3043 Prohibiting Street or Sidewalk StandsFS An Ordinance prohibiting the occupancy of any street within the City of Salina, Kansas, by certain street or sidewalk stands from which is sold or offered for sale certain merchandise, prohibiting the issuance of any license for any such street or sidewalk stand and repealing all ordinances or parts thereof in conflict herewith BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Sectionj. That from and after the taking .effect of this ord- inance no stre4 or sidewalk stand from which is sold or offered for sale fruit, egetables, garden truck or other similar merchan- dise, shall be pe itted to occupy any street or part thereof within the City of Salina, Kansas, and it shall.be unlawful.for any person \Q owning or in charge f any wagon, cart or stand.to..permit the same to stand in or occupy ny street or part thereof within the City ®. of Salina, Kansas, PRO DED HOWEVER, that this ordinance shall not i be construed to prohibit the sale of fruit, vegatables, garden truck or other similar merchand e by any duly licensed vendor or peddler, whenever such vendor or pe ler shall keep the cart, wagon or other vehicle from which such mercAandise is sold moving, except when engaged in making a sale of such marc\ater e and except atsuchtimes as such person may be reasonably requo stop for temporary purposes. Section 2. shat from anthe taking effect of this ord- inance no licdnse shall be isy the Uity Clerk to any person for the operation of any street or sid4alk stand for the purpose of permitting any such street or sidewalk stand for the sale of mer- chandise mentioned in Section One (1)��ereof, to occupy any street or part thereof within the City of Sal i a, Kansas. Section 3. That the provisions of ection 30 of Ordinance Number 1688 of the City of SalinaKansas in so far as it relates to licenses for street stands from which i sold oroffered for sale fruit, vegetables, garden truck or other sim lar merchandise, knd that the provisions of Section 31 of laid Ord ante Number 1688, in so far as,it relates to the issuance�of lie ses for sidewalk stands from which is sold or offered foltsale`fr it, vegetables, garden tf'uck or other similar merchandise, and al�\ other ordinances or parts of ordinances in conflict herewith be and\`the same are hereby repealed. Section 4. 'chat any person violating any of therovisions of this ordinance shall be deemed guilty of a misdemea r and upon conviction thereof shall be fined in any sum not exceedl�kg 4P25.00. Section 5. That this ordinance shall take effect and be in full force from and after January.lst, 1925 and after its publication once in the official City'paper. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas; Section 1. That from and after the taking effect of this ord- inance no street or sidewalk stand from which is sold or offered, for sale fruit, vegetables, garden truck or other similar merchan- dise, shall be permitted to occupy any street or part thereof within the City of Salina, Kansas, and it shall be unlawful for any person owning or in charge of any wagon, cart or stand to permit the same to stand in or occupy any street or part thereof within the City of Galina, nansas, PROVIDED HOWEVER, that this ordinance shall not be construed to prohibit the sale of fruit, vegetables, garden truck or other similar merchandise by any duly licensed vendor or peddler, whenever such vendor or peddler shall keep the cart, wagon or other vehicle from which such merchandise is sold moving, except when engaged in making a sale of such mer- chandise and except at such times as such person may be reasonably required to stop for temporary purposes. Section 2. That from and after the taking effect of this ordinance no license shall be issued by the City Clerk to any per- son for the operation of any street or sidewalk stand for the purpose of permitting any such street or sidewalk stand for the sale of merchandise mentioned in bection One (1) hereof, to. occupy any street or part thereof within the city of Salina, Kansas. Section 3. That the provisions of Section 30 of Ordinance Number 1688 of the City of Salina, isansas, in so far as it re- lates to licenses for street stands from which is sold or offered for sale fruit, vegetables'garden 'truck or other similar merchan- dise, and that the provisions of Section 31 of said Ordinance Number 1688, in so far as it relates to the issuance of licenses for sidewalk stands from which is sold or offered for sale fruit, vegetables, garden truck or other similar merchandise, and all other ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. Section 4. That any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not exceeding Twenty-five Dollars ($25.00). Section 5. That this ordinance shall take effect and be in full force from and after January 1st, 1925 and after its publi- cation once in the official City paper.
