxi -cabs: but shall not
for such reason be relieved of the payment of the license fee as
required by this ordinance and if any such vehicle shall deviate
from the schedule on file for such purpose without complying
with the ordinance relating to taxi -cabs the person or,persons,
firm or corporation driving or operating .the same shall deemed
guilty of a violation of-ths ordinance relating to taxi -cabs as
well as of this ordinance.
Section 11. There shall at all times, be posted in a con-
spicuous place in any such vehicle, the name of the driver or
person in charge of such vehicle at that particular time, and it
shall be unlawful for any person to drive or operate any such
vehicle unless his name is so posted therein.
Section 12. Any vehicle operating under the provisions of
this ordinance shall be brought to a full stop before crossing
any street railway track or any track or series,of tracks of any
steam railroad and at -all other places where vehicles are re-
quired to stop by the ordinances of the •C1ty.of Salina, Kansas.

Section 13. Any person or firm or corporation operating any ve-
hicle within the meaning of this ordinance shall use such streets and
shall load and unload passengers at such points and places within the
City of Salina as may be designated by the Board of Commissioners of
said City.
Section 14. It shall be unlawful for any person, firm or corpor-
ation to operate or for any agent, 'manager, officer, partner or other
representative to permit or direct the operation of any such vehicle
after the license thereof has been revoked.
Section 15. All license fees collected under the provisions of
this ordinance shall be paid to the.Uity Clerk of Salina, Kansas and
by him' paid into the City Treasury to the credit of. the General Fund
and the City 'lreesurer shall on the 30th day of June and the 31st
day of December of each year transfer all such license fees so
collected under the provisions of this ordinance to the Improvement
Fund of'seid City to be used for the geareral upkeep and repair of
the streets and avenues within the City of Galina, Kansas.
Section 16. No license, as herein provided for shall be issued
until the applicant therefor shall secure from the License Inspector,
of the City of balina, whose duties shall be performed by the Build-
ing Inspector until otherwise provided by ordinance, a certificate
showing that such vehicle is in good, sound and safe condition, both
mechanically and otherwise; for use in the business of carrying
passengers for hire, and the License Inspector shall have authority
at any time, after a license is granted, to examine and inspect any
such vehicle. If on any such examination it shall be determined that
such vehicle is in an unsafe or unsound condition mechanically or
otherwise or if said vehicle.is not in a clean and sanitary condition
any license which may have been issued for the operation of such
vehicle shall be revoked by the Board of Commissioners upon the
recommendation of the Liconse Inspector, and it shall thereafter be
unlawful for any person to drive or operate any such vehicle upon the
streets, avenues or public thoroughfares of the City of Galina until
a new license shall have been secured or until the order revoking
any such license shall have been set aside by the board of Commiss-
ioners.
Sectionl7. Any person, firm or corporation operating any
vehicle as in this ordinance defined, or any agent, manager, officer
partner or other representative of any person, firm or corpora-
tion operating any vehicle as in this ordinance defined, or who
shall permit the operation of such vehicle without having a licene
so to.do as required herein, or without complying with the pro-
visions of this ordinance or who shall violate or permit the vio-
lation of any of the provisions of this* ordinance shall be deemed
guilty of a misdemeanor and upon conviction thereof shall be finec
in any sum not exceeding X100.00 or be imprisoned in the City
jail for a term not exceeding 30 day's or shall be subject to both
such fine and imprisonment and any or all licenses issued be
any such person, firm or corporation_ may on account of such
conviction be revoked by the Board of Commissioners of said City.
Section 18. The holding or adjudication of any section or a
part of this ordinance to be invalid shall not effect the valid.it3
of any other section or part thereof, but all other sections and
parts of this ordinance shall be and remain in full force and
effect.
Section 19. This ordinance shall take effect and be in full
force from and after the 1st day of January, 1925 and after its
publication once in the official City paper.

tended to operate said vehicle, which said statement shall be made
on oath, and there shall be filed with the City Clerk a schedule
of all fares proposed to be charged, which schedule shall be con-
sidered as part of the license if granted.
r\ Section 4. Such application and schedules shall be submitted
to' the Board of Commissioners, who may grant or reject any such
application and if rejected, other applications may be made and
either granted or rejected.
Section 5, The owners of all vehicles procuring a license
hereunder, after the application therefor has been approved as
herein provided, and before any license is issued, shall pay to
the City Clerk of Salina, in advance, an annual license fee for
each vehicle as follows:- For each vehicle with a seating capacity
of 7 passengers or less, X20.00; for each vehicle with a seating
capacity of more than 7 and not more than 16 passengers, $30.00;
for each vehicle with a seating capacity of more than 16 and not
more than 20 passengers, $40.00; and for each vehicle with a seat-
ing capacity of more than 20 passengers, x$50.00. All such license
fees shall be due and payable on the 1st day of January of each
year or whenever during the year the operation of any such vehicle
within the City of .Salina is commenced, provided however, that after
the 1st day of July one-half of the license fee above provided for
shall be paid for the remaining portion of any such year.
Section 6. The license as herein provided shall be issued by
the City Clerk and signed by him, and shall describe and give the
name of the owner or owners of the vehicle licensed and shall contain
.a description of said vehicle, stating the make, motor number,
carrying capacity thereof, and the state license number when as-
certained shall be inserted therein, and shall certify that the
owner or owners thereof have complied with the provisions of this
ordinance.
Section 7. The license so issued shall be posted in a con-
spicuous place in such vehicle and shall be carried therein at all
times, and it shall. be unlawful for any person, firm or corpora-
tion driving or operating any such vehicle to post or to carry
any such vehicle license issued for any other vehicle.
Section 8. After a license has been granted to operate any
such vehicle and before the same shall be driven or operated upon
the streets or avenues within the City of Salina, Kansas, a printed
schedule of fares shall be posted in a conspicuous place in said
vehicle, and shall be kept so posted at all times while the same
is in operation within the City of Salina, Kansas.
Section 9. Any person, firm or corporation owning or oper-
ating any such vehicle shall, whenever a change is made in the
schedule of rates or in the route within the City of Salina to be
used or followed by said vehicle or in the person driving or in
charge of the same within the City of Salina, notify the-�
sal of said City in writing of such change and it shall
be unlawful for any person, firm or corporation operating or driv-
ing any such vehicle to operate or drive the same within the City
of Salina over streets other than those mentioned in the appli-
cation for a license or in any written notice of change addressed
to the City Clerk, except temporarily and in case of an unforseen
emergency•or to charge any other or different rates from those
contained in any schedule of rates filed with the City Clerk of
the City of Salina, any such changes to be approved by the Board
of Commissioners.
Section 10.. If any vehicle which is being operated under the
provisions of this ordinance shall be driven off of the route des-
ignated in the schedule required herein to be filed, for the pur-
pose of taking on or discharging passengers, it shall be deemed to
be operating as a taxi -cab within'the meaning of the ordinance of
the City relating to taxi -cabs, and shall be subject to the payment
of a license fee as required for taxi -cabs; but shall not for such
reason be relieved of the payment of the license fee as required by
this ordinance; and if any such vehicle shall deviate from the sched-
ule on file for such purpose, without complying with the ordinance
relating to taxi -cabs the person or persons, firm or corporation
driving or operating the same shall be deemed guilty of a violation
of the ordinance relating to taxi -cabs as well as of this ordinance.
Section 11. 'There shall, at all times, be posted in a con-
spicuous place in any such vehicle, the name of the driver or person
in charge of such vehicle at that particular time, and it shall be
unlawful for any person to drive or operate any such vehicle unless
his name is so posted therein.
Section 12. Any vehicle operating under the provisions of
this ordinance shall be brought to a full stop before crossing any
street railway track or any track or series of tracks of any steam
railroad and at all other places where vehicles are required to stop
by the ordinances of the City of Salina, Kansas.
Section 13. Any person or firm or corporation operating any
vehicle within the meaning of this ordinance shall use such streets
and shall load and unload passengers at such points and places within
the City of Salina as may be designated by the Board of Commissioners
of said City.
Section 14. It shall be unlawful for any person, firm or cor-
poration to operate or for any agent, manager, officer, partner or
other representative to permit or direct the operation of any such
vehicle after the license thereof has been revoked.
Section 15. All license fees collected under the provisions
of this ordinance shall be paid to the City Clerk of Salina, xansas
and by him paid into the City Treasury to the credit of the General
Fund and the City Treasurer shall on the 30th day of June and the
31st day of December of each year transfer all such license fees

pair of the streets and avenues within the City of Salina, Kansas.
Section 16. No license, as herein provided for shall be issued
until the applicant therefor shall secure from the License Inspector
of the City of Salina, whose duties shall be performed by the Build-
ing Inspector until otherwise provided by ordinance, a certificate
showing that such vehicle is in good, sound and safe condition,
both mechanically and otherwise for use in the business of carry-
ing passengers for hire, and the License Inspector shall have author-
ity at any time, after a license is granted, to examine and inspect
any such vehicle. If on any such examination it shall be deter-
mined that such.vehicle is in an unsafe or unsound condition mechan-
ically or otherwise, or if said vehicle is not in a clean and san-
itary condition any license which may have been issued for the oper-
ation of such vehicle shall be revoked by the Board of Ccmmissioners
upon the recommendation of the License Inspector, and it' shall
thereafter be unlawful for any person to drive or operate any such
vehicle upon the streets, avenues or public thoroughfares of the
City of Salina until a new license shall have been secured or until
the order revoking any such license shall have been set aside by
the Board of Commissioners.
Section 17. Any person, firm or corporation operating any
vehicle as in this ordinance defined, or any agent, manager, officer
partner or other representative of any person, firm or corporation
operating any vehicle, as in this ordinance defined, or who shall
permit the operation of such vehiclq without having a license so
to do as required herein, or without complying with the provisions
of this ordinance, or who shall violate or permit the violation
of any of the provisions of this ordinance shall be deemed guilty
of a misdemeanor and upon conviction thereof shall be fined in any
sum not exceeding 4100.00 or be imprisoned within the City Jail for
a term not exceeding 30 days or shall be subject to both such fine
and imprisonment and any or all licenses issued to any such person
firm or corporation may iA►on account of such conviction be revoked
by the boi�,rd of Commissioners of said City.
Section 18. The holding or adjudication of any section or a
part of this ordinance to be invalid shall not effect the validity
of any other section or part thereof, but all other sections and
parts of this ordinance shall be and remain in fall force and effect.
Section 19. This ordinance shall take effect and be in full
force from and after the 1st day of January, 1925 and after its
publication once in the official City paper.
